Time Between Shifts Clause Samples

The "Time Between Shifts" clause defines the minimum required rest period that must occur between the end of one work shift and the start of the next for an employee. Typically, this clause specifies a set number of hours—such as 8 or 12—during which the employee cannot be scheduled to work, ensuring adequate time for rest and recovery. By establishing clear boundaries for scheduling, this clause helps prevent employee fatigue, promotes health and safety, and ensures compliance with labor regulations regarding working hours.

Employees who have completed their regular shift and are required to work 25 an additional continuous eight (8) hours shall be granted four (4) hours of rest with 26 pay at the straight hourly rate. The rest pay provision shall apply to the employee’s 27 first four (4) hours of their next shift and only occurs when the next regular shift 28 begins within twelve (12) hours of the end of the continuous work period. 1 ARTICLE 15
Time Between Shifts. (a) An employee who has completed a shift (that may include a contiguous period of overtime at the end of the shift) or a period of non-contiguous overtime after the shift shall not be required to resume work until nine (9) hours have elapsed from the time the shift or overtime period was completed. This will not apply to employee requested shift changes. (b) No loss of regular wages will be incurred as a result of (a) above. This will not apply to employee requested shift changes. (c) In exceptional circumstances, and with the employee’s consent, the nine (9) hour rest entitlement described in (a) above may be waived. The supervisor will consider the employee’s needs and the needs of the Sheriff’s Office and direct the employee to either report for work at the regularly scheduled shift or report for work after eight (8) hours have elapsed from the last call-in time or overtime. If the employee is directed to work at the regularly scheduled shift, the employee will be paid time and one half for all hours worked until eight (8) hours have elapsed from the last call-in time or overtime and straight time thereafter. If the employee is directed not to report at the regularly scheduled shift until eight (8) hours have elapsed from the last call-in time or overtime and reports and works as directed, the employee shall be paid as though the employee worked the entire shift.

Time Between Shifts. An employee shall have a minimum of ten (10) hours off before having to report for duty on said employee's next regular scheduled shift. The above does not apply to call-in situations, or to a continuation of work at the end of presently scheduled shifts. Additionally, exceptions may be made in emergency situations with the approval of the Chief and/or at any other time by mutual agreement between the employee and the Chief. An employee scheduled to report back to duty without the required ten hours off, shall be compensated at time and one-half for those hours in conflict with the ten-hour rule. For example: An officer is scheduled to work 3:00 p.m. to 11:00 p.m. one day and 7:00 a.m. to 3:00 p.m. the following day (eight off-duty hours between shifts). The officer will be paid time and one-half for the first two hours of his/her shift (7:00 a.m. to 9:00 a.m.) and will be paid at the regular straight-time rate for the hours worked from 9:00 a.m. to 3:00 p.m.
