Firmware Updates from time to time certain Hardware may require a firmware update. The costs related to such firmware updates shall be paid by Customer. Supplier may at its discretion decide when such firmware update will have to implemented. If possible, Supplier will strive to remotely update the firmware. If the firmware cannot be updated remotely, Customer has to return the Hardware to Supplier or has to make an appointment with Supplier to update the relevant Hardware at Supplier’s premises. Supplier will give Customer a reasonable period to update the firmware. If the firmware is not updated prior to the date indicated by Supplier, Customer may not be able to use the SBS TELEMATICS, including the underlying Hardware anymore and any failures in the operation of the Hardware and the SBS TELEMATICS are for the account of the Customer.
Firmware Updates. BRINC will provide Updates and Upgrades to BRINC Device firmware for as long as a BRINC Device is part of an active Support Program. An “Update” is a generally available release that BRINC makes available from time to time. An “Upgrade” includes (i) new versions of BRINC software and/or firmware that enhance features and functionality, as solely determined by BRINC. Upgrades exclude new products that BRINC introduces and markets as distinct products or applications. New or additional BRINC products and applications, as well as any BRINC professional services are not included.

Seller shall provide the following updates for the Licensed Firmware: the annual delivery to Buyer of all corrections, updates, new releases, or new versions of the Licensed Firmware, together with all accompanying Documentation, promptly after final testing, but in no event later than the date made available to Seller's general customer base.
