Testing Conditions. A. POST-ACCIDENT. In light of the change in definition, driving CDL holders will be tested for drugs and alcohol as soon as practicable after any accident in which they were involved as driver if:
1. there was a fatality, or
2. the driver received a citation for a moving traffic violation arising from the accident, or
3. there was a serious injury requiring the injured person to leave the scene of the accident for immediate treatment. A driver who is subject to post-accident testing shall remain readily available for such testing. Otherwise, that driver may be deemed by the employer to have refused to submit to testing. Nothing in this section shall be construed to require the delay of necessary medical attention for injured people following an accident or to prohibit a driver from leaving the scene of an accident for the period necessary to obtain assistance in responding to the accident, or to obtain necessary emergency medical care.
Testing Conditions. 5.3.1 During the period of testing and commissioning of the Generation Facility, all of the electricity that Generator makes available for delivery to MSEDCL/MSETCL at the interconnection Point shall be treated as lapsed and no payment shall be made by MSEDCL.

d. Refusal to submit to such testing may subject the employee to discharge, but the employee's taking of such test shall not constitute a waiver of any objec- tion or rights that the employee may have.
(b) Prior to release from the Field Training Program to duty status, a probationary employee may be required to supply blood or urine testing without the requirement of "reasonable suspicion".
(c) The Employer may require an employee to supply a blood or urine sample for testing upon reinstatement to active status following any leave of absence in excess of thirty (30) days without the requirement of "reasonable suspicion".
(d) The Employer may require an employee to supply a blood or urine sample for testing as a condition of the promotional process or for initial employment with the Employer, without the requirement of "reasonable suspicion".

Testing Conditions. Testing can only take place in the presence of a technical advisor from the Seller’s. Should the tested equipment be damaged as a result of a non-conforming use and outside the presence of the Seller’s technical advisor, the cost of repairing the damaged equipment shall be borne by the client who is responsible for carrying out the testing. Should the testing prove inconclusive, the client who has conducted it shall within 8 days of receiving the tested equipment inform the Seller and explain why the testing was inconclusive (giving the exact testing conditions) and hold the equipment at the disposal of the Seller’s technical advisor in charge of supervising the testing who will check the returned equipment. Should tested equipment require repairing after being subject to intensive use, the cost thereof will be invoiced to the client who has conducted the testing.
