The 'Use of Cards' clause defines the rules and limitations governing how a card—such as a credit, debit, or access card—may be used by the cardholder. Use of Cards. Company represents and warrants, on behalf of itself and its Employees, that the Cards will only be used for business purposes.
Use of Cards. You will ensure that each Card is signed immediately upon receipt and will take every reasonable precaution to keep it safe. This Card is not a credit card and its issuance does not entitle You to overdraw Your Designated Account or otherwise obtain credit from us. You understand that the dollar amount and associated fees of purchases with this Card will be deducted from Your Designated Account. You understand that by activating and using Your Card, You agree to accept and irrevocably honour any and all terms and conditions set out in this Agreement. The Card(s) is our property and we may in our sole discretion refuse to reissue or replace Your Card at any time. You will not use Your Card for any illegal, improper or unlawful purpose. We reserve the right to refuse our authorisation for certain types of transactions as determined by us. You agree and accept that the use of the Card will be at all times subject to statutory restrictions, and/ or regulations that any regulatory authority may impose. You acknowledge and accept that any transaction that FirstCaribbean, in its sole discretion, considers to be in breach of any statutory restrictions, regulations, procedures, suspicious and/or illegal activity or use of the Card for an illegal, improper or unlawful purpose, will be declined. Once You have sufficient funds in Your Designated Account, Your Card(s) may be used for the purchases/ services mentioned below, but not to exceed the daily transaction limits. Should You require a higher maximum daily limit for a special circumstance, please contact us. From time to time there may be exceptions to the daily transaction limits due to security procedures or local interchange restrictions. You can access Your Designated Account through the following Banking Channels (where available): • Designated Automated Teller Machines (“ATM”); • Debit Point of Sale (POS) Terminals that display the VISA and VISA Electron symbols or any other system that we may designate from time to time for purchase transactions paid using Your Card; • FirstCaribbean Online Banking.
Use of Cards. Only the Card Member whose name is on the Card is permitted to use the Card for Charges, for identification, or for any other reason. We will look to you and the Company for payment of all Charges made with the Card issued to you, even if you have let someone else use the Card, or relinquished physical possession of the Card. You may not return any goods, tickets or services obtained with the Card for a cash refund. However, you may return an item or ticket to a firm honouring the Card for credit to the account, if that firm permits such returns. We reserve the right to deny authorisation of any charge.
Use of Cards. The Card issued to you can be used in India and overseas. You agree and undertake that the American Express Card issued to you, if used overseas shall be utilised strictly in accordance with the relevant exchange control regulations issued and as amended by the Reserve Bank of India (RBI) from time to time. You also agree that in the event you exceed your Foreign Exchange entitlements as per the exchange control guidelines of the RBI, you undertake to bring the same immediately to our notice in writing. Further you also agree and understand that if you are required to get your passport endorsed for any such Charges incurred by you as stipulated by RBI, the onus of getting the passport endorsed shall lie entirely on you. And in the event of any failure to comply with the prevailing exchange control guidelines issued by RBI by you, you shall be liable for any action under the Foreign Exchange Regulation Act, 1973/ Foreign Exchange Management Act, 1999 as amended, and be debarred from the American Express Card facility either at our instance or by the RBI. The Globally Valid Card issued to you is valid for payments in Nepal and Bhutan only in Indian Rupees. Without prejudice to the foregoing, any payment of such Charges by us will be with full recourse to you and you will not be absolved from liability to make such payment and you will indemnify us in respect of any loss, claim or expense incurred by us as a result of your non-compliance with any such regulations. The Card is issued to the person requesting issuance of the same. No other person is permitted to use the Card issued to you for Charges, for identification or for any other reason. If you have let someone else use the Card or you have voluntarily relinquished physical possession of the Card, this will not affect your liability to us for payment of all Charges made with the Card issued to you. You agree to notify us in writing, at once, if the Card is lost, or stolen, or if you suspect it is being used without your permission. You shall also file an FIR with the nearest Police Station from where the loss occurred. Provided that you have acted in good faith, your liability to us arising out of any unauthorised use of the Card prior to such notification shall be limited to Indian `1,000. Use of Cards. 4.1 A non-Restricted Card can be used at any Merchant (fees apply, see paragraph 11), a Restricted Card can be used for making transactions in GBP currency and at any Merchant within the UK and Luxembourg that accepts GBP. You can authorise transactions on your Card at any Merchant by entering your PIN or other security code, if the Merchant does not accept chip and PIN authorisation, the Merchant may allow you to authorise the transaction by signature of the receipt. Please be aware that you may not usually stop a transaction once it has been authorised as at this point it is deemed to be received by us. You will be responsible for all transactions where you or any additional Cardholder authorise such transaction, regardless of the manner of such authorisation.
4.2 Cards can be used to make withdrawals at cash machines bearing the Cirrus® or Maestro® Acceptance Marks (fees apply, see paragraph 11). Subject to paragraph 3.6 you can withdraw up to £250 per day but some cash machines may have lower limits. Please note that extra cash machine fees in addition to those shown at paragraph 11 may be charged by certain cash machine providers.
