Usage Right. 1. As a licensee of the contract program, Insight grants non-transferable right (hereinafter referred to as "Usage right") using the contract program non-exclusively to a corporation.
2. The corporation can use the contract program only after Insight delivers this Agreement to a corporation, for example by paying a predetermined license fee.
3. The corporation can use the contract program only for the designated equipment for its own work. However, it is assumed that the designated device has the operating environment requested by the contract program.
4. In addition to what is stipulated in other parts of this Agreement, the corporation shall not perform the acts specified below.
(1). To transfer, rent, lease, sell, and re-license the contract program to a third party. (2). Reverse engineering, decompiling and disassembling the contract program.
(3). Use the contract program for commercially based timesharing or for third-party training.
(4). Modify, modify, change and translate the contract program without prior written permission by insight.
(5). Make copies of the contract program, except as provided in Article 3 of this Agreement.
5. The corporation allows Insight to enter the corporate building within business hours to confirm the performance conditions of this Agreement and the status of the contract program. In cases where the corporation has a violation of this Agreement and the damage is not recovered by monetary damages, Insight may request the court to stop the acts of the corporation without giving up other rights.
6. License fee and settlement method shall be determined separately between the parties (or the designated agency of Insight).
Usage Right. Subject to payment of the Fees and your compliance with the terms of this Agreement, HackTheBox hereby grants Subscriber, a limited, non-exclusive, non-transferable and revocable right to access and use (and permit Authorised Users to access and use) the Services and the Documentation during the Subscription Term solely for your internal business purposes.
Usage Right. 2.1 The data transmitted for usage is copyright-protected by the licensor.
2.2 The licensor will be responsible for ensuring that exercising of the rights granted to the licensee does not conflict with any third-party rights over the subject of the agreement.
2.3 The licensee will receive the free, basic usage right, without limitations in content or place, to distribute and duplicate the documents specified under 1.1 on its online platform and in its printed products for the purpose of marketing the products illustrated or described in the documents. Should the licensee commission a service provider to further process the data, it will be responsible for agreeing the conditions of usage, which satisfy the content of the agreement reached with the licensor, in writing before transfer of the data. A copy of the agreement reached with the service provider is to be delivered to the Licensor.
2.4 The usage right includes the right to edit the licensed documents. In doing so, it is to be ensured that the name, charac- ter and defining features of the Licensor‘s products are not altered. In particular, the manipulation of design aspects as well as the distortion of images by means of discolouration, disproportionate scaling as well as embedding in inappro- priately themed settings are prohibited. The provisions of the licensor‘s CI style guide are to be complied with.
2.5 Furthermore, the source of the data is to be referred to as follows in a clearly visible position: “Usage of digital data belonging to Auerswald GmbH & Co. KG, Vor den Grashöfen 1, 38162 Cremlingen, GERMANY.“ Data Usage Agreement V1.2 19.08.2021 page 1 of 2
2.6 The data provided may not be used for purposes that violate the existing agreements between the licensee and the licensor (Auerswald GmbH & Co. KG), in particular not for illegal purposes and/or unlawful advertising. If a third party asserts claims against the licensor due to a use of the data for which the licensee is responsible, the licensee shall defend these immediately and in any case indemnify Auerswald GmbH & Co. KG upon first request from damages and expenses that are attributable to the contractual or unlawful conduct of the licensee.
Usage Right. Party B shall have the right to release the Text/Graphics Resources in the Licensed Area (i.e., ▇▇▇▇▇.▇▇▇ and ifeng News mobile application) (including corresponding selection, adaptation, editing or compilation thereof, subject to Article 5.1) in China (as defined above).
Usage Right. With the conclusion of the app Licence Agreement, Fleetboard grants customers a non-exclusive, non-trans- ferable and non-sublicensable right that is limited to the contract period of the app Licence Agreement to use the Fleetboard App themselves for their own commercial purposes or to allow their staff to use it for those purposes. This includes any copies that are technically required for download, installation and use of the Fleetboard App on a mobile end device, such as in the memory.
