Website Design and Development. 3.1. The Client acknowledges that the standard of the intended design works detailed in the Deeper Look portfolio (▇▇▇.▇▇▇▇▇▇▇▇▇▇.▇▇▇.▇▇) is a fair representation of the design The Client can expect to secure for its own website.
3.2. The website concept design Deeper Look will either update the existing website graphic design (if one exists) or will create a completely new website graphic design concept for The Client. The conceptual stage requires continual and timely feedback from The Client.
3.3. Number of website design concepts and design variations
(a) One design concept will be provided with up to three concept variations completed if required.
(b) A second design concept can be provided on request only if there have been no design variations requested on the first design concept. If a second design concept is requested only one concept variation is included. All additional design variations and any further design concepts will be charged at the Standard Hourly Rate unless otherwise agreed in writing by both parties.
Website Design and Development. 7.1. Where requested by the Client, Prevolution Digital will design and build a website or develop the Client’s website based on the brief agreed between the Client and Prevolution Digital.
7.2. Payment for the Services shall be made in accordance with condition 6 above. The balance of Prevolution Digital’s charges must be paid prior to the website going live. If any charges are not paid on or before the date for payment, Prevolution Digital may suspend the provision of the Services and Prevolution Digital will not upload the website to the Client’s server or supply the website files to the Client for use on any third-party hosting server.
7.3. Once Prevolution Digital has been paid in full for its website design and development services, Prevolution Digital will provide a version of the Client’s website to the Client for the Client’s review and approval. If the Client believes that the website design and/or development does not conform to the brief, then it shall notify Prevolution Digital within 3 (three) working days of receiving the version of the website. If no notification is received within 3 (three) working days of receiving the final version of the website then the website shall be deemed accepted and to conform to the description of the Services in every respect. Once approval has been given by any means, which can include by email or verbally, Prevolution Digital will release the website to the Client. On approval, Prevolution Digital will have no liability for any errors or downtime due to changes being made to the website by the Client or any third parties.
7.4. Prevolution Digital reserves the right to refuse to handle any material that it considers to be offensive, illegal, or controversial.
7.5. Unless agreed otherwise, the Client agrees that Prevolution Digital shall be free to use any ideas, concepts, know how or techniques used in the construction of the Client’s website for any purpose whatsoever, including, but not limited to, developing, manufacturing, and marketing products and other items incorporating such information. 8.
Website Design and Development. Client agrees to pay to DWS the sum of COST HERE (the “Contract Price”) to design and develop a website for Client (the “Client Website”) located at: http(address to be announced at a later date) in accordance with the accompanying Scope of Work, attached to this Agreement as Exhibit A, including any Change Orders as defined in Paragraph 2 below.

b. Where there is a "Project Plan" and it contains a timetable, whilst we will use our reasonable endeavours to meet the relevant dates time will not be of the essence in relation to this timetable and we shall be entitled to amend the timetable where failure to meet the due dates is due to your actions (or lack of them) or due to third parties or due to other circumstances beyond our reasonable control.
c. The performance of our work in relation to the web site is subject to you providing all materials (this shall include text, graphics, photographs and any other content) and all other necessary data, information, input and decisions as are required of you. You agree to provide these promptly and accurately and will nominate a contact for us to deal with who will act on your behalf and will be authorised to make decisions on you behalf. To avoid any doubt, we will not be liable for any loss arising from material, data, information, input or instructions supplied by you or on your behalf which is incomplete, inaccurate, illegible, out of sequence or in the wrong form.
d. Text supplied by you shall be typed up in a word processing application and supplied in a recognised and commonly used electronic format. Website Design and Development. Client agrees to pay to Company the sum of $5,000 (the “Contract Price”) to design and develop a website for Client (the “Client Website”) in accordance with the accompanying Scope of Work, attached to this Agreement as Exhibit A.
