Declaration of Availability Clause Samples

A Declaration of Availability clause requires a party to formally confirm that they have the necessary resources, personnel, or assets available to fulfill their obligations under the agreement. In practice, this may involve a contractor certifying that they have the staff and equipment ready to begin work on a project, or a supplier confirming inventory levels before entering a supply contract. The core function of this clause is to provide assurance to the other party that commitments can be met as promised, thereby reducing the risk of delays or non-performance due to lack of resources.
