The Project Services. 4.1.1. The Contractor shall carry out the Project Services in accordance with Annex 1 and to a quality acceptable to NICE.
4.1.2. No material changes to the Project Services shall be permitted without the written consent of NICE Project Manager.
4.1.3. The Contractor shall use its best endeavours to achieve the milestones set out in Annex 2 ("the Milestones").
The Project Services.
(a) The Contractor shall provide the Project Services in accordance with the Performance Standards and all other requirements set out in Item 8 of Schedule 1 and Schedule 2.
(b) In addition to complying with the other provisions of this Agreement the Contractor shall comply with all statements or representations as to its performance or the provision of the Project Services contained in the Proposal.
(c) The Contractor shall carry out its obligations and duties and provide the Project Services in order to complete the provision of the Project Services to the reasonable satisfaction of the Authority’s Representative and shall exercise all due care, skill and judgement and at all times act in accordance with the applicable professional standards, principles and practices.
(d) The Contractor shall have regard to any requirements notified to it by the Authority’s Representative and shall comply with all reasonable directions of the Authority’s Representative.
(e) The Contractor shall permit the Authority’s Representative to enquire of, to confer with and counsel the Contractor and its employees engaged in the provision of the
(f) The Contractor shall provide the Authority’s Representative with written reports every 30 days as to the progress of the Project Services.
(g) The Contractor shall supply to the Authority’s Representative such information as to the progress of the Project Services as he may from time to time reasonably require.
The Project Services. 2.1 The Project Services provide a choice of 3 levels of service: :
(a) Basic The basic level of service applies to new provision orders for a single End User at single or multiple sites of that End User. It provides weekly status reports using reports from the relevant ordering system. The status report fields are shown in Annex A to this Schedule. The Basic Level of service provides a one weekly management conference call of up to 1 hour with the CP for the purpose of reviewing progress against plan. The call will cover for example, number of completions, number of delays with reasons and any new Estimated Completion Dates (ECDs). Openreach will provide a single point of contact for delivering the Service with deputies to cover leave or absences.
(b) Standard The standard level of service applies to new provision orders for a single End User at single or multiple sites of that End User. The Standard product is the Basic product plus Openreach will: Prior to the order completion date:
(i) Liaise with planning teams regarding the project requirements;
(ii) Check Openreach systems to ensure that the provision order is on target for completion and investigate those which are not;
(iii) Verify the appearance of project specific notes in orders; and
(iv) Notify the CP’s single point of contact of any exceptions discovered. On the order delivery date:
(i) Liaise with the Openreach engineering function to assist the smooth running of the job including facilitating site access issues;
(ii) Review the progress of the job;
(iii) Manage issues arising which are within Openreach’s control; and
(iv) Liaise with the CP’s single point of contact as appropriate. The Standard level of service has the following options:
(i) Appointment co-ordination;
(ii) Where mutually beneficial, for a single site programme or sites positioned in a limited area, liaison with the engineering function to endeavour to allocate orders to a specific engineer where appropriate;
(iii) Liaison as appropriate with 3rd parties undertaking interdependent work on the provision order eg. equipment engineers.
The Project Services. 6.1 The Contractor shall provide the Project Services, which shall conform to the Performance Standards and meet all other requirements set out in Schedule 2 and the Project Brief.
6.2 In addition to complying with the other provisions of this Agreement the Contractor shall comply with all statements or representations as to its performance or the provision of the Project Services contained in the Tender.
6.3 The Contractor shall carry out its obligations and duties and provide the Project Services in order to complete the provision of the Project Services to the reasonable satisfaction of the Authority’s Representative and shall exercise all due care skill and judgement and work diligently, effectively and to a high standard and at all times act in accordance with the applicable professional standards, principles and practices.
6.4 The Contractor shall observe and comply with all Relevant Legislation.
6.5 The Contractor shall have regard to such requirements as may be conveyed to it by the Authority’s Representative and shall comply with all reasonable directions of the Authority’s Representative.
6.6 The Contractor shall permit the Authority’s Representative to enquire of, to confer with and counsel the Contractor, the Contractor’s staff and its employees engaged in the provision of the Project Services, and shall do all that is within its power to facilitate any and all appropriate enquiries, conferences and counselling.
6.7 The Contractor shall provide the Authority’s Representative at intervals of approximately thirty
