Use of Accrued Paid Leave Clause Samples
The 'Use of Accrued Paid Leave' clause defines how employees may utilize paid leave that they have accumulated over time, such as vacation or sick days. Typically, this clause outlines the process for requesting leave, any advance notice requirements, and any restrictions on when or how much leave can be taken at once. Its core function is to provide clear guidelines for both employees and employers regarding the use of earned paid time off, thereby preventing misunderstandings and ensuring consistent application of leave policies.
Use of Accrued Paid Leave. Qualified Exigency Leave is unpaid leave, except that an employee shall use accrued vacation time prior to taking leave without pay.
Use of Accrued Paid Leave. Military Caregiver Leave is unpaid leave, except an employee may use sick leave in accordance with Article 13, ▇▇▇▇ Leave. An employee may also elect to use accrued compensatory time off or accrued vacation before taking leave without pay. However, if the employee's vacation leave accrual is at maximum, the employee will be required to use at least ten (10) percent of the vacation leave credit prior to taking leave without pay.

Use of Accrued Paid Leave. Family Care and Medical Leave is unpaid, however, an employee on medical leave for his/her own serious health condition shall use accrued sick leave in accordance with the University's disability plan or as provided in Article 19 -
Use of Accrued Paid Leave. Family Care/Medical Leave is unpaid, except for the use of sick leave and/or the use of accrued vacation, as provided in this Article:
a. An employee on leave for her/his own serious health condition:
1) shall use accrued sick leave in accordance with the University's disability plan requirements; or
2) if not eligible for University disability benefits and not on leave as a result of a work-incurred injury or illness, shall use all accrued sick leave prior to taking leave without pay; or
3) if on leave due to a work-incurred injury or illness, may use accrued sick leave as provided in Article 45 -
Use of Accrued Paid Leave. Pregnancy Disability Leave may consist of leave with or without pay; however, an employee shall be required to use accrued sick leave in accordance with the University's Disability Plan. If sick leave is exhausted, the employee may elect to use accrued vacation time prior to taking leave without pay.
Use of Accrued Paid Leave a. Family Care/Medical Leave is unpaid, except for the use of sick leave and/or the use of accrued vacation, as provided in this Article:
b. An employee on leave for her/his own serious health condition:
1) shall use accrued sick leave in accordance with the University's disability plan requirements; or
2) if not eligible for University disability benefits and not on leave as a result of a work-incurred injury or illness, shall use all accrued sick leave prior to taking leave without pay; or
3) if on leave due to a work-incurred injury or illness, may use accrued sick leave as provided in Article Work Incurred Injury or Illness.
c. An employee on leave for her/his own serious health condition shall use accrued vacation time prior to taking leave without pay, if all accrued sick leave has been exhausted.
d. An employee on Family Care Leave for Family Illness may use sick leave in accordance with Article Sick Leave, 'B.3., and shall use accrued vacation time prior to taking leave without pay.
Use of Accrued Paid Leave. This leave is unpaid leave, except that an employee may elect to use accrued compensatory time off (in accordance with Article 13 – Hours of Work) or accrued vacation time prior to taking this leave without pay.
Use of Accrued Paid Leave a. An employee on approved Family Illness Leave may, at the discretion of the University, elect to use accrued vacation time and/or compensatory time off before taking leave without pay. If the employee’s vacation leave accrual is at maximum, the employee will be required to use at least ten (10) percent of the vacation leave credit prior to taking leave without pay. Accrued sick leave may be substituted for Family Illness Leave granted under this Section, pursuant to Article 14 - Sick Leave, Section E. 5.
b. An employee on an approved Parental Leave may elect to use accrued vacation time and/or compensatory time off before taking leave without pay. If the employee’s vacation leave accrual is at maximum, the employee will be required to use at least ten (10) percent of the vacation leave credit prior to taking leave without pay.
c. An employee on leave for his/her own serious health condition shall use accrued sick leave in accordance with the University’s disability plan or as provided under Article 16 –
Use of Accrued Paid Leave. FML is unpaid, except for the use of accrued sick leave and/or the use of accrued vacation, as provided in this Article:
a. An Academic Researcher on FML for the Academic Researcher’s own serious health condition:
1) If eligible for University disability benefits, the Academic Researcher shall use accrued sick leave in accordance with the University’s disability plan requirements;
2) If not eligible for University disability benefits and not on FML due to a work-incurred injury or illness, the Academic Researcher may elect to use accrued sick leave prior to taking FML without pay;
3) If on FML due to a work-incurred injury or illness, the Academic Researcher may use accrued sick leave prior to taking FML without pay;
4) In any of the above circumstances, the Academic Researcher may elect to use accrued vacation time prior to taking FML without pay.
b. An Academic Researcher on FML to care for a family member with a serious health condition or taking FML as Military Caregiver Leave may use accrued sick leave in accordance with Article 25 - Sick Leave, Section B.2, or an Academic Researcher may elect to use accrued vacation time prior to taking FML without pay.
c. An Academic Researcher on FML for Pregnancy Disability Leave shall use accrued sick leave in accordance with the University’s disability plan requirements. If sick leave is exhausted, the Academic Researcher may elect to use accrued vacation time before taking FML without pay.
d. An Academic Researcher taking FML as Parental Bonding Leave may elect to use accrued vacation time and/or accrued sick leave before taking FML without pay.
e. An Academic Researcher taking FML as Qualifying Exigency Leave may elect to use accrued vacation time prior to taking FML without pay.
