Formal Evaluation Summary. 12.7.1 All final evaluation conferences for permanent, temporary, and probationary unit members shall be completed by the end of the last week in April. Formal Evaluation Summary. 1. All final evaluations for permanent, temporary, and first-year probationary employees shall be completed and delivered to the employee by May 1st. All final evaluations for second-year probationary employees shall be completed and delivered to the employee by Feb. 15th. The employee and the evaluator shall meet no later than ten school days following delivery of the final evaluation. The evaluator and the evaluatee shall sign the evaluation. Signature by the employee implies only that he/she has had an opportunity to see the written evaluation. The evaluator shall retain a copy, transmit a copy to the unit member thirty days prior to the end of the school year, and transmit the original to the District Personnel Office to be filed in the employee’s personnel file.
2. If a permanent employee is given a rating of “Progress Not Evident” or “Not Meeting Standards” or “Unsatisfactory,” the District must include the following (“Improvement Plan”) on the Addendum to the Formal Evaluation Summary:
a. list of duties performed in an unsatisfactory manner;
b. description of improvement required, and program/people available to provide assistance;
c. a time period for demonstrating improvement; and
d. a description of methods used to measure improvement. The employee shall participate in the improvement program designed by the Superintendent or designee as outlined on the Addendum to the Formal Evaluation Summary. The employee is responsible for demonstrating application of target behavior. Merely completing improvement activities may not demonstrate successful performance or target behavior.
3. The employee shall have the right to initiate a written reaction or response to the evaluation; that response shall become a permanent attachment to the evaluation in the employee’s personnel file.
Formal Evaluation Summary. 10.7.1 All final evaluation conferences for permanent, temporary, and probationary unit members will be completed by May 1. All final evaluation conferences for probationary 2 unit members will be completed by February 15. No later than May 10, the evaluator will transmit a copy to the unit member and the original to the Human Resources Department to be filed in the unit member’s personnel file. All copies must be signed by the evaluator and the evaluatee. The appropriate Final Evaluation Summary form in Appendix D will be used.
10.7.2 If a permanent unit member is given an “Unsatisfactory/Not Meeting Standards” the District must include the following on the Certificated Performance Improvement Plan, attached as Appendix D-8:

10.7.3 Where the evaluatee receives an overall “unsatisfactory/not meeting standards” Formal Evaluation Summary, the evaluator will hold a conference with the evaluatee prior to the issuance of the Formal Evaluation Summary. A unit member may only receive a marking of “unsatisfactory” on their formal evaluation summary if they have not satisfactorily completed the process delineated in Section 10.7.2.

12.8.2 If a permanent unit member is given a “Practice Not Consistent With Minimum Standards” in one half or more of the elements of any one teaching standard, he/she shall be referred to the PAR program as per section 12.1 of this agreement. Any rating of “one” requires the evaluator to indicate in writing specific teacher instructional Practices Not Consistent With Minimum Standards as described in CUSD Rubric Supporting the California Standards for Teaching Professionals. Any standard which is not applicable will be marked N/A.

12.7.2 When it becomes apparent the evaluatee will receive an overall “Practice Not Consistent with Minimum Standards: Unsatisfactory” on the Summary Evaluation Form, the evaluator shall hold a conference to notify the evaluatee at least four (4) weeks prior to the issuance of the Summary Evaluation Report.
12.7.3 The evaluatee shall have the right to initiate a written response to the evaluation within ten (10) working days of the Summary Evaluation Report and the evaluator shall schedule a second (2nd) conference to discuss the concerns. The evaluatee’s response shall become a permanent attachment to the evaluatee’s personnel file.
12.7.4 If the employee feels the evaluation is unjustified, he/she may, within ten (10) workdays of the second (2nd) evaluation conference, elect to request the Superintendent or designee to review his/her performance evaluation record. In such event the employee shall present to the evaluator, in writing, his/her objections to the evaluation record and submit a copy to the Superintendent or designee. At the employee’s request, a copy of these objections shall be attached to the evaluation and become a part of the evaluation record. Also, a review by the Superintendent or designee of the procedures utilized and the results of a classroom visitation, if possible, will be put in writing and attached to the evaluation.
12.7.5 The findings, recommendations, and/or decisions of the Superintendent or designee shall be final regarding the evaluation itself unless it can be determined that the evaluation procedure contained herein has not been properly followed.
