Substantial Completion of the Project definition

Substantial Completion of the Project or “Substantial Completion” means that, in the opinion of the Commissioner, you have completed all Work in accordance with the Contract, except for Punch List Work, and the City is able to occupy and use the Project for the purpose intended.
Substantial Completion of the Project means that each of the following events shall have occurred with respect to the Project:
Substantial Completion of the Project means that the Project is ready for use or is being used for the purpose intended and is so certified by the Consultant;

Examples of Substantial Completion of the Project in a sentence

  • Contractor is entitled to receive payment for the actual cost of the allowable General Conditions items incurred after receipt of a Notice to Proceed with Construction from Owner through Substantial Completion of the Project, plus 30 calendar days.

  • In the event the Design-Builder achieves Substantial Completion of the Project prior to the Substantial Completion Date, the Design-Builder shall maintain the completed Project, at its own expense, until such time that the Department agrees to occupy and use the Project for its intended use.

  • Construction Manager is entitled to receive payment for the actual cost of the allowable General Conditions items incurred after receipt of a Notice to Proceed with Construction from the Owner through Substantial Completion of the Project plus thirty (30) calendar days.

  • The Contractor is solely responsible for all construction means, methods, techniques, safety, sequences, coordination and procedures and protection of the installed work as part of the Contract until Substantial Completion of the Project.

  • The Architectural Designer shall certify the date of Substantial Completion of the Project or a designated portion thereof and shall prepare and issue the appropriate Certificate of Substantial Completion.


More Definitions of Substantial Completion of the Project

Substantial Completion of the Project means sufficient work has been completed showing that a financial commitment as well as the Developer’s intent and ability to satisfactorily complete each applicable Phase of the Development within the time frames established in this Agreement. The City, in its reasonable discretion, shall determine whether the Developer has Substantially Completed each phase of the development.
Substantial Completion of the Project means the completion of the Project (except for Punch List Work), in good and workmanlike condition, in compliance with all applicable requirements, and in conformance with the Approved Plans.
Substantial Completion of the Project means that, in addition to all of the requirements for "Substantial Completion of the Building as described in Section 44.2, all of the following have been achieved: the Authority's Consultant has certified that substantial performance of the Work under the the remainder of the Facility and the Site is ready for use by the Authority or is being used by the Authority for the purpose intended, and the following items have been submitted to the Authority or completed by the Design-Builder: (i) a clearance letter from the WorkSafeBC indicating that all current assessments due from the Design-Builder and all Subcontractors have been paid; (ii) a statement reconciling all Change Orders and claims under this Agreement with respect to the Work to the date of the application for Substantial Completion of the Project; (iii) all approvals necessary for the Project from local authorities having jurisdiction; (iv) an occupancy permit for the Facility, if required in addition to the occupancy permit for the Building, as required from local authorities having jurisdiction; (v) a statutory declaration of an officer or senior management employee of the Design- Builder stating that all accounts for labour, subcontracts, materials, construction machinery and equipment and other indebtedness which may have been incurred by the Design-Builder in performing the Work and for which the Authority might in any way be held responsible have been paid in full, except for amounts properly retained as a holdback or as an identified amount in dispute; (vi) the requirements of Section 35 (Cleanup and Final Cleaning of Work) have been fulfilled to the extent required by the Substantial Completion of the Project; and (vii) any other conditions specified in this Agreement with respect to achieving Substantial Completion of the Project; all deficiencies in the deficiency list for the Building have been completed; a comprehensive deficiency list, including an estimated value for each item, has been submitted to the Authority's Consultant by the Design-Builder which will be supplemented by the Authority's Consultant acting reasonably; and a schedule for completion of all remaining Work has been submitted to the Authority's Consultant by the Design-Builder and agreed to by the Authority's Consultant, acting reasonably.
Substantial Completion of the Project has the meaning set out in Section 44.3; "Target Building Substantial Completion Date" has the meaning set out in Section 3.1; "Target Project Substantial Completion Date" has the meaning set out in Section 3.1; "Term" means the period commencing on the Effective Date and ending on the End Date;
Substantial Completion of the Project means the completion of the Demolition and the construction of (i) all of the Public Improvements, and (ii) at least one hundred thousand (100,000) square feet of retail space to the condition ready for tenant improvements and tenant finish.
Substantial Completion of the Project or “Substantial Completion” means that, in the determination of SCC, the Contractor has completed all Work in accordance with the Contract Documents, except for Punch List Work and SCC is able to occupy and use the Project for the purpose intended.
Substantial Completion of the Project is the stage in the progress of the entire Project when the entire Project is sufficiently complete in accordance with the construction contract for the entire Project so the Owner can occupy or utilize all of the work which is to be performed and completed under the construction contract for the Project and occupy and utilize the Project for its intended use. Only punchlist items with respect to the Project shall remain after such date.
