Introduction of shifts. (1) The Employers may consider introducing an afternoon, night and/or morning shift pattern (including a rotating shift) as required for operational reasons. The introduction of an afternoon, night and/or morning shift will be implemented providing that: (a) Affected employees are consulted, their views taken into account and the reason for the change is explained to them; (b) the impact of the changes on employees, including but not limited to their family responsibilities, is taken into account during the consultation period; (c) the employer considers any occupational health issues; (d) Information, including proposed roster arrangements, start/finish times and meal breaks, is provided to employees during the consultation period; and (e) The new shift arrangements will not commence until at least 12 weeks after consultation with affected employees has commenced (the consultation period); and (f) During the consultation period: (i) The employer will consult with the affected employees on proposed shift rosters. The employer will take employee feedback and employee roster proposals into account in preparing at least 2 shift roster options for affected employees to consider and vote on. The shift roster with majority support from affected employees will be implemented by the employer. (ii) The employer may, where it is requested by a majority of employees, or at its own initiative, seek the input from a consultant in the area of shift arrangements, in developing appropriate shift rosters. (iii) In determining appropriate shift rosters for consideration by employees, the employer will take into account occupational health and safety issues. (2) During the consultation period, and where an entire work area or department is not proposed to move to a new shift arrangement, the employer will call for volunteers within the work area or department to move to the new shift arrangement. The employer will determine whether the volunteers are appropriate to move to the new shift arrangement taking into account the skills and classifications of the volunteers and the operational requirements of the shift arrangements. (3) If there are insufficient volunteers or more employees than required remaining on the current shift arrangement and an employee is unable to transfer to the new shift arrangement for personal reasons including family responsibilities, the employer will commence a redundancy process in accordance with Clause 38. Introduction of shifts. Approval for the introduction of shifts shall be governed by Article 5.7. of Chapter V of the company-specific component of the agreement. An employee engaged in daytime work is not obliged to take part in shift work except with his/her consent even though it has been agreed to introduce shift work at the company in question.

  • Rectification of Safety Hazard (a) Where, because of the existence of a safety hazard, a site has been stopped for a defined period of time and Employees sent off site by agreement between Site Managers and any combination of Union Official/s, Health and Safety Committee, those people who remain on site to do rectification work will be paid at the rate of double time for all such work. (b) This would not be applicable on normal de watering (see clause 32.6 hereof) or normal housekeeping work or where a section of the site has been declared unsafe and normal rectification occurs whilst the remainder of the site carries on working.
