FACTOR 2 – PAST PERFORMANCE Clause Samples

The 'FACTOR 2 – PAST PERFORMANCE' clause is used to evaluate a party's previous experience and success in performing similar work as part of a selection or award process. In practice, this clause requires bidders or contractors to provide evidence of their track record, such as references, performance ratings, or summaries of completed projects relevant to the current contract. Its core function is to help the evaluating party assess the reliability and capability of potential contractors, thereby reducing the risk of poor performance on the project.
FACTOR 2 – PAST PERFORMANCE. Each Offeror’s past performance will be reviewed to determine a past performance confidence assessment.
FACTOR 2 – PAST PERFORMANCE. This factor evaluates the Offeror’s relevant present and past work performance history to draw a Performance Confidence Assessment of the Offeror’s ability to successfully perform in a proposed Market Segment. In accordance with FAR 15.305(a)(2), the currency and relevance of the information, source of the information, context of the data, and general trends in the contractor’s performance shall be considered. These are combined to establish one performance confidence assessment rating for each Offeror. There are three aspects to the past performance evaluation: The first aspect of the past performance evaluation is to evaluate the Offeror’s past performance to determine how recent an effort is. Only contracts/task orders within the past five (5) years of the date of the solicitation will be considered recent. The second aspect of the past performance evaluation is to evaluate the Offeror’s past performance to determine how relevant an effort accomplished by the Offeror is to the effort required by this solicitation. In determining relevance, consideration will be given to projects similar to this solicitation in scope, and complexity to the range of services required as described in the SOO. • For scope, each referenced effort will be compared to the requirements of this effort as found in the SOO for the specific Market Segment that the Offeror submitted a proposal under. Scope is defined as subject matter that is relevant to the Program Areas stated in the SOO. For complexity, each referenced effort will be compared to the requirements of this effort relative to the specific Market Segment the Offeror submitted a proposal under. Complexity is defined as how intricate the subject matter is relevant to performance across one or more Proficiency Areas and/or Market Segments in the SOO. The Government may consider efforts performed for agencies of the federal, state, or local governments and commercial customers. The evaluation will also include review of efforts performed by other divisions, subcontractors, teaming contractors, or joint venture partners, if such resources will be brought to bear or significantly influence the performance of the proposed effort. FACTOR 2 – PAST PERFORMANCE. The past performance evaluation assesses the degree of confidence the Government has in an Offeror’s ability to supply products and services that meet users’ needs, based on a demonstrated record of performance. The Government may consider past performance information contained in the Past Performance Information Retrieval System (PPIRS) and the Federal Awardee Performance and Integrity Information System (FAPIIS). The Government may also use other information such as Contractor Performance Assessment Reporting System (CPARS) or other data available from Government sources to evaluate an Offeror’s past performance. The Government reserves the right to limit or expand the number of references it decides to contact, and contact references other than those provided by the Offeror. The Government may consider past performance information obtained from sources other than those identified by the Offeror, including Federal, State, and local Government agencies, Better Business Bureaus, published media and electronic databases. In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available, the Offeror will not be evaluated favorably or unfavorably on past performance.
FACTOR 2 – PAST PERFORMANCE. (a) The Offeror shall provide three (3) past performance references, if available, that reflect recent and relevant experience performed within the last three (3) years of the closing date of the solicitation that demonstrate the ability to handle work performed under this contract, including similar hardware or services provided to federal, state, or local Governments, as well as commercial customers. Include a discussion on how the references provided are relevant to the work being proposed. Include contract/task order number, contract/task order type, program name, total contract/task order cost, short description of work performed, and names and valid telephone numbers for the Procuring Contract Officer (PCO), Contracting Officer’s Representative (COR), and Government Program Manager (PM), or equivalent. (b) Each prime past performance reference shall not exceed two (2) pages per reference for a total of six (6) pages. (c) Subcontractors performing more than twenty-five percent (25%) of the total price of the contract shall also submit three (3) past performance references, if available, that reflect recent relevant experience performed within the last three (3) years of the closing date of the solicitation that demonstrate the ability to handle work performed under this contract. Subcontractor past performance references shall contain the same information as that of the prime as listed in paragraph 4.2(a) above. Each past performance reference shall not exceed two (2) pages per reference, for a total of six (6) pages per subcontractor.
