Customer’s Property. 9.1 Except in the case of a Customer who is not contracting in the course of a business or holding himself or herself out as doing so, any Customer’s property and all property supplied to Citipost by or on behalf of the Customer shall be deemed to be at the Customer’s risk whilst it is in the possession of Citipost or in transit to or from the Customer unless agreed otherwise in writing.
9.2 Citipost shall be entitled to make a reasonable charge for the storage of any Customer’s property left with Citipost before receipt of the Print Management Order or after the Customer has been notified by Citipost that the Print Management Services have been completed.
Customer’s Property. 22.1. As between the parties, the Customer:
22.1.1. owns all Intellectual Property Rights in and to all the Customer’s Property; and
22.1.2. shall have sole responsibility for the acquisition, deployment, licensing, legality, non-infringement, reliability, integrity, accuracy, and quality of the Customer’s Property.
Customer’s Property. 9.1. If the provision of any Services requires use of the Customer's equipment, the Customer will ensure that the CDG Personnel are given such access to the equipment as is reasonably necessary to facilitate the provision of the Services.
9.2. CDG will keep safe and secure and will take all reasonable care of any equipment belonging to the Customer while in the possession or control of CDG. Any equipment, which belongs to the Customer and which is used by CDG will remain at the Customer's risk and CDG will not assume any responsibility or liability for the safety or security of such equipment.
Customer’s Property. Title to and right of immediate possession of any property, including without limitation, patterns, tools, jigs, dies, equipment or materials furnished or paid for by the Customer shall remain in Customer. No articles made therefrom shall be furnished by Supplier to any other party without Customer’s prior written consent. Supplier may not use Customer’s property for any purpose outside the scope of Customer’s orders. Supplier shall keep adequate records of such property, which shall be made available to Customer upon request, and shall store, protect, preserve, repair and maintain such Customer’s property in accordance with sound industrial practice, all at Supplier’s expense. Unless otherwise agreed to by Customer, Supplier shall insure Customer’s interest in such the property against all risks of theft, loss or damage (including extended coverage). Copies of certificates of insurance evidencing this coverage will be furnished to Customer on demand. In the event that ▇▇▇▇▇▇▇▇’s property becomes lost or damaged Supplier agrees to pay for or replace the property, at Supplier’s expense, at Customer’s request. Supplier shall upon Customer’s request return the property at Supplier’s expense.
Customer’s Property. All property supplied to the Company by or on behalf of the Customer which is held by the Company for the purposes of the Contract or in transit to or from the Customer, shall be deemed to be entirely at the Customer’s risk and the Company shall not be liable for any loss of or damage to such property whilst in possession of the Company or in transit as afore said unless such loss or damage is due directly to the negligence of the Company, its employees or agents. In no circumstances whatsoever will the Company be liable for any consequential loss or damage arising there from. The Customer shall insure all such property for all risks.
Customer’s Property. The provider will only maintain fire and extended coverage on property belonging to the customer while the property is in the provider’s possession. The provider’s liability for this property will not exceed the amount recoverable from insurance. Additional insurance coverage may be obtained if it is requested in writing, and if the premium is paid to the provider.
Customer’s Property. 5.3.1 The Service Provider shall store parts and equipment removed from the Customer’s Aircraft, or shipped to the Service Provider for use or installation on the Customer’s Aircraft, in an area secure and separate from the work being done for other customers. No such parts or equipment may be used for other work without the Customer's prior written permission. Any equipment loaned by the Customer to the Service Provider for use in performing the Services shall be maintained by it in proper working order in accord- ance with the manufacturer’s instructions, and returned to the Customer when all work is completed in the same condition as when received, save for ordinary wear and tear.
Customer’s Property. The Supplier will not be liable for the damage, loss or destruction of any property (including Goods which are not collected by Customer) of the Customer in the Supplier’s possession.
Customer’s Property. Buyer shall have sole ownership of all right, title and interest in any items, materials or works of authorship produced by Supplier as a result of the services performed by Seller for Buyer hereunder. Seller hereby irrevocably assigns all copyrights in such items, materials or works of authorship to Buyer.
Customer’s Property. Seller shall charge the customer at current rates for handling and storing customer’s property (e.g. truck chassis) held for more than 30 days. All customers property or third party’s property that is stored by Seller is at customer’s or other party’s risk. Seller shall be liable only for ordinary care of the property and will not be liable for any loss or damage thereto caused by fire, corrosion, theft, negligence, or any cause beyond it’s reasonable control.
