Third Party Warranty. Except as otherwise provided above, ▇▇▇▇▇▇▇ makes no warranty, express or implied, with regard to third party hardware or software and expressly disclaims the implied warranties or conditions of merchantability or merchantable quality, fitness for a particular purpose, title, infringement and those arising by statute or otherwise in law. Customer’s sole recourse for warranty claims is with the manufacturer of the Product. However, ▇▇▇▇▇▇▇ agrees to pass through any third party warranty that ▇▇▇▇▇▇▇ receives from the manufacturer of the Products to Purchaser. The extent of any third party warranty details, terms and conditions, remedies and procedures may be expressly stated on, or packaged with, or otherwise accompanying the Products.
Third Party Warranty. 11.1 The Supplier shall within seven days if so required by the Company enter into a warranty with any third party warranting that the standard of the Goods provided is in accordance with the Contract and the Order and that they are fit for the intended purpose.
11.2 The Company shall be entitled to withhold payment for the Goods until such time as the Supplier has provided any warranty requested in accordance with clause 11.1.

9.2 The Customer acknowledge and agree that the Company make no warranty condition or representation with respect to the CNG conversion, installation or any parts associated with CNG, including but not limited to the concession of taxes granted by LTA or any Authorities concerned and that the risk of any loss or damage to or deterioration of the vehicle shall be borne by the Customer from the date of delivery of the vehicle and the Customer shall have not have any claim against the Company in respect thereof including and not limited to any loss or damage.
9.3 In the case of warranty being provided by the Company, unless otherwise expressly stated as a special condition herein or in the Company’s service and warranty booklet, no warranty condition or representation by the Company is given or implied by the Agreement nor is any warranty condition or representation to be taken to have been given by the Company or implied from anything said or written in the negotiations between the parties or their representatives prior to the Agreement and any statutory or other warranty condition or representation express or implied as to the stated quality or fitness of the vehicle and goods subject to this Agreement is hereby expressly excluded.
9.4 In the case of warranty being provided by Third Party and not the Company, unless otherwise expressly stated as a special condition herein, no warranty condition or representation by the Company is given or implied by the Agreement nor is any warranty condition or representation to be taken to have been given by the Company or implied from anything said or written in the negotiations between the parties or their representatives prior to the Agreement and any statutory or other warranty condition or representation express or implied as to the stated quality or fitness of the vehicle and goods subject to this Agreement is hereby expressly excluded.
Third Party Warranty. For any equipment or product that comprises or is part of Constructed BPL Network that is not BPL Equipment, such equipment and products being set forth in Schedule G, the Seller shall assign or pass through, as the case may be and to the extent such assignment or pass through is permitted, to the Buyer all warranties and indemnities offered by the manufacturer or a vendor or dealer of such equipment or product, which shall extend only for such time as the third party product manufacturer provides such warranty, which the Seller and the Buyer acknowledge that such warranty may not be for the same duration as the Product Warranty provided herein by the Seller. At the Buyer’s request, the Seller authorizes the Buyer to assert for the Seller’s account, all rights of the Seller (granted under this Agreement) under any manufacturer’s, vendor’s, or dealer’s warranty or indemnities on any third party equipment or product comprising or part of the Constructed BPL Network, and the Seller agrees to cooperate, subject to Buyer’s reimbursement of Seller’s reasonably incurred costs and out-of-pocket expenses, with the Buyer in asserting such rights.

(“dormakaba USA”) warrants that all Products manufactured by dormakaba USA and sold under its trade name “PRECISION HARDWARE” are free of defects in materials and workmanship as outlined below. The sole and exclusive liability of dormakaba USA under this warranty is limited to the repair or replacement of any Product or component part covered by the warranty at the sole discretion of dormakaba USA.
