Fences and Gates. 9.1 The Covenantor and the National Trust will agree from time to time on fencing requirements on the boundary of the Covenant Area as reasonably required to protect the Covenant Area from stock.
9.2 The fence on the boundary of the Covenant Area must protect the Covenant Area from stock types and/or stock levels on land adjacent to any boundary of the Covenant Area. If an adjacent land use has, or is likely to have, a detrimental effect on the Covenant Area, then the Covenantor must, at their own cost, erect and maintain appropriate stock-proof fencing on the affected boundary of the Covenant Area.
9.3 It is the Covenantor’s responsibility to keep and maintain all covenant boundary fences and gates in good order, repair, and condition, including replacement, when reasonably required. The provisions of the Fencing Act 1978 apply on title boundaries.
Fences and Gates. Lessee shall consult with Owner as to the location of all fences, gates, and cattle guards that it intends to construct on Owner’s Property outside of the Lessee Property; provided, that Lessee shall have sole discretion as to the ultimate location of any fences, gates, and cattle guards necessary to safeguard the Project. At Owner’s request, Lessee shall repair or replace any of Owner’s fences, gates, or cattle guards damaged or removed in connection with ▇▇▇▇▇▇’s activities on Owner’s Property. Fences removed from Owner’s Property, if replaced, shall be re-built by Lessee at its expense in mutually agreeable locations. All fence repair and construction of Owner’s fences, gates, or cattle guards shall be substantially similar to the construction of fences and cattle guards that exist on Owner’s Property as of the Effective Date. Once completed, all replacement fences, gates, and cattle guards shall be owned and maintained by Owner. Upon abandonment or termination of the rights granted to Lessee in this Agreement, any fences, gates, and cattle guards installed by ▇▇▇▇▇▇ shall remain and become the property of Owner. To minimize the need for temporary fencing, Owner will cooperate with Lessee to avoid pasturing animals on or near the Improvements during periods of construction, maintenance, or removal activity by Lessee. Owner will discuss with Lessee what temporary fencing is necessary during the periods of construction, maintenance, or removal activity by Lessee.
Fences and Gates. Fencing shall be designed for heavy commercial usage with top and bottom rail. Height shall be six feet above grade. Employee parking must be separated from customer parking by a 6’ tall fence or by the building. Fabric shall be chain link, No. 9 gauge wire woven in a 2 inch mesh. Fabric may be aluminum coated (ASTM A491) or zinc coated (ASTM A392). Posts, gates and other appurtenances shall be hot dipped, galvanized Schedule 40 pipe. Gates shall be complete with corner fittings and ball and socket hinges. Provide standard catches, stops and key operated cylinder style locks. Special double swing or double cantilevered slide gates may be required on some projects. Materials and installation standards shall conform to the “Standard Guide” as published by the Chain Link Fence Manufacturers Institute (CLFM1). Storm and Drainage Fencing: Fencing and access gates are required for all detention, retention, or drainage ditches which pass through or are located on the site. The owner shall install a 4-foot high fence system completely around the perimeter of these areas. The fence shall have a bottom rail located no more than 2 inches above finished grade, and a top rail along the fence perimeter. The horizontal fence members shall be located on the hazardous side of the fence. Maximum mesh size for this fence shall be 1 1/2” square, 9 gauge chain link unless the fence is provided with slats fastened at the top and bottom which reduce the openings to not more than 1 3/4”. There shall be at least 1 6-foot wide access gate provided for maintenance and shall be lockable by use of a key.
3.1 Cast In place concrete shall meet the following specifications: “Specification for Structural Concrete for Buildings”, ACI 301, except as modified herein.
A) Cement: ▇▇▇▇ Portland cement conforming to ASTM C-150 Type 1.
B) Aggregate for all concrete: conform to ASTM C-33 lightweight aggregate.

