ODFW. Each employee shall be eligible to accrue and use compensatory time off through June 30 of each calendar year. The Agency shall notify each employee by January 1 of each calendar year of their accrued compensatory time off balances. In order to reduce an employee’s compensatory time off balance to one-hundred twenty (120) hours or below, the Agency may schedule the employee to take time off from March 1 to June 30 in the same calendar year. If the Agency cannot schedule the employee for the time off, the Agency shall pay down to one-hundred twenty (120) hours for the compensatory time off not used by June 30 of each calendar year.
ODFW. (1) Payment for overtime shall be no later than one (1) month following the pay period in which the overtime is worked. (A) All FLSA non-exempt employees shall receive compensatory time off for authorized overtime worked. If, however, the employee wishes to receive cash in lieu of compensatory time off, he/she may opt to receive cash. Subject to the restriction listed in Subsection (B) of this Section, an employee’s request for cash or compensatory time off will remain in effect until the employee elects a change. The employee may not elect such a change more than once per month. (B) All employees will have the option of maintaining a maximum balance of one-hundred twenty (120) hours of accrued compensatory time off by June 30 of each calendar year. Taking compensatory time off shall be subject to prior approval of the employee’s immediate supervisor.
ODFW. (a) Employees assigned to a fixed, year-round regular or alternate work schedule, as defined in Article 90 of this Agreement, shall be eligible for overtime pay pursuant to Article 32, Section 2 and Section 4 of the Agreement. ODFW. Contingent upon continued availability of ODFW budget allocation (or competitive grant funding received) for conservation actions to benefit Oregon chub, ODFW will be responsible for the following actions: • Conduct initial introduction of Oregon chub to ▇▇▇▇▇▇▇ Pond using fish translocation protocols listed in Appendix A of this document. • Install and monitor an overflow device to prevent winter overtopping of the ▇▇▇▇▇▇▇ Pond. Device will consist of a valve and length of pvc pipe to allow for diversion of inflow from the seep around the pond. Communicate with Permittee to ensure that pond levels will be monitored in ▇▇▇▇▇▇▇ with high rainfall and diversion will occur if potential exists for the pond to overtop. • Annually monitor the ▇▇▇▇▇▇▇ Pond Oregon chub population size, habitat conditions, and potential threats to the population, per the protocol identified in Appendix B of this document, contingent upon availability of funding. • Submit annual monitoring reports by April 30 annually to the Oregon Fish and Wildlife Office, ▇▇▇▇ ▇▇ ▇▇▇▇ ▇▇▇▇▇▇, ▇▇▇▇▇ ▇▇▇, ▇▇▇▇▇▇▇▇, ▇▇▇▇▇▇ ▇▇▇▇▇. • Conduct removal of Oregon chub from the ▇▇▇▇▇▇▇ Pond, per approval by the FWS, upon a decision by the Permittee to return the population to baseline, or if deemed necessary and appropriate, due to imminent threat to the population, or for subsequent translocations from the pond to alternative sites as described above. • Work with USFWS and the Oregon chub workgroup to identify potential introduction sites for Oregon chub and to develop a translocation plan.
ODFW. Seasonal employees shall have the option to carry forward up to a maximum of forty (40) hours of accrued vacation under the following conditions: 1) The employee must be scheduled into a successive season without a break in service, known as “back- to-back” seasons. If the employee is not scheduled for a successive season, then accrued vacation will be paid off. If the employee is scheduled into a successive season, but does not report as scheduled, the Employer will pay off the vacation balance as it determines is appropriate. 2) The employee must submit written notice of intent to carry forward accrued vacation leave at least two (2) weeks prior to the end of the season, if a date certain for season end has been provided to the employee. If no date certain has been provided to the employee, then the employee must submit written notice of intent to carry forward accrued vacation leave within five (5) working days of notice that their season is ending.

ODFW. It is the policy of the State of Oregon that wildlife shall be managed to prevent serious depletion of any indigenous species and to provide the optimum recreational and aesthetic benefits for present and future generations of citizens of the state. In furtherance of this policy, the State Fish and Wildlife Commission shall represent the public interest of the State of Oregon and implement the following coequal goals of wildlife management (ORS 496.012). 1) To maintain all species of wildlife at optimum levels 2) To develop and manage the lands and waters of the state in a manner that will enhance the production and public enjoyment of wildlife 3) To permit an orderly and equitable utilization of available wildlife 4) To develop and maintain public access to the lands and waters of the state and the wildlife resources thereon 5) To regulate wildlife populations and the public enjoyment of wildlife in a manner that is compatible with the primary uses of the lands and waters of the state 6) To provide optimum recreational benefits 7) To make decisions that effect wildlife resources of the state for the benefit of the wildlife resource and make decisions that allow for the best social, economic and recreational utilization of wildlife resources by all user groups. ODFW is a lead agency for implementing the Oregon Plan for salmon and watersheds. The Department is mandated to comply with state agency measures on water quality, population monitoring and habitat. Also, ODFW is mandated to comply with the Diamond Lake Management Plan (OAR 635-500-703), which sets forth management goals and objectives for the fishery at Diamond Lake.
