Service Outside the Bargaining Unit. (a) Service with the Employer outside the bargaining unit shall not count for seniority purposes under this Article, save and except as expressly provided otherwise by this Agreement.
(b) Upon a decision by the Parties or the Labour Relations Board of British Columbia, or any of its predecessors or successors, that a person and a job previously excluded from the bargaining unit shall henceforth be included in the bargaining unit, the person involved shall be granted seniority for the entire period of employment with the Employer outside the bargaining unit since his or her last date of hire by the Employer. However, seniority achieved under this Clause 11.06(b) shall not be used to secure any promotion in accordance with Article 14 during the first six (6) months from the date of entry into the bargaining unit or to exercise any bumping rights under Article 39 during the first twelve (12) months from the date of entry into the bargaining unit.
(c) An Employee who accepts a position with the Employer outside of the bargaining unit shall accrue seniority for a period not to exceed ninety (90) consecutive calendar days from the date of commencement of such work, providing the Employee continues to pay the Union dues prescribed by Article 26. Upon expiry of this time limit, and continuation in the position outside of the bargaining unit, the Employee shall lose all seniority accumulated under this Agreement. An Employee shall only have the right to accrue seniority under this Clause 11.06
Service Outside the Bargaining Unit. (a) An employee who leaves the Union and subsequently returns shall be treated as a new employee from the date of his/her return except as otherwise provided in this Agreement.
(b) Employees excluded under the Labour Relations Code of B.C. and thus required to withdraw from the Union shall be credited with all seniority accrued pursuant to this Article, provided they do not in the meantime become members of another Union. Any such employee shall have the right to exercise such seniority for the purpose of re-entry to the Union bargaining unit.
(c) Upon a decision by the Parties or the Labour Relations Board that a person and a job previously excluded from the bargaining unit shall henceforth be included in the bargaining unit, the person involved, at his/her option, may be granted seniority credit for the period of exclusion provided it is approved by the Union and provided the person exercises such option in writing to the Union within 30 calendar days of the date of entry. Seniority achieved under this clause will not be utilized under the lay-off and bumping provisions within the first 12 calendar months from the date of entry and will not be utilized under the job selection or promotional provision within the first 6 calendar months from the date of entry.

(b) A bargaining unit employee who accepts a temporary promotion into a management position shall accrue seniority for a period not to exceed six (6) months from the date of commencement of such work, subject to the provisions of Clause 16.09. Upon expiry of this time limit, the employee shall lose all seniority unless by then he has returned to the bargaining unit.
Service Outside the Bargaining Unit. A nurse who works for the Medical Center in a position outside the bargaining unit and then returns to a bargaining unit position within twelve (12) months (without a break in service) will be given credit for his/her previously accrued seniority. Such a nurse will not be required to complete another probationary period upon return to a position within the bargaining unit.
Service Outside the Bargaining Unit. It is understood that service with the Armed Forces of Canada in time of war or compulsory military service, or service with the Employer as a supervisory employee does not constitute a break in the continuous service and shall not affect an employee's accumulation of seniority.
Service Outside the Bargaining Unit. An APP covered by this Agreement who, without 37 a break in employment by the Hospital or an affiliated LMG operation, enters non- 2 bargaining unit position, shall retain all previously earned seniority under this 3 Agreement. Reinstatement of previously accrued seniority will not apply until after the 4 non-bargaining unit APP’s return to the bargaining unit.

A Nurse who returns to the bargaining unit will resume accrual of 17 seniority once returned to the bargaining unit position, shall maintain their APL accrual 18 rate and a wage that is no less than their previously existing wage step under this 19 Agreement.

(b) A Regular Employee who accepts a position with the Employer outside of the bargaining unit shall accrue seniority for a period not to exceed three hundred sixty-five (365) consecutive calendar days, adding one (1) additional day in the case of a “leap year”, calculated from and including the date of commencement of such work. Upon expiration of this time limit, and continuation in the position outside of the bargaining unit, the Employee shall lose all seniority accumulated under this Agreement, and shall be considered to be terminated from employment hereunder, unless an extension of this time limit is mutually agreed by the Employer and the Union, on a case-by-case basis, in which event seniority shall continue to accrue for the duration of any such extension(s). The Union shall not unreasonably deny any such extension(s) of the aforesaid time restriction(s), particularly, but not limited to, in respect of replacement coverage for maternity or paternity leave.