D) Welded wire mesh: conform to ASTM A-185.
E) No admixtures containing calcium chloride shall be permitted. All concrete shall have a minimum compressive strength of 3,500 PSI (for interior) and 4,000 PSI (for exterior) in 28 days except where noted, conforming to ASTM 39-83a. All concrete exposed to weathering shall be mixed with an air entraining type Portland cement or admixture. Air entraining admixtures shall conform to ASTM C-260. Fences and Gates. At Lessor’s request, Lessee will install and diligently maintain fences, gates and locks or cattle guards above pipelines and on all access roads, Christmas trees, pumping units, tanks, sump holes, pits, machinery, other excavations, or other areas of operations so as to maintain the integrity of preexisting fences and to the extent required to safeguard livestock and prevent access by any unauthorized persons. Lessor shall be given a key to these gates and allowed free use thereof. Gates or cattle guards will become Lessor's property on termination of this Lease. Lessee will keep all gates locked when not in use.
Fences and Gates. After reaching an agreement with the landowner, Hydro-Québec shall install gates or temporary fences inside the right-of-way where necessary to protect crops, livestock and property off the right-of-way. Fences inside the right-of-way that run along public access roads shall have rigid gates to prohibit access to the right-of-way outside working hours. In case of existing electric fences, Hydro-Québec may do one of the following: • Install an arch • Modify the power supply to supply the fence from both sides of the gate Hydro-Québec may use any other method satisfactory to the landowner. Gates shall be installed as follows: • Shore up posts on either side of the opening to maintain mechanical tension in adjacent spans. • Manually cut wire and, if adequate, use it to build the gate; if not, recover the cut wire and use material of equivalent or higher quality to build the gate. Hydro-Québec shall ensure that the contractor responsible for the work maintains the gates in good condition and keeps them closed at all times. In addition, any fence or temporary gate shall be visible at all times to anyone with access to the right-of-way. Any fence or gate that is cut, removed, damaged or destroyed shall be immediately repaired or replaced with material of equivalent or higher quality. When construction is completed, temporary gates shall be removed, barring agreement otherwise with the landowner. If stone or pole fences must be taken down, the material removed shall be stored and used to rebuild the fence when the construction work is completed. Hydro-Québec shall maintain appropriate protection systems for livestock. Any fence needed to keep out particular kinds of animals shall be described in specific mitigation measures, e.g., fences running along the right-of-way or allowing animals to cross it.

If any part of the Leased Premises, or the improvements thereon, are enclosed within the secure area of the Airport, Lessee shall provide all materials and labor, at its sole cost, necessary to comply with the Airport Security Plan and TSA Section 49 CFR Part 1542 (Airport Security). Lessee shall pay the cost of all additional gates or doors required for access by Lessee and its employees, business invitees, or others from the landside of the Airport to the air side of the Airport into the secure area. Lessee shall install an entry card system approved by the SRA pursuant to the Airport Security Plan submitted to and approved by the FAA at all security gates or doors on the Leased Premises. Any alteration of the communication devices or entry card system, which may be necessitated by a change in Governmental Requirements shall be paid for by Lessee.

If any part of the Leased Premises, or the improvements thereon, are enclosed within the secure area ("the Security Line") of the Airport, Lessee shall provide all materials and labor, at its sole cost, necessary to comply with the Airport Security Plan and TSA Section 49 CFR Part 1542 (Airport Security). Lessee shall pay for the cost of all additional gates or doors required for access by Lessee and its employees, business invitees, or others from the landside of the Airport to the airside of the Airport through the Security Line. At all security gates or doors on the Leased Premises, Lessee shall install an entry card system approved by ▇▇▇▇ pursuant to the Airport Security Plan submitted to and approved by the FAA. Any alteration of the communication devices or entry card system, which may be necessitated by a change in ▇▇▇▇ or FAA requirements shall be made at the expense of Lessee.

Fences and Gates. GRANTOR may construct, place and erect fencing and gates only as necessary for either permitted natural resource protection, preservation, restoration or enhancement, or permitted public recreational and educational use of the Property. Fencing must be the minimum necessary for such use. All fencing and gates must (a) preserve the scenic values of the Property; (b) not impede wildlife movement except in cases where necessary to protect the allowed natural resources preservation, restoration and enhancement, or recreational and educational uses described in this Easement and (c) comply with the DISTRICT’s then current guidelines for fences on conservation lands. Notwithstanding the provisions of Section 5.4.1, in the event of destruction or deterioration of any fences and gates, whether existing at the date hereof or constructed subsequently in accordance with the provisions of this Easement, GRANTOR may maintain and/or replace such fencing and gates only pursuant to the provisions of this Section 5.4.
