The 'Formal Level 1' clause establishes the initial stage of formal dispute resolution procedures within an agreement. Typically, this clause outlines the process by which parties must first attempt to resolve disputes through designated representatives or managers before escalating the issue further. For example, it may require that disputes be submitted in writing to a specific individual or department, who then has a set period to respond or negotiate a resolution. The core function of this clause is to encourage early, structured communication and problem-solving between parties, potentially resolving issues efficiently and minimizing the need for more formal or costly dispute resolution steps.
Formal Level 1. If a complaint is not resolved in a conference between the affected bargaining unit member(s) and his/her immediate supervisor, the complaint may be formalized as a grievance. A formalized grievance shall be submitted in writing within five (5) days of the meeting between the supervisor and the affected bargaining unit member(s). A copy of the grievance shall be sent to the Association and the immediate supervisor. The immediate supervisor shall, within five (5) days of receipt of the grievance, render a written decision. A copy of this decision shall be forwarded to the grievant(s) and the Association.
Formal Level 1. If a complaint is not resolved in a conference between the affected bargaining unit member(s) and his/her immediate supervisor, the complaint may be appealed in writing within ten (10) working days of the meeting between the supervisor and the affected bargaining unit member(s). If a grievance is not resolved in the meeting between the affected employee and his/her immediate supervisor at the Informal Level, the grievance may be formalized in writing, within ten (10) days of the Informal Level meeting between the supervisor and the affected employee. A copy of the grievance shall be sent to the immediate supervisor. The immediate supervisor shall, within five (5) days of the receipt of the grievance, render a written decision. A copy of this decision shall be forwarded to the grievant and the Association.
Formal Level 1. If a complaint is not resolved in a conference between the affected teacher(s) and his/her principal, the complaint may be formalized as a grievance. A formalized grievance shall be submitted, in writing on the approved form, within ten (10) days of the meeting between the principal and the affected teacher(s). A copy of the grievance shall be sent to the Association and the principal. The principal shall, within ten (10) days of the receipt of the grievance, render a written decision. A copy of this decision shall be forwarded to the grievant(s) and the Association.
Formal Level 1. If a complaint is not resolved at the informal level, the complaint may be formalized as a grievance. A formalized grievance shall be submitted in writing with in seven (7) working days of the informal level meeting between the supervisor and the affected Bargaining Unit Member(s) and shall include specific facts, contract sections allegedly violated, requested relief and signature of Bargaining Unit Member. A copy of the grievance shall be sent to the Association and the immediate supervisor. The immediate supervisor shall, within seven (7) working days of the receipt of the grievance, render a written decision. A copy of this decision shall be forwarded to the grievant(s) and the Association.
Formal Level 1 a. If a satisfactory resolution of the alleged contract issue(s) is not reached through the informal process, the grievant(s) shall have the right to file a written grievance with the appropriate supervisor. This level of grievance shall be filed within fifteen (15) working days from the date of the informal meeting. The written grievance shall include:
(1) statement of the grievance;
(2) circumstances involved;
(3) specific remedy sought; and
(4) statement of the specific provision(s) alleged to have been violated. Said written statement shall be prepared by the grievant and provided to the immediate supervisor on the approved form made available by the District.
b. A meeting with the grievant will be arranged to review and discuss the grievance. Such meeting will take place within five (5) working days from the date the written grievance is received by the District. Within five (5) working days following the meeting, the supervisor will provide a written response and decision.
c. In the event the immediate supervisor fails to conduct a hearing and render a decision in writing within five (5) working days, the grievant shall notify the Superintendent or designee who shall convene a hearing with the immediate supervisor and the grievant within two (2) days after notification and direct the immediate supervisor to render a decision in writing. Such a directed decision shall be made within five

Such written grievance must be submitted within five (5) days. The grievance shall state the alleged cause for the grievance, the Article and section of this Agreement which have allegedly been violated, the solution sought, and the signature of the member filing the grievance. Such grievance shall be submitted to the immediate supervisor. The immediate supervisor shall have five (5) days to respond in writing, with copies to the Association and the grievant. If the immediate supervisor is the Superintendent, Level 1 is bypassed.

A copy of this decision shall be forwarded to the grievant(s) and the Union. FORMAL LEVEL 1.B - When the supervisor(s) is/are not the Superintendent, the process described in 1A is expanded to include the next supervisory level if the grievant is not satisfied at 1A level, prior to proceeding to Level 2.
