Transfer Outside the Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without his/her consent. If an employee is transferred to a position outside the Bargaining Unit he/she shall retain for a period of twelve (12) months his/her seniority accumulated up to the date of leaving the unit. An employee permanently transferred outside the unit shall lose all seniority in the bargaining unit.
Transfer Outside the Bargaining Unit. An employee may be transferred to a position outside the bargaining unit for a period not to exceed six months and will not accumulate seniority during this period. This period may be extended by mutual agreement by all parties.
Transfer Outside the Bargaining Unit. An employee who applies for and accepts a full-time promotion to a position outside the bargaining unit may be returned to her former position by the Corporation, or may return at her own request, within three (3) months of the date of promotion. An employee who returns to her bargaining unit position within three (3) months shall retain, but not accumulate seniority held at the time of transfer. Accumulation of seniority will resume upon return to the bargaining unit.

If an employee who has been transferred outside of the bargaining unit, other than on a provisional basis, subsequently returns to the bargaining unit, that employee shall not displace another regular employee, nor shall any time spent outside the bargaining unit count toward seniority for promotion purposes.

The individual designated as Supervisor, shall receive relief pay when: a) the work constitutes the full portion of a workday preceding or following a lunch break or more and; b) the duties assigned to the individual designated Supervisor are beyond the individual worker duties, as prescribed by OHSA requirements; or c) the duties assigned to the individual designated as Supervisor are beyond the decision expectation parameters of the bargaining unit job description. When required by the Corporation to relieve temporarily in a management position the employee shall receive a premium of one dollar ($1.00) per hour above their regular straight time rate of pay or the minimum rate for the position, whichever is greater, for all hours so assigned.

In the event the employee is returned to a position in the bargaining unit, she/he shall be credited with seniority held at the time of transfer and resume accumulation from date of her/his return to the bargaining unit. If an employee is transferred to a position outside of the bargaining unit for the purpose of back filling a pregnancy/parental leave only, the length of such term may be up to a period of twenty (20) months. An employee must remain in the bargaining unit for a period of at least three (3) months, unless agreed otherwise by the parties, before transferring out of the bargaining unit again or she or he will lose all seniority held at the time of the subsequent transfer. (b) In the event that an employee is transferred to a position outside of the bargaining unit for a period in excess of thirteen (13) months, she will lose all seniority held at the time of transfer. In the event the employee is returned to a position in the bargaining unit, the employee's seniority will accrue from the date of her/his return to the bargaining unit. (c) It is understood and agreed that the periods of time referred to above may be extended by written agreement of the parties which would include a defined period of time. (d) The Employer will notify the Bargaining Unit President in writing of any bargaining unit member who accepts a temporary transfer out of the bargaining unit. Such notification will include the defined period of time.

Transfer Outside the Bargaining Unit. (a) An employee who is transferred to a position or successfully competes for a temporary position outside the bargaining unit for a period of more than three (3) months, but not more than one (1) year will retain, but not accumulate, her or his seniority held at the time of the transfer or at the time that the temporary position is awarded. (b) An employee must remain in the bargaining unit for a period of at least three (3) months before transferring out of the bargaining unit again or she or he will lose all seniority held at the time of the subsequent transfer. (c) In the event that an employee is transferred to a position outside the bargaining unit or is awarded a temporary position outside the bargaining unit for a period in excess of one (1) year, she or he will lose all seniority held at the time of transfer or at the time that the temporary position is awarded. In the event the employee is returned to a position in the bargaining unit, the employee’s seniority will accrue from the date of her or his return to the bargaining unit. (d) It is understood and agreed that an employee may decline such offer to transfer and that the period of time referred to above may be extended by agreement of the parties. An employee who accepts a transfer under Article 11.08 will be not be required to pay Union dues for any complete calendar month during which no bargaining unit work is performed.
