AWARDING OF POSITIONS. In vacancies other than provided for under 19.02, part-time to full-time and full-time to part- time the following factors shall be considered: (a) Length of seniority shall be the determining factor when (b) and (c) are considered to be relatively equal in the judgment of the Corporation. The Corporation shall not exercise this determination in an arbitrary or discriminatory manner; (b) The employee meets the normal requirements of the job; and, (c) The employee meets the physical ability to perform the functions of the position.
AWARDING OF POSITIONS. All posted positions shall be awarded to the unit employee ranking highest on the seniority list who applies and possesses the minimum qualifications. If no unit employee applies or is qualified, employees within the bargaining unit will be considered for the vacant position provided they apply within the posting period. Said consideration will be given prior to advertising outside. An employee who is promoted to another classification or transferred will be given a reasonable trial period, but not to exceed ninety (90) days to demonstrate in actual work performance whether he has the ability to perform the work. If he does not have the ability to perform the work, he will be returned to the position from which he was promoted and given written notice of the reason. A copy of the notice will be sent to the employee’s ▇▇▇▇▇▇▇.
AWARDING OF POSITIONS. Positions will be awarded on the basis of qualifications and seniority (see Section 47.5). In such cases where qualifications are equal, Tour Seniority will be the determining factor. Employees on approved leaves of absence shall not be considered unqualified because of their leave. If the most senior qualified driver is on an approved leave, regardless of when the leave started, the position shall be filled by the next most senior qualified driver who bid on the position until the most senior qualified driver returns from leave.

AWARDING OF POSITIONS. All such vacancies shall, as determined by management, be filled by awarding the position to the most senior qualified employee who bids for that position and has not been awarded a position within the last six (6) months. Employees will be transferred or promoted in accordance with their seniority, provided they have the necessary ability and experience and can meet the job description requirements. For purposes of this Article, “seniority” shall mean Employer Seniority accrued at this unit.
AWARDING OF POSITIONS. In promotions, demotions, transfers, layoff and recall, the following factors shall be considered: (a) length of continuous service; (b) knowledge, efficiency and ability to do the normal requirements of the job; (c) physical ability to perform the functions of the position; and when factors (b) and (c) are relatively equal in the judgement of the Corporation, which shall not be exercised in an arbitrary or discriminatory manner, factor (a) shall govern.
AWARDING OF POSITIONS. 9.7.1 All Position Vacancies shall be awarded in accordance with seniority provided that the Pilots’ licenses and qualifications, excluding type ratings, are sufficient in accordance with the minimum requirements contained in the Transport Canada Regulations and this Agreement. If applicable, the Pilot must also meet the conditions in the Company’s Upgrade Policy. 9.7.2 Within fourteen (14) calendar days after the closing date of the posting the Company will post the bid results, inform the successful candidate(s) and advise the MEC Chair in writing of the award(s). 9.7.3 A Pilot awarded a Position shall be bound by such award unless extenuating circumstances exist of a nature satisfactory to the Company. Extenuating circumstances are limited to personal and family emergencies. 9.7.4 If no applications are received from Pilots who meet the qualifications in accordance with paragraph 9.7.1 for a permanent or temporary vacancy, the Company may hire a new Pilot from outside of the bargaining unit to fill the Position Vacancy. 9.7.5 A Pilot who is awarded a Position where an initial training course is required, may be subject to an Equipment Freeze, at Company discretion, for a period of up to twelve (12) months. The start date of such freeze shall be the effective date of the bid or the date of a successful Pilot Proficiency Check (PPC), whichever is earlier. A new hire Pilot will also be required to remain in their initial Equipment type for a period of twelve (12) months. The Company may, at its discretion, waive such freeze period in order of seniority. If a Pilot is frozen on their Equipment, no Pilots junior to that Pilot may have their freeze waived. 9.7.6 During any freeze period a Pilot shall be permitted to bid for Position Vacancies on other Equipment provided the effective date of the applicable Position begins within sixty (60) days of the completion of the freeze period.
AWARDING OF POSITIONS. (a) All Level 1 positions shall be considered on the basis of seniority, fitness and qualifications before appointments are made. (b) In making all other staff changes, primary consideration shall be given to qualifications, ability and fitness to per- form the required duties. Where qualifications, ability and fitness are equal, seniority as defined in Article 23 shall prevail.
AWARDING OF POSITIONS. Section 1 Employees shall remain in an assignment until a vacancy occurs in another. Vacancies will be posted and awarded to the most senior qualified employee. The position vacated by the most senior qualified employee will also be posted and filled as was the first vacancy. Any additional vacancies will be filled with a new hire. Section 2 A person who is awarded a higher position, in accordance with the provisions of this Agreement, shall receive the full hourly rate set forth in this Agreement. All such appointments to higher positions shall be for a probationary 90 working day period, during which time the appointee's progress shall be reviewed and evaluated by the supervisory staff, including contractors and/or consultants hired by the Board in its discretion or the Director of Personnel and Labor Relations. During this probationary period, if the appointee's performance on the job does not meet the standards for the position as set forth in the job description, the supervisory staff, including contractors and/or consultants hired by the Board in its discretion shall recommend to the superintendent of schools that the appointee be rejected from the position and returned to a position similar to that he/she held prior to the position that he/she was rejected from. Written notification of the employee’s status shall be provided to the Union at the conclusion of the probationary period. Section 3 The decision as to when the promotion to the higher position is to become effective will be solely the judgment of the Director of Personnel and Labor Relations or his/her designate. It is understood that when possible, such promotion will become effective within two weeks from the date the award is made; however, the Director of Personnel and Labor Relations or his/her designate will advise the Union when such promotion is to be delayed.