FACTOR 2 – PAST PERFORMANCE. 3.3.1 After the Offeror’s proposal has been determined to be technically acceptable or unacceptable, the technically acceptable proposals(s) shall be evaluated for past performance to determine whether there is a reasonable expectation that the Offeror will be able to successfully perform the required effort. FAPIIS and PPIRS are required to be checked as a result of the anticipated dollar amount. 3.3.2 The Government’s evaluation team shall consider the recency, relevancy, and quality of performance when evaluating the Offeror’s past performance. The Government will assign an acceptable or unacceptable rating for past performance. To receive an acceptable rating, past performance must be recent, relevant and have a quality rating of Satisfactory. If past performance is determined to not be recent or relevant or does not have a satisfactory quality rating a rating of unacceptable will be assigned and may be determined ineligible for award. Only those proposals determined to be acceptable, either initially or as a result of discussions, will be considered for award in accordance with the evaluation process described herein. Acceptable Based on the offeror’s performance record, the Government has a reasonableexpectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note above) Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort. 3.3.3 If the Offeror is without a record of recent/relevant past performance or for whom information on past performance is so sparse that no meaningful assessment rating can be reasonably assigned, the Offeror will not be evaluated favorably or unfavorably on past performance and, as a result, will receive an Acceptable rating for the Past Performance factor. Past Performance will include the following definitions as stated below: Recency Assessment An assessment of the past performance information will be made to determine if it is recent. In order to be recent, the contract must have been performed within the past three (3) years from the date of issuance of this solicitation (calendar years 2015-2018). Past Performance outside this timeframe will not be evaluated. FACTOR 2 – PAST PERFORMANCE. Offerors will be evaluated on performance under existing and prior Contracts and / or Task Orders for similar products or services. Offerors shall submit no more than three (3) total recent past / present performance efforts for evaluation, and each cited past performance effort shall not exceed three (3) pages. (Note: Single-Award IDIQs or BPAs (single-award) may be submitted as one past performance reference if all Task/Call Orders are described and presented.) Information on up to one (1) recent Contract performed by an Offeror’s significant teaming partners / subcontractors and significant subcontractors considered most relevant in demonstrating their ability to perform the proposed effort may be submitted. The Government considers a significant subcontractor and / or teaming partner to be a company who provides 20% or more of the support required, and / or a company who provides a critical portion of the effort required and / or influences the results of performance. The maximum number of past performance efforts submitted by the prime Offeror and its teaming partners may not exceed three (3) total. Therefore, if one (1) teaming partner effort is submitted, the maximum number of efforts submitted by the prime would be two (2) efforts. References other than those identified by Offerors may be contacted by the Government, and the information received may be used in the past performance evaluation. Offerors for whom information on past performance is not available, or so sparse that no confidence assessment rating can be reasonably assigned, will not be evaluated favorably or unfavorably on past performance and as a result will receive an “Neutral Confidence” rating for the Past Performance Factor. FACTOR 2 – PAST PERFORMANCE. Each offeror’s past performance will be reviewed to determine relevancy and confidence assessment. The Government will evaluate the offeror’s record of past and current performance to ascertain the probability of successfully performing the required efforts of the PWS. Relevancy. The first aspect of the past performance evaluation is to assess the offeror’s past performance to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection. Relevancy is not separately rated; however, the following criteria will be used to establish what is relevant which shall include similarity of service/support, complexity, dollar value, contract type, and degree of subcontract/teaming.
FACTOR 2 – PAST PERFORMANCE. The Government will evaluate the offeror’s record of past and current performance to ascertain the probability of successfully performing the required efforts of the PWS. Evaluation of past performance shall be in accordance with this plan utilizing the forms and questionnaires set forth in Appendix D. The past performance evaluation considers each offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the contract’s requirements. The Government will focus its inquiries on the Prime and major subcontractors, records of performance as they relate to all solicitation requirements, including cost/price, schedule, performance, and management of subcontractors. A significant achievement, problem, or lack of relevant data in any element of the work can become an important consideration in the evaluation process. Therefore, offerors will be reminded to include the most recent and relevant efforts (within the past three years) in their proposal. Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned a “neutral confidence rating” and its proposal will not be evaluated either favorably or unfavorably on past performance. The Government may use data provided by the Offeror in its proposal as well as data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal, State, or Local government, or commercial contracts for same or similar services. Offerors shall submit all Government and/or commercial contracts for the prime offeror and each major subcontractor in performance or awarded during the past three years, from the issue date of this RFP, which are relevant to the efforts required by this RFP. The Government may consider a wide array of information from a variety of sources but is not compelled to rely on all of the information available.
FACTOR 2 – PAST PERFORMANCE. The Government will evaluate the Past Performance of the Offeror. The past performance evaluation factor assesses the degree of confidence the Government has in an Offeror’s ability to supply products and services that meet users’ needs, based on a demonstrated record of performance. This assessment is based on the Offeror's record of relevant and recent past performance information that pertain to the products and/or services outlined in the solicitation requirements. Past performance will be initially evaluated to determine whether the Offeror's present/past performance is recent, and relevant or not relevant to the effort to be acquired. In establishing what is relevant for the acquisition, consideration should be given to what aspects of an Offeror's contract performance history would give the most confidence that the Offeror will satisfy the requirements of the contract that is contemplated to be awarded as a result of the evaluation of proposals in the current procurement. Second, the past performance evaluation is to determine how well the Offeror performed on relevant prior contracts. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the Offeror's past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the Offeror performed those past contracts. Table 2– Past Performance Ratings Adjectival Rating Description Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the offeror’s performance record is unknown. Unacceptable Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort.
FACTOR 2 – PAST PERFORMANCE. The Government will evaluate past performance to assess how well the contractor performed work relevant to the type of effort and type of requirement described in the solicitation, as an indicator of an offeror’s (to include major subcontractors) ability to perform this contract successfully. The Government will place more weight and consideration on more relevant past performance information. While not automatic, the lack of any such submissions may negatively impact the Offeror’s past performance evaluation. The rating for the past performance factor is the Government’s assessment of confidence, based upon the Offeror’s performance record, that the Offeror will successfully perform the requirements of this acquisition as proposed, based on the overall past performance record. The Government will not evaluate personal references.