Usage Right. 15.1 Supplier grants Customer a non-exclusive right to use the software. Customer shall diligently adhere to the usage limitations agreed upon between the parties. Notwithstanding other provisions in these Terms and Conditions, Customer's usage right shall solely encompass the right to load and execute the software.
15.2 Customer may use the software solely within its own company or organization, on a single processing unit, and for a specific number or type of users or connections for which the usage right has been granted. Unless otherwise agreed upon, the processing unit used by Customer for the first time to run the software and the number of connections connected to that processing unit at the time of initial use shall be considered the processing unit and number of connections for which the usage right has been granted. In the event of a malfunction of the designated processing unit, the software can be used on another processing unit for the duration of the malfunction. The usage right may extend to multiple processing units, as expressly indicated in the agreement.
15.3 The usage right is non-transferable. Customer is not allowed to sell, rent, sublicense, alienate, or grant limited rights in the software and the media on which it is recorded, or to make the software available to a third party in any manner or for any purpose, either remotely or not, to provide a third party, even remotely, with access to the software, or to host the software with a third party, even for Customer's exclusive use. Customer shall not modify the software, except for the purpose of error correction. Customer shall not use the software for data processing on behalf of third parties ("time- sharing"). The source code of the software and the technical documentation produced during the development of the software shall not be provided to Customer, even if Customer is willing to pay a financial compensation for such provision. Customer acknowledges that the source code is confidential and contains trade secrets of Supplier.
15.4 Promptly upon the expiration of the usage right of the software, Customer shall return all copies of the software in its possession to Supplier. If the parties have agreed that Customer will destroy the respective copies upon expiration of the usage right, Customer shall promptly notify Supplier of such destruction in writing.
Usage Right. Party B shall have the right to release the Text/Graphics Resources in the Licensed Area (ifeng VIP mobile application) (including corresponding selection, adaptation, editing or compilation thereof, subject to Article 5.1) in China (as defined above).
Usage Right. Subject to the terms and conditions of this Agreement, including payment of the fees, during the respective Subscription Term GYTPOL shall grant Customer a non-exclusive, limited, non-transferable, non-sublicensable, revocable right , to, subject to the respective subscription model specified in the respective Order, either install, download access and/or use (as the case may be) the Platform solely for Customer's internal purposes (collectively, the “Subscription”). Customer may use the Platform subject to the use limitations specified in this Agreement, the respective Order and applicable laws and regulations. Customer shall be solely responsible for providing all equipment, systems, assets, access, and ancillary goods and services needed to access and use the Service, for ensuring their compatibility with the Platform.

(A) In consideration of the payment of Usage Fees, Owner hereby (i) agrees to make available for pick-up by User or use on Owner's premises, on an as is, where is basis, and (ii) grants to User the right, subject to paragraph 2(B) and Section 4, to use the Equipment during the period from the Effective Date to the date of termination of this Agreement.
(B) Owner shall be permitted to use the Equipment when not in use by User, subject to the following conditions. At any time that Owner desires that itself or a third party use such Equipment (or any portion thereof) which is on User's premises, (i) Owner shall give User not less than ten (10) days prior notice of the dates of intended use, (ii) the scheduling of such use shall not unreasonably interfere with the requirements of User's business and (iii)

You authorize ▇▇▇▇▇▇▇▇ to include Your anonymized data in aggregations that may be shared publicly, including, without limitation, on ▇▇▇▇▇▇▇▇’▇ website, with its clients, with other users of the Survey, and with other third parties. ▇▇▇▇▇▇▇▇ may also transfer the information from the U.S. to other countries, which may have less stringent data protection laws. Any of Your raw data collected will only be accessible by Armanino staff or contractors who need to process this information and are subject to non-disclosure obligations.
