(d) The qualifications for the posted position or vacancy shall be consistent with the responsibilities specified in the posting.

(2) That job opportunity should increase in proportion to seniority. Therefore, in making staff changes, transfers, or promotions, appointment shall be made on the basis of a competition among applicants. Where the skill, ability qualifications and experience of the applicants are relatively equal, then seniority will be the deciding factor. Appointments from within the Bargaining Unit shall be made within three (3) weeks of postings. The job shall be filled within one (1) week of appointment.

(b) In making appointments and filling vacancies the qualifications such as job knowledge, experience and education shall be the primary consideration, but where such qualifications are equal, seniority shall be the determining factor. The qualifications for the posted position or vacancy shall be consistent with the responsibilities specified in the posting including acceptable performance of the Employee’s current job.
(c) As an alternative to (b), the Employer may elect at the time of posting to the following: When filling vacancies in a classification within the bargaining unit, seniority shall be the deciding factor.

(a) In making staff changes, transfers, or promotions, appointments shall be made of the applicant with the greatest seniority (whether full-time or part-time) and having the required qualifications and past performance. Appointments from within the bargaining unit shall be made within three (3) weeks of posting. Posting shall be made for a period of seven (7) calendar days. Employees in this bargaining unit shall have the first right of refusal for jobs within this bargaining unit in the event of vacancy or new jobs, before transfers are allowed. Temporary positions expected to be six (6) weeks or less shall not be posted, and may be filled at the discretion of the Home, such discretion will be exercised in good faith. Positions expected to be in excess of six (6) weeks shall be posted.
(b) Notwithstanding the above, the parties agree that if a temporary job is posted, appointments shall be made of the applicant with the greatest seniority (whether full-time or part-time) and having the required qualifications and past performance. If no part-time employee posts for said position then casual will be offered the position if the position is still unclaimed the Employer may fill the vacancy at the Employer’s discretion.
(c) An existing full-time, part-time or casual employee who is the successful applicant for a temporary position shall retain their status and revert to their original position upon completion of such temporary position.
(a) The successful applicant of a new classification shall be placed on trial for a period of up to six (6) weeks. Conditional on satisfactory work performance, such trial promotion shall become permanent after the period of up to six (6) weeks. In the event the successful applicant proves unsatisfactory in the position during the aforementioned trial period or if the employee finds themself unable to perform the duties of the new job classification, they shall be returned to their former position or any other position available without loss of seniority and wage and salary.

Therefore, in making staff changes, transfers or promotions within the Employer's service, appointments shall be made of the applicant with the greatest seniority provided the most senior applicant has, the necessary ability, suitability, qualifications, and special skills required to perform the work and provided the change, transfer or promotion does not negatively affect a delicate relationship existing between an applicant and a pupil.
