Exempt Positions. No worker in the bargaining unit shall be in an exempt status for overtime purposes.

Exempt Positions a) If an employee accepts a temporary position with the Employer which is exempt from the Bargaining Unit for a term of less than one (1) calendar year, the employee shall continue to accrue seniority in the Bargaining Unit. After one (1) calendar year, the employee’s seniority will be frozen from the date they left the Bargaining Unit. b) If an employee applies for and is successful for a permanent position exempt from the Bargaining Unit, their seniority shall remain frozen for a period of sixty (60) days for the employee to have a trial period. At the end of the exempt trial period, the employee’s seniority will be lost if they do not return to a Bargaining Unit position. c) Employees in exempt positions will continue to pay Union dues while their Bargaining Unit seniority is accruing or frozen.
