Management Process. If a Commercial Issue or a Technical Issue cannot be resolved at the Tier 2 Management Process level, it shall be referred to a meeting of the Managing Director of Irish Water or nominee and the Manager of the Local Authority or nominee.
Management Process. Managers, supervisors or co-workers should not attempt to make judgements on a perceived medical condition or problem. Comments and assessment should be limited to fitness for work and the activity to perform work or associated duties. Where the use of alcohol or other drugs is identified as a problem in the workplace, the company will: 📬 advise the employee that his or her performance or conduct is unsatisfactory and that disciplinary action may be taken if the problem is not resolved; 📬 facilitate the employee in seeking access to counselling, treatment and rehabilitation to address the problem; 📬 assist, where reasonably practicable, an affected employee who is prepared to undertake rehabilitative treatment by temporarily adjusting workloads and/or performance expectations until the employee is able to resume the inherent requirements of the position; 📬 maintain normal confidentiality and privacy including, wherever possible, of any records and information regarding alcohol or drug related problems disclosed voluntarily to the company by the affected employee or becoming known to the company; 📬 apply relevant disciplinary action where the employee, for example, refuses to address the alcohol or drug related problem, or the problem continues; 📬 disciplinary action may mean termination of employment. Further, any employee who is observed at the workplace, coming to or returning to work in an obviously impaired condition will be removed from the work place or not permitted to enter the workplace. In such a case, a responsible manager or supervisor will provide or arrange for transportation home for the employee.
Management Process. 6.1 On the Closing Date, each of Parent and Purchaser shall designate a project manager (a “Project Manager”) to report and discuss issues with respect to the provision of the Services. The Project Managers shall meet to discuss the performance of the Services as often as reasonably necessary to ensure the orderly provision of the Services, and in any event at least monthly, and shall have authority to address and remedy problems related to the provision of the Services. Each party shall designate successor Project Managers in the event that a designated individual is not available to perform such role hereunder.
6.2 In the event that any dispute arises under this Agreement, the parties agree to negotiate in good faith to resolve such dispute prior to seeking relief in accordance with Section 19. Any party may at any time deliver a notice to the other party that it wishes to refer a dispute to the Project Managers. Following receipt of such notice, the Project Managers shall negotiate in good faith to resolve such dispute within a period of ten (10) days (or such longer period of time as such Project Managers may agree in writing). If at the end of such period, the Project Managers have not fully resolved the dispute, the Project Managers shall within ten (10) days appoint one expert satisfactory to both Parent and Purchaser to mediate the dispute and shall share equally the costs thereof. If within twenty (20) days following the appointment of such mediator the parties have not fully resolved the dispute, either party may seek relief in accordance with Section 19.

The development of technology following the ACDC architectural model implies that the management and control of the TDF applies to the upper layers, i.e. at the ACDC Solution and ACDC Service levels. The TDF does not control the individual ACDC tool development process and that responsibility falls on the corresponding tool owner. At this level, the TDF can only provide the guidelines and specifications necessary to ensure the correct integration, delivery and operation.
