COMPENSATION TO THE ARCHITECT. The DISTRICT shall compensate the ARCHITECT as follows:
1. The ARCHITECT’s fees for performing Additional Services related to change orders are paid as approved by the DISTRICT’s Board. If a change order is approved without ARCHITECT fee, no fee will be paid to the ARCHITECT unless negotiated and approved prior to commencing the change order-related services.
2. The ARCHITECT’s compensation for performing all the Basic Services required by this AGREEMENT including, but not limited to, those services detailed in Article I and II, shall be as follows: Schematic Design Phase: No more than 10% of the estimated Architect Fee, as determined under Exhibit “A” to this AGREEMENT, to be paid monthly based on actual level of completion Design Development Phase: No more than 15% of the estimated Architect Fee, as determined under Exhibit “A” to this AGREEMENT, to be paid monthly based on actual level of completion Construction Docs Phase No more than 35% of the estimated Architect Fee, as determined under Exhibit “A” to this AGREEMENT, to be paid monthly based on actual level of completion DSA Approval Phase: No more than 5% of the estimated Architect Fee, as determined under Exhibit “A” to this AGREEMENT, to be paid upon DSA approval of the PROJECT including incorporation and approval of any back-check comments Bidding Phase: No more than 2% of the estimated Architect Fee, as determined under Exhibit “A” to this AGREEMENT, to be paid monthly based on actual level of completion Construction Admin. Phase: No more than 25% of the actual Architect Fee, as determined under Exhibit “A” to this AGREEMENT and the accepted bid, to be paid monthly based on actual level of completion Project Close-Out Phase: Balance of actual Architect Fee to be paid after the all the Project Close-Out Phase requirements set forth in Article II have been completed and the PROJECT is certified by DSA and the Notice of Completion has been recorded.
3. The ARCHITECT and its consultants shall maintain time sheets detailing information including, but not limited to, the name of the employee, date, a description of the task performed in sufficient detail to allow the DISTRICT to determine the services provided, and the time spent for each task. The DISTRICT and ARCHITECT may otherwise mutually agree, in writing, on alternative types of information and levels of detail that may be provided by the ARCHITECT and its consultants pursuant to this Article X.

2. Payment to the ARCHITECT will be as follows: Schematic Design: 10% of estimated Architect Fee as set forth on Attachment “A”. Design Development: 15% of estimated Architect Fee as set forth on Attachment “A”. Construction Documents: 40% of estimated Architect Fee, to be paid monthly Based on actual level of completion, as set forth on Attachment “A”.

The DISTRICT agrees to pay the ARCHITECT for performing all the Basic Services required by this AGREEMENT including, but not limited to, those services detailed in ARTICLE I and ARTICLE II in accordance with the Fee Schedule set forth herein as Exhibit “A,” unless otherwise described in a duly approved WORK ORDER. Payment to the ARCHITECT shall be as follows:

To the extent that the time initially established for the completion of ARCHITECT’s services is exceeded or extended through no fault of the ARCHITECT, compensation for any services rendered during the additional period of time shall be negotiated and subject to prior approval by DISTRICT Board. Assessment and collection of liquidated damages from the Contractor is a condition precedent to payment for extra services arising from Contractor caused delays.
4. Expenses incurred by the ARCHITECT and ARCHITECT’s employees and consultants in the interest of the PROJECT shall have prior DISTRICT written approval before they are incurred and records of such expenses shall be provided to DISTRICT for the DISTRICT’s review.
COMPENSATION TO THE ARCHITECT. 1. The DISTRICT shall compensate the ARCHITECT for each PROJECT on a time- and-materials basis at the rates itemized on Attachment A of this Agreement. Except for any change in the scope of services mutually agreed upon in writing by the PARTIES, the Architect shall be compensated for each individual PROJECT in an amount not to exceed the fee specified in Attachment B of this Agreement.
2. When ARCHITECT's Fee is based on a percentage of construction cost and any portions of the PROJECT(S) are deleted or otherwise not constructed, compensation for those portions of the PROJECT(S) shall be payable to the extent actual services are performed, in accordance with the schedule set forth in Article X, Paragraph 2 based on the Bid Price.
3. To the extent that the time initially established for the completion of ARCHITECT's services is exceeded or extended through no fault of the ARCHITECT, compensation for any services rendered during the additional period of time shall be negotiated and subject to prior approval by DISTRICT Board. Assessment and collection of liquidated damages from the Contractor is a condition precedent to payment for extra services arising from Contractor caused delays.

COMPENSATION TO THE ARCHITECT. 1 DISTRICT agrees to pay ARCHITECT for all the services set forth in this AGREEMENT for a total cost not to exceed ONE MILLION NINE HUNDRED TWENTY THOUSAND FIFTY SEVEN DOLLARS ($1,920,057.00) inclusive of all reimbursable expenses, for all services performed and expenses incurred pursuant to this Agreement (“TOTAL FEE”).

COMPENSATION TO THE ARCHITECT. Compensation to the A/E for Basic and Supplemental Services shall be STIPULATED SUM. Provide a fee for Basic Services and individual fees for each Additional Service.
COMPENSATION TO THE ARCHITECT. The DISTRICT shall compensate the ARCHITECT as follows:
1. For ARCHITECT services, as described in Article II, compensation shall be computed as follows: Compensation is based on a fixed fee of $233,269.00, plus an additional $16,731.00 for reimbursable expenses for a total contract amount of $250,000.00. Progress payments for ARCHITECT services in each phase shall total the following percentages of the total compensation payable: Program Assessment Phase: 10 percent Schematic Design Phase: 15 percent Design Development Phase: 15 percent Construction Documents Phase: 25 percent DSA Agency Approval Phase: 5 percent Bidding Phase: 5 percent Construction Phase: 20 percent
2. This compensation shall be compensation in full for all services performed by the ARCHITECT under the terms of this AGREEMENT, except where additional compensation is agreed upon between the ARCHITECT and DISTRICT in writing as provided for as additional services.
3. Payments for ARCHITECT services shall be made monthly and, where applicable, shall be 95% of the services performed within each phase of service, on the basis set forth in paragraph 1. 100% payment will be made upon DISTRICT acceptance of each phase.
