Superintendent Level Clause Samples

The 'Superintendent Level' clause defines the authority and responsibilities assigned to the superintendent on a construction project. Superintendent Level. If the grievance is not resolved at Step 1, the employee and/or the Union may refer the grievance in writing to the Superintendent or designee within ten (10) days after receipt of the Step 1 answer. The Superintendent or designee shall arrange for a meeting to take place within ten (10) days of receipt of the appeal. Within ten (10) days after completion of the conference, the Superintendent shall give his/her decision to the grievant/Union in writing.
Superintendent Level. If no settlement has been reached in Step 2 within the specified time limit, the employee and/or his/her designated Council representative may advance the grievance to Step 3 by submitting a copy of the written statement of grievance in appropriate form to the office of the superintendent within ten (10) calendar days of receipt of the written disposition of grievance given by the Step 2 administrator. After such submission, the superintendent or designee shall have ten (10) calendar days to attempt to resolve the grievance. Within that time the superintendent or his/her designee shall indicate his/her disposition of the grievance on the grievance form and shall furnish a copy thereof to the employee and to the Council. If in the resolution process a meeting is held with the grievant in attendance, a representative of the Council shall be given an opportunity to attend.
Superintendent Level. If no settlement is reached in Step 1, the grievance shall be reduced to writing and presented to the Superintendent within ten (10) days following Step 1. The Superintendent shall arrange for a hearing to take place within ten (10) days following the receipt of the request for the hearing. The parties of interest will have the right to include all facts and witnesses as deemed necessary and pertinent to the grievance. Upon conclusion of the hearing the District will have ten (10) days to provide the Association with a written decision and the response shall include the reasons upon which the decision was based.
Superintendent Level. The Superintendent or Designee shall meet with the grievant in an attempt to resolve the grievance. The Superintendent shall render a decision on the grievance within fifteen (15) days following the receipt of the appeal. If the aggrieved or the Association is not satisfied with the decision at the Superintendent Level, the aggrieved or the Association may appeal to the Board of Education through the Superintendent. Such action must be initiated within ten (10) work days after the decision is rendered at the Superintendent Level.
Superintendent Level. In the event the Union is not satisfied with the disposition of the grievance at ▇▇▇▇▇ ▇, it may proceed to Level 3 by filing the grievance and all written responses, along with the written reason of rejection by the Union, with the Superintendent or his/her designee within ten (10) working days of the answer at Level 2. Within ten (10) days of the appeal, the Superintendent or his/her designee shall hold a discussion of the grievance with the grievant and the Union's grievance chairperson or Union's designee. The Superintendent or his/her designee shall answer the grievance with reasons within ten (10) days of the discussion.
Superintendent Level. If no settlement has been reached in Step 2 within the specified time limits, the employee may, within seven (7) working days, submit the written grievance to the superintendent or his/her designee. The superintendent or designee shall within seven (7) working days after receipt of the grievance, hear the grievance and shall within seven (7) working days thereafter submit in writing the disposition of said grievance. The Union shall have seven (7) working days from the date of the decision of the superintendent or his/her designee to demand arbitration.
Superintendent Level. 3.1 If the complaint is not resolved at the informal level, either party may refer the written complaint, together with a written request for further consideration, to the Superintendent. 3.2 This request must be filed within five (5) days of the end of receipt of the immediate supervisor’s written response from Section 2.5 above. 3.3 The Superintendent shall investigate the complaint and issue a written opinion of the matter.
Superintendent Level. If the answer of the immediate supervisor does not satisfactorily resolve the grievance, the grievant and/or the Organization may, within seven (7) days after the receipt of the written answer from the immediate supervisor, submit the grievance to the Superintendent, or his/her designee, in writing, including the answer of the immediate supervisor. The Superintendent, or his/her designee, shall hear the grievant and/or the Organization and shall submit a written answer of the grievance to the grievant and the Organization within seven (7) days after receipt of the written grievance.
Superintendent Level. If the grievance is not settled at the preceding level, the grievance may be presented, in writing, to the Superintendent within five (5) days after the receipt of the decision in the preceding level. The specific nature of the complaint and the contract provisions alleged to have been violated shall be included at this time. The Superintendent or his/her designee shall meet with the aggrieved teacher, within five (5) days after receipt of the written grievance by the Superintendent, to discuss the grievance. The Superintendent or his/her designee shall issue a written decision within (five) 5 days after the conclusion of such meeting.
