Type Description Clause Samples

A Type Description clause defines and clarifies the specific nature or category of an item, service, or obligation referenced in the contract. It typically outlines the essential characteristics, specifications, or classifications that apply, such as identifying whether a product is a finished good, a raw material, or a service, and may include relevant standards or codes. By providing this detailed description, the clause ensures that all parties have a shared understanding of what is being supplied or performed, thereby reducing ambiguity and minimizing the risk of disputes over interpretation.

Usually, you can participate in another study as soon as 30 days after you received the last dose of drug in the study you were in. This information is true for most drugs. Some drugs may stay in your body longer and that may mean you may have to wait longer before starting another study. These results are usually only known after the last blood sample taken from you is tested to look for left-over drug. We will always make this information available to you as soon as we know. Our goal is to keep you from doing anything that may be potentially harmful to you. Your safety while participating in these studies is our primary concern. You cannot be enrolled in the study if, at screening you: • Report a history of allergic reactions or oversensitivity to drugs like rezafungin or the inactive ingredients (mannitol, polysorbate 80, histidine) of the injectable form of rezafungin (Rezafungin for Injection); • experience symptoms of an illness within 14 days before the first dose of study drug, or if the Study Doctor feels you are not in good health; • if you weigh less than 50 kg (110 lbs.) and/or have a body mass index (BMI) calculated from your height and weight that is less than 18.5 kg/m2 or more than 35.0; • have a positive HIV or hepatitis test result, abnormal laboratory test results that are not due to a transient (passing) condition, or an abnormal electrocardiogram (ECG); • Are pregnant or planning to become pregnant during the study or a minimum of 30 days after the study, or if you are breastfeeding, or if you have any medical conditions that could make it potentially unsafe for you to participate in the study (for females); • are plann...

Type Description. 2 Legal provisions cannot be enforced 3 Legal provisions are not fit for purpose to protect the fundamental right at stake Let me briefly explain the need to investigate these three types of legal problems in particular. Both the right to privacy and data protection are fundamental rights in the EU.634 Violations of fundamental rights, which constitute Type 1 legal problems, must be prevented. For example, unsupervised ML approaches process personal data for inexplicit purposes – the processing itself determines the pur- pose and future use of the personal data. Such processing violates the purpose limitation principle, which constitutes a Type 1 legal problem. Type 2 legal problems, namely, when legal provisions cannot be enforced, are not acceptable either because they lead to negative consequences for the de facto protection of fundamental rights. For example, the unclear substantive meaning of the fairness principle reduces legal certainty and makes it less likely that this principle will be enforced by means 633 Admittedly, this is not a traditional data protection principle. Nonetheless, it could be regarded as a principle in a broader sense, which then also aligns with the approach taken in this chapter. 634 Article 7 and 8 CFREU. of private litigation and by supervisory authorities, which leads to Type 2 problems. Furthermore, Type 3 legal problems, namely, legal provisions that are not fit for purpose, point to the shortcomings of the current legal framework. Legal provisions are not fit for purpose, for instance, when they fail to achieve legislative aims, are not effective or create a gap of protection. For example, the principle that special categories of personal data receive enhanced protection and the legislator’s approach to exhaustively enumerate special data cause a Type 3 legal problem. This approach does not keep up with technological developments facilitated by AI. It leads to significant gaps of protection, for ex- ample, regarding the processing of new types of sensitive personal data generated by AI, such as emotion data, neurodata and mental data. Insights about this type of legal problems are essential when considering how the legal problems should be addressed, which is the aim of Subquestion 5 (see Chapter 6). As indicated in Section 1.4, the scope of this thesis is limited to legal problems related to the funda- mental rights to privacy and data protection. Thus, this chapter identifies legal problems arising pri- ▇▇▇▇▇▇ from t...
Type Description. The uncertainty associated with radiometric responsivity of an OCR shall be estimated and delivered to FRMOCnet, including: the quantification of uncertainties from the radiometric calibration laboratory and their propagation; an estimation of any temporal changes in responsivity between such calibrations; and, for in-water measurements, (residual) uncertainties associated with immersion factors and possible pressure effects. The FRM4SOC-2 project deliverable D-10, using ideas from chapters 3.2, 3.4, 3.10 and 3.13 of [20], provides guidance on how to do this for the TRIOS/RAMSES and Seabird/HyperOCR OCR, while the FRM4SOC-2 project deliverable D-12 provides guidance on how to perform the laboratory measurements themselves.

  • Task Description This task includes activities associated with permit-required monitoring conducted in accordance with the conditions specified by state or federal regulatory agencies. All monitoring tasks must be located within or adjacent to the Project area and follow the Department’s Regional Coastal Monitoring Program and FWC's marine turtle and shorebird monitoring programs. Guidance for monitoring of nearshore resources is available in the Department's Standard Operation Procedures For Nearshore Hardbottom Monitoring Of Beach Nourishment Projects. The Local Sponsor must submit work products directly to the appropriate state or federal regulatory agencies in accordance with permit conditions to be eligible for reimbursement under this task, unless otherwise directed.

  • System Description The wet detention basin is designed to trap 80% of sediment in runoff and maintain pre-development downstream peak flows. The basin has two forebays (smaller ponds) located at the low end of two grass ▇▇▇▇▇▇. In addition to runoff conveyance, the grass ▇▇▇▇▇▇ also allow infiltration and filtering of pollutants, especially from smaller storms. The forebays are each 4 feet deep. They are connected to the main pool by 18 and 24-inch metal pipes that outlet onto a rock chute. The forebays will trap coarse sediments in runoff, such as road sands, thus reducing maintenance of the main basin. The main pool will trap the finer suspended sediment. To do this, the pond size, water level and outlet structures must be maintained as specified in this Agreement (see Figures 1, 2 and 3). The main basin receives runoff from a 67.1 acre drainage area (41.2 acres within the subdivision and 25.9 acres off- site drainage coming from the east). During high rainfall or snow melt events, the water level will temporarily rise and slowly drain down to the elevation of the control structure. The water level is controlled by a 12-inch concrete pipe extending through the berm in the northwest corner of the basin (see Figures 1 and 3). On the face of the 12- inch pipe, there is metal plate with a 3-inch drilled hole (orifice) with stone in front of it. This orifice controls the water level and causes the pond to temporarily rise during runoff events. Washed stone (1-2” diameter) is placed in front of the orifice to prevent clogging. High flows may enter the grated concrete riser or flow over the rock lined emergency spillway. “As-built” construction drawings of the basin, showing actual dimensions, elevations, outlet structures, etc. will be recorded as an addendum(s) to this agreement within 60 days after Waukesha County accepts verification of construction from the project engineer.
