External Applicants Clause Samples
The 'External Applicants' clause defines the rules and procedures that apply to individuals who are not currently employed by the organization but wish to apply for open positions. Typically, this clause outlines eligibility requirements, the application process, and any specific documentation or background checks required for external candidates. Its core function is to ensure a fair and transparent hiring process for non-employees, clarifying how external candidates are considered and helping to prevent misunderstandings or disputes regarding recruitment practices.
External Applicants. No external applicants will be considered until present employees have had a full opportunity to apply as provided in Article 13.01 and 13.05
External Applicants. Only after all of the provisions mentioned above have been met, may the Employer recruit individuals who are not current employees for the position.
External Applicants. An Employee who is transferred before completing their probationary period shall complete the initial probationary period in the new position.
External Applicants. An applicant chosen under this clause will transfer her service and her seniority (as a Regular or Temporary Employee of the Employer), and will have all rights set out in this Collective Agreement as if there was no break in continuous employment.

External Applicants b) In assessing the required qualifications of applicants, the Employer will consider each applicant’s abilities, education, skills, knowledge, aptitude and fitness for the vacant or newly created position in the Bargaining Unit and where the required qualifications of two (2) or more applicants are approximately equal, seniority will govern.
c) Permanent full-time and permanent part-time employees must have successfully completed their probationary or trail period of their new or current permanent position, as applicable and have not changed permanent positions within the last six (6) months. Where a permanent full-time or permanent part- time employee has applied within the same six (6) month period for another permanent position and has successfully completed the probationary or trial period of their new or current permanent position, these applications may be considered on a case by case basis in consultation with the Union. Release Agreements will be required and approvals will not be unreasonably withheld.
d) When a permanent employee successfully applies for a temporary position, the employee’s permanent status will not change. The employer, at their discretion, may waive all or part of the qualification requirements for this temporary position. Upon completion of the temporary position, the employee will be returned to the employee’s former position, the employee will be returned to the employee’s former permanent position without loss of pay, hours of work, seniority , and benefits. The employee may elect to return to their former permanent position at any time but will be ineligible to apply for any other temporary position for a period of twelve
External Applicants. Where no internal applicant is selected, the Selection Committee may continue the selection process by reviewing the external applicants and interviewing and/or selecting a candidate.
External Applicants. Where no Bargaining Unit member meets the essential requirements as listed in the job description, external applicants will be assessed against each of the essential requirements as specified in the job description. Methodology may reasonably differ from the assessment of internal candidates.
External Applicants. 8 Nurses applying for such vacancies shall be given consideration over 9 outside applicants providing the Hospital determines that the nurse 10 already employed by the Hospital possesses the necessary 11 qualifications for the job.
External Applicants. Exception to Qualified/EHC Examiners/ Temporary Postings: Internal applicants will be tested. The senior person who achieves at least seventy percent (70%) shall be awarded the position at the position’s rate of pay. If none of the persons tested achieves seventy percent (70%), but one or more of the persons tested achieves at least sixty percent (60%), then the senior person achieving at least sixty percent (60%) will be awarded the position as a trainee at the trainee’s rate of pay.
