COOPERATOR RESPONSIBILITIES. Cooperator will take possession of TIFMAS Vehicle at a time and location mutually decided on by TFS and Cooperator.
COOPERATOR RESPONSIBILITIES. The Cooperator understands and agrees to/that:

Submit to the APHIS AgDiscovery Program Manager the required documentation (Work and Financial Plans) for the processing of the new Cooperative Agreement for the coming year, no later than October 31 of each year in order to be able to participate in the program. Apply for the opportunity published in the EzFedGrants financial system no later than January 31 of the new year.
c. Furnish personnel and equipment as required, to accomplish the activities outlined in the Work Plan and Financial Plan. Cooperators are required to adhere to the applicable equal employment opportunity laws, rules, and regulations, when recruiting and hiring AgDiscovery program personnel. Cooperator will conduct criminal background investigations, and provide appropriate training pertaining to appropriate conduct and behavior while working with minors for all summer camp personnel hired.
d. Provide funds as partial payment of expenditures incurred in carrying out the terms of this Agreement in accordance with the Work Plan and Financial Plan.
e. Certify and submit to APHIS authorized representative an annual accomplishment report on all activities outlined in the Work Plan and Financial Plan. The report will be used by APHIS to verify compliance with revisions of this Agreement. It is due no later than 90 days after the Agreement expires or terminates. Any requests for an extension of time to submit the report must be justified and made in writing to APHIS’ authorized representative before expiration of the 90 day period. Extensions of time to submit the report are subject to the discretion of the APHIS authorized representative and, if allowed, shall be provided by the authorized representative in writing. When an agreement includes multiple projects covered by multiple Work Plans and Financial Plans, each project must be reported separately.
f. Submit to APHIS’ authorized representative properly certified annual Federal Financial Report (“FFR”), SF...
COOPERATOR RESPONSIBILITIES. The Cooperator agrees to/that:

b. To authorize USDA-WS to conduct wildlife hazard management activities as defined by the Work and Financial Plan.
c. To reimburse USDA-WS for costs, not to exceed the annually approved amount specified in the Work and Financial Plan. If costs are projected to exceed the amount reflected in the Financial Plan, the Work and Financial Plan shall be formally revised and signed by both parties before services resulting in additional costs are performed. The Cooperator agrees to pay all costs of service submitted via an invoice within 30 days of the date of the submitted invoice or invoices as submitted by USDA-WS. Late payments are subject to interest, penalties, and administrative charges and costs as set forth under the Debt Collection Improvement Act of 1996. If the Cooperator is delinquent in paying the full amount of the due service costs submitted by USDA- WS, and/or is delinquent in paying the due late payments, and/or is delinquent in paying the interest, penalties, and/or administrative costs on any delinquent due service costs, USDA-WS will immediately cease to provide the respective service associated with the submitted service costs. USDA-WS will not reinstate or provide the respective service until all due service costs, and/or due late payments, and/or due interest, penalty, and/or administrative costs are first paid in full.
d. To provide a Tax Identification Number or Social Security Number in compliance with the Debt Collection Improvement Act of 1996.
e. As a condition of this Agreement, The Cooperator ensures and certifies that it is not currently debarred or suspended and is free of delinquent Federal debt.

COOPERATOR RESPONSIBILITIES. 1. Under no circumstances will a landowner be authorized to purposefully take (e.g., intentionally kill, injure, capture, or transport) a Houston toad in an effort to return the property to baseline conditions or for any other purpose.
2. Informing EDF and the Service whenever the neighboring landowner has reason to believe that Houston toads have or may have colonized any site enrolled under the Safe Harbor Agreement (if such site was not known at the time of enrollment);
3. Providing a minimum of 60 days notice to EDF and Service’s Austin Ecological Services Field Office, ▇▇▇▇▇ ▇▇▇▇▇▇ ▇▇▇▇, ▇▇▇▇▇ ▇▇▇, ▇▇▇▇▇▇, ▇▇▇▇▇, ▇▇▇▇▇, phone (512) ▇▇▇- ▇▇▇▇; fax (▇▇▇) ▇▇▇-▇▇▇▇ prior to the following:
a. The removal or alteration of an enrolled aquatic site supporting Houston toads or any other significant change in land-use activity at an enrolled site that would be expected to result in take (e.g., death, injury, or other harm) of Houston toads. Neighboring landowners must provide the Service (and/or other designated representatives, as appropriate) access to such properties to capture and/or translocate any potentially affected Houston toads.
b. The sale or transfer of ownership of the enrolled property, so that EDF or the Service can attempt to contact the new owner, explain the responsibilities of the previous property owner under the Safe Harbor Agreement, and seek to interest the new owner in signing the existing Safe Harbor Agreement or a new one to benefit the Houston toad on the enrolled property.
COOPERATOR RESPONSIBILITIES. The County (Cooperator) agrees:

2. To authorize APHIS-WS to conduct direct control activities and/or technical assistance to reduce commercial agricultural damage associated to wildlife damage caused by the species identified in the Work Plan. Activities are defined in the Work Plan. APHIS-WS will be considered an invitee on the lands controlled by Wildlife Damage Abatement and Claims Program (WDACP) enrollees. These program enrollees will be required to exercise reasonable care to warn APHIS-WS as to dangerous conditions or activities in the project areas.
3. To reimburse APHIS-WS for costs, not to exceed the annually approved amount specified in the Financial Plan. If costs are projected to exceed the amount reflected in the Financial Plan, the agreement with amended Work Plan and Financial Plan shall be formally revised and signed by all parties before services resulting in additional costs are performed. The Cooperator agrees to pay all costs of services submitted via an invoice from APHIS-WS within 30 days of the date of the submitted invoice(s). Late payments are subject to interest, penalties, and administrative charges and costs as set forth under the Debt Collection Improvement Act of 1996.
4. To provide a Tax Identification Number or Social Security Number in compliance with the Debt Collection Improvement Act of 1996.

C. Maintaining all facilities in a sanitary condition. All employees shall be neat and clean in fact, as well as in appearance.
D. Ensuring alcoholic beverages and controlled substances are not used or furnished to any person at the incident.
E. Ensuring only those Cooperator employees essential to the mission may remain at the incident.