4.3 Your Card is a prepaid card, which means that the Card's Available Balance will be reduced by the full amount of each transaction and authorisation, plus any taxes and charges that are applicable including any additional cash machine charge if any (the 'full deductible amount'). The full deductible amount must be less than or equal to the Available Balance on your Card. You must not use your Card if the full deductible amount exceeds the Available Balance or after the expiry date of the Card. If, for any reason, a transaction is processed for an amount greater than the Available Balance on your Card, you must repay us the amount by which the full deductible amount exceeds your Available Balance within 14 days of receiving an invoice from us. Should you not repay this amount within 14 days of receiving an invoice from us we reserve the right to take all steps necessary, including legal action, to recover any monies outstanding
4.4 You can check your balance and transaction history for free by visiting My Account and by calling Customer Services.
4.5 Due to security safeguards, Merchants that accept your Card are required to seek authorisation from us for all of the transactions that you make. There are some circumstances where Merchants may require you to have an Available Balance greater than the value of the transaction...
Use of Cards. The Customer shall, and shall procure that a Cardholder, only use Cards in accordance with the provisions of this Agreement. A Card may not be used in, among others, the following circumstances:
(a) unless the Cardholder has presented the Card to the Retailer at the Supply Point prior to drawing any Goods (save where the Supply Point permits use of a Card via a remote terminal);
(b) after the expiry date shown on the Card;
(c) if Customer exceeds its Credit Limit;
(d) if the Card has been reported lost or stolen or the PIN compromised in accordance with Clause 4.6;
(e) if the Card has been cancelled or blocked or its return requested by DCI;
(f) on non-compliance with the Card Procedures, if any;
(g) if there are any Late Payments;
(h) by a Cardholder other than as indicated on the Driver Card (as defined in Clause 4.3 (a)) or for a vehicle other than designated on a Vehicle Card (as defined in Clause 4.3 (a));
(i) if the Cardholder does not enter the correct PIN code. Notwithstanding clause 4.2(a)-(g), the Customer shall be liable to pay DCI for all amounts due pursuant to each Transaction plus any Charges levied as a result of any breach of this clause 4.2.
Use of Cards. Customer agrees to provide Cards only to persons authorized by Customer to be Cardholders. Customer understands that Bank is authorized to charge the Card Account for all transactions resulting from the use of a Card and Card Account at any time, whether or not Customer has authorized its use or the Cardholder exceeds his or her authority or limits, and Customer assumes all responsibility and liability for all such Card use except as otherwise provided in this Agreement.
Use of Cards. Section 3 of the Agreement (“CARD AND ACCOUNT USE”) is hereby modified by revising the second paragraph of Section
(a) any balance owed by the Company in respect of the Account to which such Transaction relates or any balance owed by the Company on any Account is past due;
(b) the amount of the Transaction plus the outstanding balance (including Transactions authorized but not yet posted) of all Accounts would exceed the Aggregate Credit Limit;
(c) the amount of the Transaction plus the outstanding balance (including Transactions authorized but not yet posted) of the relevant Account would exceed the Account Credit Limit for such Account;
(d) if the Transaction is a Cash Advance, the amount of the Cash Advance plus the outstanding Cash Advance balance (including Cash Advances authorized but not yet posted) of the relevant Account would exceed the Cash Advance Credit Limit for such Account; or
(e) any other reason exists for declining a Transaction as set forth in this Agreement, in the Cardholder Agreement, if any, in the operating regulations of Visa, or under applicable law.
Use of Cards. A Card may be used to make purchases (“Purchases”) from merchants honoring the Card. If requested by Company, loans (“Cash Advances”) may be obtained from any financial institution honoring the Card. Company hereby represents that it will use the Card only for business purposes and that its Employees have agreed to use the Card for business purposes only. Company shall be solely responsible for ensuring its Employees’ proper use of the Card. Issuer will not be responsible for any merchant’s or financial institution’s failure or refusal to honor a Card. Company shall return the Card(s) to Issuer immediately upon Issuer’s request.
Use of Cards. Each Transaction is subject to the terms and conditions of this Agreement and to the terms and conditions of the Cardholder Agreement, if any, in effect at the time of the Transaction. WaFd shall have no obligation or responsibility to the Company or to any Cardholder in the event that any merchant, entity or person refuses to honor a Card or Account. A Card or Account may be used only by the Cardholder to whom it is issued or who is authorized to use it, as the case may be, and may not be transferred to another Cardholder or any other person or entity, and any such attempted transfer shall automatically be void. Without limiting any other rights of WaFd hereunder or under applicable law, WaFd may refuse to authorize any Transaction in the event that:
(a) any balance owed by the Company in respect of the Account to which such Transaction relates or any balance owed by the Company on any Account, is past due;
(b) the amount of the Transaction plus the outstanding balance (including Transactions authorized but not yet posted) of all Accounts would exceed the Aggregate Credit Limit;
(c) the amount of the Transaction plus the outstanding balance (including Transactions authorized but not yet posted) of the relevant Account would exceed the Account Credit Limit for such Account; or
(d) any other reason exists for declining a Transaction as set forth in this Agreement, in the Cardholder Agreement, if any, in the operating regulations of Visa, or under applicable law.
