ASSIGNMENT, TRANSFERS AND VACANCIES. 15.1 All bargaining unit vacancies shall be publicized to Association members through District e- mail notification for three days with pertinent information and procedures for being considered included. Vacancies, along with a job posting, will be on the District Web page as quickly as possible. Employees will apply for vacancies as an internal candidate using the District’s on-line application system.
15.2 When a vacancy becomes available, the position may be posted in-district and advertised externally simultaneously. However, files of external applicants will not be made available to the interview team for review unless it is determined that no qualified suitable candidates are available among internal applicants.
15.3 The interview team will select the most qualified and suitable candidate; and during the process administrative references will be considered. The interview team will make a recommendation to the Superintendent. The Superintendent’s decision is final.
a. When two internal candidates have absolutely equal qualifications and suitability, as judged by the discretion of the interview team, for a vacant position the one with the most seniority will be given preference.
1) If neither has seniority in the desired position, then District longevity will be considered.
15.4 Should an emergency situation arise where a position needs to be filled immediately, the District may temporarily assign the duties until the position is posted and filled using the hiring practices contained herein.
15.5 When requested, an internal applicant who is not selected for a position shall receive an explanation from the District.
15.6 Prior to selection of an employee for an involuntary transfer, the District shall notify employees within the same position of the potential for an involuntary transfer.
15.7 An employee involuntarily transferred due to economic or programmatic reasons shall be given preference for desired voluntary transfers back to the position they were involuntarily transferred from; this preference shall last two years from the date that the involuntary transfer took effect and end if they turn down an assignment, in said position, of equal or greater salary. Nothing contained in this subsection shall grant preference to an employee who was transferred involuntarily for disciplinary or staff morale issues.

ASSIGNMENT, TRANSFERS AND VACANCIES. A. Definitions
1. Vacancies A "vacancy" is a position that is not assigned to a current staff member at a given site. Notices of vacancies for positions covered by this Agreement shall be posted as they occur and copies of such notices shall be mailed to the Association. In cases where multiple openings may occur in a single year, the District shall not be required to re-post like positions. In filling vacancies for the succeeding year, the District will first decide whether it is necessary to make any involuntary transfers from sites and, if so, the district will follow the provisions below dealing with involuntary transfers. Next, the District will consider qualified employees who volunteer for reassignment or transfer according to the provisions below dealing with voluntary reassignment or transfer.

ASSIGNMENT, TRANSFERS AND VACANCIES. A. The assignment and transfer of a teacher directly affects satisfaction and effectiveness. Assignment and transfer should match the teacher’s qualifications in the areas of training, experience, and personal preference.
B. Teachers will be notified of their tentative programs for the coming year, including the grade levels assigned, subjects they will teach, and any specific or unusual classes that they will have by May 30 or 30 days prior to a new semester. However, due to fluctuating enrollment, staff changes, and other factors, it may be necessary to make changes. If changes are made by the District after these dates, the affected teacher(s) may choose release time or be paid at per diem rate for necessary prep work associated with the unforeseen schedule changes. Teachers will receive: • three (3) days release time or per diem rate for a new class or one that is significantly different than their current teaching assignment, • two (2) days release time or per diem rate for a class previously taught if it has been over one (1) year or two (2) semesters, • or one (1) day of release time or per diem rate for a class previously taught if less than one (1) year or two (2) semesters. Any discrepancies regarding the number of days allocated for prep work will be resolved by LEA and the District. Teachers may request a change of assignment for the next year. Such requests will be given careful consideration by the District. Teachers requesting a change of assignment shall be notified in writing of vacancies and new positions. Any teacher with appropriate qualifications, certifications, and necessary endorsements may apply for open positions within the district. The final decision as to whether an in-house candidate will be selected for an open or new position will be made by the District. Teachers requesting a change in assignment shall be notified within thirty (30) days of the disposition of the request. The District reserves the right to transfer staff members within the Cooperative in order to meet the academic needs of students in grades 6-12.
C. A vacancy is defined in this Agreement as any vacated or newly created position. An administrator may reconfigure a vacated or new position but the resulting position, if there is one, must be opened. To assure that pupils are taught by employees working within their areas of competence, employees shall not be assigned, except in accordance with the regulations of the State Board of Education, to subject, grades and/or other classes outside their teaching certificates and/or their major or minor fields of study or qualification in specialty areas. Employees shall have notification in writing no later than June 30 of any changes in their assignment(s). Subsequent to June 30 changes in assignment shall be made only after conference with the employee concerned. In the determination of assignments and transfers, the convenience and work of the employee shall be considered to the extent that these considerations do not conflict with the education program. As to the employees who desire a transfer or reassignment, the following procedures shall be used:
1. The employee shall write and submit a letter specifying positions interested in by April 15 which shall be kept on file by the District.
2. Employment of any new employee for a specific position shall not be made until all those employees who have a pending request for transfer or reassignment have been found by the Superintendent to be unqualified for the position.
3. At least thirty (30) days prior to the beginning of the school year, the Superintendent or his designee shall notify in writing and/or by personal conference each employee whose request for transfer or reassignment was not granted and the reason(s) for not granting the request. To assure that employees are given every consideration in filling any vacancies or newly created positions which occur at any time within the District, the following procedures shall be used:
1. All vacancies and new positions shall be publicized to the Staff and Association through a written notice which shall be distributed to each employee as far as possible in advance of the date of the opening of any vacancy or new position. During summer vacation such notification may include posting on a web page or voice mail/answering machine. Employees will be notified before the last day of school where to check during the summer for vacancies and new positions.
2. Said notice of vacancy or new position shall clearly set forth the qualifications for the position and the procedures for applying.
3. All vacancies or new positions shall be filled on the basis of qualifications for the position.

In the determination of assignments and transfers, the preferences of the employee shall be considered and followed to the extent that these considerations do not conflict with the education program.
