Open Runs. When a run opens up during the course of a bid period, the extra board will operate the run on a daily rotation basis consistent with Section 2 of this Article. An extra operator on AM protection who catches a full-time split run in which the second piece begins after 1300 hours will not operate the complete split run. He will relinquish the second piece but be available as needed for additional work (straight time or overtime, as applicable). The second piece of the split run shall be operated by an operator on PM protection. Each piece of part-time split runs will be separately assigned to operators on protection.
Open Runs. (1) An “open” run shall be defined as an opening in a regular bus run which occurs due to the death, retirement, resignation or other permanent separation of the driver assigned to the run and which opening is not filled through te annual bid meeting (if held) or any newly created run. (2) If an opening on a regular bus run occurs after completion of the annual bid meeting (if held), the open run shall be bid at a meeting of all interested bargaining unit members as soon as it is practicable. The senior qualified driver in the classification bidding on the open run shall be awarded the run. The subsequent vacancy created by the filling of the open run shall be filled by a new hire for the remainder of the school year and shall be bid prior to the beginning of the next school year.
Open Runs. Where a new run is created for any reason, SunLine shall bid the open run, in seniority order. After one (1) round of bidding, the remaining open position may be filled by SunLine with a part-time employee and no further bid shall take place. Where an old run becomes open, for any reason, SunLine shall have the right to fill the position with a part- time employee and no bid shall take place.
Open Runs. A. An open run occurs when one of the following is present: a. A driver owning a run vacates b. A driver is terminated or resigns c. The General Manager is properly notified of and approves a personal leave of absence of more than thirty (30) days d. A driver does not report to work and has not notified Dispatch of his/her reason for absence within five (5) days of the last day worked e. A driver has properly requested a medical leave of absence (See Section 16.B) f. A driver not requesting a medical leave of absence is absent for fourteen (14) consecutive days. 1. Upon notification of a leave of absence of more than thirty (30) days other than a personal leave, a regular driver's route shall go up for general bid (temporary) on the Monday following the date the route was vacated. Notation of the driver's date of return from leave shall be posted on the bid sheet. 2. Upon notification of a personal leave of absence of more than thirty (30) days, a Regular Driver's route shall go up for general bid (permanent) on the Monday following the date the route was vacated. If the driver returns from personal leave in such case prior to thirty (30) days, the driver will have no right to the route which was vacated. 3. Any driver returning from a leave of absence prior to the date the leave was to have ended will have no right to the route vacated until the scheduled date of return. This does not apply to personal leaves for more than thirty (30) days which are covered in 2 above. 4. In cases of absence as defined in Subsection d. on the previous page, the route will go up for general bid (permanent) on the second Monday following the driver's last day worked. 5. Should a driver verbally notify Dispatch of the need for a medical leave of absence, but fail to properly request said leave in writing, specifying an expected date of return, the driver's route will go up for general bid (temporary) on the second Monday following the driver's last day worked. B. Open bidding shall begin on the first Monday (if Monday is a holiday, on the first Tuesday) following the run being vacated, and bidding shall close the following Wednesday noon with the results being posted the following Thursday by 1400 hours unless extended by mutual agreement of the Company and the Union. The successful bidder shall take over the route on the following Monday. Upon closing of the bid, the most senior qualified Bus Driver shall be awarded the route; and this Bus Driver shall not vacate this route...

  • Interest Rates and Letter of Credit Fee Rates Payments and Calculations (a) Interest Rates. Except as provided in Section 2.13(c) and Section 2.15(a), all Obligations (except for the undrawn portion of the face amount of Letters of Credit) that have been charged to the Loan Account pursuant to the terms hereof shall bear interest at a per annum rate equal to the lesser of (i) the LIBOR Rate plus the Applicable Margin, or (ii) the maximum rate of interest allowed by applicable laws; provided, that following notice to Borrower in accordance with Section 2.15(a) hereof, all Obligations that have been charged to the Loan Account pursuant to the terms hereof shall bear interest at a per annum rate equal, during the duration of the circumstances described in Section 2.15(a), to the lesser of (A) the Base Rate plus the Applicable Margin as calculated pursuant to Section 2.15(a) or (B) the maximum rate of interest allowable by applicable laws.

  • C1 Contract Price In consideration of the Contractor’s performance of its obligations under the Contract, the Authority shall pay the Contract Price in accordance with clause C2 (Payment and VAT).

  • OFFSET CREDIT/COOPERATION This Contract has been entered into in direct support of LOCKHEED ▇▇▇▇▇▇'▇ international offset programs. All offset benefit credits resulting from this Contract are the sole property of LOCKHEED ▇▇▇▇▇▇ to be applied to the offset program of its choice. SELLER shall assist LOCKHEED ▇▇▇▇▇▇ in securing appropriate offset credits from the respective country government authorities.

  • FINAL PAYMENT AND CLOSE-OUT A. If a DBE/MBE/WBE Program Plan is agreed to and the Contractor has identified Subcontractors, the Contractor is required to submit a Contract Close-Out MBE/WBE Compliance Report to the Purchasing Manager no later than the 15th calendar day after completion of all work under the contract. Final payment, retainage, or both may be withheld if the Contractor is not in compliance with the requirements as accepted by the City. B. The making and acceptance of final payment will constitute: i. a waiver of all claims by the City against the Contractor, except claims (1) which have been previously asserted in writing and not yet settled, (2) arising from defective work appearing after final inspection, (3) arising from failure of the Contractor to comply with the Contract or the terms of any warranty specified herein, (4) arising from the Contractor’s continuing obligations under the Contract, including but not limited to indemnity and warranty obligations, or (5) arising under the City’s right to audit; and ii. a waiver of all claims by the Contractor against the City other than those previously asserted in writing and not yet settled.
