Order of Dismissal Clause Samples
Order of Dismissal. Among teachers qualified to hold a position, teachers must be dismissed in the order of their groupings, with teachers in Group 1 dismissed first and teachers in Group 4 dismissed last.
a. Within Group 1, the sequence of dismissal is at the sole discretion of the District.
b. Within Group 2, the sequence of dismissal is based on the average of the last two summative performance evaluation ratings, if two ratings are available, or the teacher’s last summative performance evaluation rating if only one rating is available. The average is calculated using the following numeric values: 4 for “Excellent”; 3 for “Proficient” or “Satisfactory”; 2 for “Needs Improvement”; and 1 for “Unsatisfactory”. Teachers with the lowest average summative performance rating shall be dismissed first. Teachers with the same average summative performance evaluation rating shall be dismissed based on seniority, with teachers that have shorter length of continuing service with the District dismissed first.

This Article is not evidence that the Board waives any rights it may have to determine the qualifications of a Teacher to perform the duties of a specific position, or that the Association agrees that the Board may make such determination beyond the requirements of the School Code and applicable rules and regulations of the State Board of Education.

Order of Dismissal. 1. The Settling Parties will seek and obtain from the Court a Judgment as further described in Section XI below. The Judgment shall, among other things, (i) approve this Settlement Agreement as fair, reasonable and adequate,
Order of Dismissal. Upon receipt by Plaintiffs’ counsel of the monies specified in Paragraph 4 above, Plaintiffs authorize and direct Plaintiffs’ counsel to file a notice of dismissal with prejudice of the claims against the Defendants in this Action.
Order of Dismissal. The Plaintiffs and the Company will seek and obtain from the Court a Final Judgment and Order Approving Settlement (for which, as a condition of settlement, the time for appeal has expired without any modifications in the Final Judgment or Order Approving Settlement) as further described below in Section XV. The Final Judgment and Order Approving Settlement shall, among other things, (i) approve the Settlement Agreement in the Action as fair, reasonable and adequate, and (ii) dismiss the Action with prejudice and on the merits.
Order of Dismissal. Upon execution of this Agreement, the Parties shall execute a Stipulation and Agreed Order of Dismissal Without Prejudice for entry in the Lawsuit. Counsel for the Defendants shall present and file the Stipulation and Agreed Order of Dismissal in the form attached hereto as Exhibit B after Plaintiffs’ receipt of the settlement funds identified in paragraph 1(a), and clearance of such funds, if paid by check.
Order of Dismissal. If the Board determines that it is necessary to have a reduction in staff among tenured teachers, the order of such dismissals shall be in inverse order to the teacher’s seniority. All non-tenured teachers shall be dismissed before any tenured teacher is honorably dismissed so long as the tenured teacher is qualified according to SBE Document No. 1 to displace a non-tenured teacher.
Order of Dismissal. The Parties together will use their best efforts and agree to cooperate to expeditiously obtain from the Court, as a condition of Settlement, a Final Order and Judgment. The Judgment will, among other things: (1) approve the Settlement Agreement as fair, reasonable, and adequate; (2) dismiss the Action with prejudice and on the merits; and (3) incorporate the terms of the Release.
