Fixed Term Appointments. An employee may be engaged for a fixed-term provided there are genuine reasons based on reasonable grounds for the particular fixed-term appointment. The employer shall advise the employee of those reasons at the time of the appointment and record them in the letter of appointment or job description.
Fixed Term Appointments. (a) An employee on fixed-term employment will cease to have an entitlement to parental leave upon the expiry of the employment, except as provided for in subclauses 39.5.3(b) and (c) below. (b) An employee on a fixed term employment whose contract expires when she is at least 20 weeks pregnant, and whose employment is not continued beyond the expiry date of the contract, will be entitled to payment of the full paid maternity leave in accordance with subclause 39.5.1 unless: (i) she was offered and refused another contract of employment broadly comparable to her existing position; or (ii) a significant majority of the duties and responsibilities of the existing position are no longer being performed. (c) An employee on fixed term employment who is on maternity leave at the expiry of the contract and who is subsequently employed on a further employment contract for the same position after a gap in time, not being longer than the period of parental leave would have been, will be entitled to the full paid maternity leave entitlement subject to fulfilling the eligibility requirements set out in this clause.
Fixed Term Appointments. 3.7.1 Where appointments are not permanent the provisions of this subclause will apply. a) An employee and an employer may agree that the employment of the employee will end: i. at the close of a specified date or period; or ii. on the occurrence of a specified event; or iii. at the conclusion of a specified project. b) Before an employee and employer agree that the employment of the employee will end in a way specified in subsection (a), the employer must: i. have genuine reasons based on reasonable grounds for specifying that the employment of the employee is to end in that way; and ii. advise the employee of when or how his or her employment will end and the reasons for his or her employment ending in that way. c) The following reasons are not genuine reasons for the purposes of subsection (b)(i): i. to exclude or limit the rights of the employee under the Employment Relations ▇▇▇ ▇▇▇▇; ii. to establish the suitability of the employees for permanent employment. 3.7.2 Where an appointment is for a fixed term, the letter of appointment will state the way in which the appointment will end and the reasons for the employee’s employment ending that way.
Fixed Term Appointments. A) Fixed-term Faculty Fixed-term faculty are appointed at a rank of Instructor or higher. The duties of a fixed-term faculty member, whether in a full-time or a part-time assignment, consists largely of instruction. A full-time assignment from which no service or scholarship is expected shall consist of 45 load hours. The teaching load of fixed term appointments for which additional effort for scholarship or service is required shall be less than 45 hours, pro-rated commensurate with the level of non-teaching activities assigned. Fixed-term faculty may be renewed depending on the needs or the University. In some cases, fixed-term faculty may be contracted for multiple-year contracts dependent on the needs of the University. Such appointments specify the beginning and ending date of the employment period in the Notice of Appointment. Beyond the ending date of this period, there is no commitment for continued employment and timely notice is not required. Fixed-term appointments for one year of less may be renewed subject to such factors as merit evaluation, program needs and availability of funds. Those individuals on fixed-term appointments are not eligible for indefinite tenure but may be considered for tenure-related positions when vacancies occur. Such appointments specify the beginning and ending date of the employment period in the Notice of Appointment and may be made in either administrative or management areas. Contract recommendations will be made by Deans of the Colleges in instructional areas and by unit administrators in other employment areas. Fixed Term Appointments. 52.7.1 An employee employed on a fixed-term contract of employment will cease to have an entitlement to parental leave upon the expiration of the contract, except as provided for in sub-clauses 52.7.2 and 52.7.3 below. 52.7.2 An employee employed on a fixed-term contract of employment whose contract expires when she is at least twenty weeks pregnant, and whose employment is not continued beyond the expiry date of the contract, will be entitled to payment of the fourteen week paid maternity leave entitlement subject to fulfilling any eligibility requirements unless: i) she was offered and refused another contract of employment (on grounds other than pregnancy) broadly comparable to her existing position; or ii) a significant majority of the duties and responsibilities of the existing position are no longer being performed. 52.7.3 An employee employed on a fixed-term contract who is on maternity leave at the expiry of the contract and who is subsequently employed on a further employment contract for the same position after a gap in time, not being longer than twelve months from the date of taking maternity leave, will be entitled to the fourteen week paid maternity leave entitlement subject to fulfilling the eligibility requirements set out in this Clause.
