AIS reserves the right to decline any EFT request at any time, even if there is sufficient spending power available in My Account to settle the transaction, if, in its sole discretion, it believes that a transaction is for an improper purpose, is fraudulent, or is otherwise not within the terms of the service as set forth in this Agreement. AIS will not be liable for any incidental or consequential damages incurred by Me or any other person as a result of declining any EFT request.
Use and Purpose. The Licensee shall use the Licensed Area for a temporary parking facility and for no other purposes. The Licensee shall not commit or suffer to be committed any waste on the Property; nor commit, suffer or allow any environmental violation on the Property, or any damage or contamination to the Property, including but not limited to spillage, dumping, or seepage of any other contamination or hazardous materials whatsoever; or cause or allow any activities to occur which might give rise to any environmental related liabilities. For purposes hereunder, “hazardous materials” means any substance (i) the presence of which requires investigation or remediation under any federal, state or local statute, regulation, ordinance or policy; (ii) which is defined as “hazardous waste” or “hazardous substance” under any federal, state, or local statute, regulation or ordinance and regulations promulgated thereunder; (iii) which is toxic, explosive, corrosive, infectious or otherwise hazardous or is regulated by any federal, state or local governmental authority; (iv) the presence of which on the Property or adjacent property could constitute a nuisance on the Property; or (v) which contains petroleum products, polychlorinated biphenyls (PCBs), petroleum and petroleum byproducts, asbestos or urea formaldehyde.
Use and Purpose. Borrower agrees to borrow from Lender and Lender agrees to lend to Borrower the Loan Proceeds, such Loan Proceeds to be used for the purposes and subject to all of the terms, provisions and conditions of this Agreement and to be used as generally provided on the Development Budget.

Sublessor shall not create or impose any rules or regulations governing the Property that are inconsistent with Sublessee's intended use of the Property or the terms of this Sublease.
Use and Purpose. The Easement described herein shall be granted to Grantee for the purposes of construction, building, operating or repairing and maintaining a private pedestrian access across, through, and over the Easement Area described in Paragraph 1 above. Grantee shall be responsible, at ▇▇▇▇▇▇▇’s sole expense, for the construction of the pedestrian path located in the east-west portion of the Easement Area. Grantor, its employees, agents, and invitees shall also be allowed use of the sidewalk. It is further understood and agreed that any work done by Grantee, its agents, employees, or assigns, within the easement area shall be done in a good and workmanlike manner and will not interfere with the use of the surface of the ground on Grantor's adjoining land except such inconveniences as may be occasioned by the actual construction, building, operation, repairing and maintenance of the utilities and sidewalk. Grantee shall not commence work on the easement without first having the proposed work schedule and proposed work reviewed and approved by the Village Engineer for the Village of Grafton. Grantee agrees to restore ▇▇▇▇▇▇▇'s land located adjacent to the Easement Area, as nearly as possible, to the condition existing prior to the day of entry by Grantee, its employees, agents or assigns.
