Time Off in Lieu of Payment of Overtime. 17.8.1 Notwithstanding the provisions of subclause 17.1 an employee may elect, with the consent of the Company, to take time off in lieu of payment for overtime at a time or times agreed with the Company. 17.8.2 Overtime taken as time off during ordinary time hours shall be taken at the ordinary time rate, that is an hour for each hour worked. 17.8.3 The company shall if requested by an employee, provide payment at the rate provided for the payment of overtime in the Agreement, for any overtime worked under paragraph 17.8.1 of this subclause where such time has not been taken within four (4) weeks of accrual.
Time Off in Lieu of Payment of Overtime. Employees who work overtime may opt to bank, at the equivalent premium time rate, hours worked up to a maximum of the equivalent of one week, plus a day or 6 working days in one year, i.e., 48 hours for Category 1, 2 and 3 Workers, and 43.5 for Category 4 Workers. 11.9.1 Banked lieu time may be used on an hour-by-hour basis. Utilization of lieu time must be requested in advance and is subject to approval of the employee’s immediate supervisor, based on business requirements. Such requests will not be unreasonably denied. 11.9.2 Employees who work on the following recognized holidays; the one- half day on the last working day before Christmas Day or the one-half day on the last working day before New Year’s Day, may bank and carry-over those hour(s) into the next calendar year. These banked hour(s) must be used by March 31st of that year otherwise they will be paid out as of that date. 11.9.3 Shift Workers working rotational shifts who work on a recognized holiday may have that specific time banked as lieu time, in addition to the above- mentioned six-day limit. 11.9.3.1 Shift workers who bank the time in lieu on the following recognized holidays; one-half day on the last working day before Christmas Day, Christmas Day, Boxing Day, one-half day on the last working day before New Year’s Day, will carry these days into the next calendar year. These banked days must be used by March 31st of that year otherwise they will be paid out as of that date.
Time Off in Lieu of Payment of Overtime. 14.11.1 Time off in lieu of payment for overtime is where overtime worked is not paid but used as time off at a later date during the normal ordinary hours or work; 14.11.2 The time off in lieu of payment for overtime worked on any day, is available for all Employees. 14.11.3 An Employee may elect to take time off in lieu of payment for overtime, at a time or times agreed with the Work Section Manager taking into account the needs of Employees, customers and production requirements. The Work Section Manager will indicate within two (2) working days of receiving an Employee’s request for time off in lieu of overtime whether or not it has been approved. The Work Section Manager will not unreasonably withhold consent; 14.11.4 Overtime, instigated by an Employee, must be overtime taken as time off in lieu during ordinary time hours taken at the ordinary time rate, that is an hour for each hour worked (i.e. if 8 hours is worked on a Saturday, the time taken in lieu is 8 hours) and paid at the Weekly Hire Employee’s rate of pay for the Employee’s own grade; 14.11.5 If an Employee is requested to work overtime by the Work Section Manager, the Employee will have the option of being paid at the appropriate overtime rates or take time off in lieu of payment for overtime. In this case, the time taken must be equivalent to the overtime payment that would otherwise have been made (i.e. if 4 hours are worked on a Saturday, the time taken in lieu is 7 hours). In this instance, the Work Section Manager and the Employee would mutually agree as to when the Employee would take the equivalent time off; PENALTY RATES ALSO APPLY FOR THE TIME OFF IN LIEU. 14.11.6 The Company shall, if requested by an Employee, provide payments, at the rate provided for the payment of overtime in the Agreement, for any overtime worked under this sub clause. 14.11.7 This sub clause can be used for Public Holidays; For example, an Employee who works 8 hours Easter Monday would be paid 8 hours ordinary time and the 12 hours ordinary time banked as Time Off in Lieu of Payment of Overtime; 14.11.8 This sub clause will not be used to avoid paying Employee(s) for overtime; 14.11.9 The Company cannot require Employee(s) to take time off in lieu of payment of overtime for overtime worked;
Time Off in Lieu of Payment of Overtime. (a) An employee may elect, with the consent of the employer, to take time off in lieu of payment for overtime at a time or times agreed with the employer within twelve (12) months of the said election. (b) Overtime taken as time off during ordinary time hours shall be taken at the ordinary time rate, that is an hour for each hour worked. (c) If, having elected to take time as leave in accordance with paragraph (a) above, the leave is not taken for whatever reason, payment for time accrued at overtime rates will be made at the expiry of the twelve
Time Off in Lieu of Payment of Overtime. 19.3.1 At the request of the employee, the employee will be able to have time off in lieu of payment for overtime. The time off will be taken at a time or times agreed by the Employee with the Company. 19.3.2 Time off in lieu of payment for overtime will be taken during an employee’s rostered shift at the ordinary time rate: that is an hour for each hour worked. 19.3.3 The Company will, if requested by an employee, make payment at the employee’s ordinary wage rate, for any accrued TOIL under this clause where such time has not been taken within four (4) weeks of accrual. 19.3.4 Professional A and B employees may be granted for time worked in excess of normal hours special additional remuneration or have this factored into account when fixing annual remuneration.

If the Employee’s employment ends, any outstanding hours will be paid at the appropriate penalty rate. b. The Employer cannot direct an Employee to take time in lieu and if circumstances arise so that the Employee cannot take the mutually agreed time in lieu within the 28 day period then payment of the overtime will be made in the next pay period. c. Leave loading does not apply to this arrangement. d. The provisions of this clause shall not apply to a Scientist - Director or Deputy Director.
