Testing Results i. In all cases of testing a detainee’s test results shall be provided to the tested detainee within 24 hours after receiving all test results for detainees in the housing unit tested at the same time.
ii. If an individual in a housing unit tests positive, Federal Defendants shall inform the detainees in that housing unit of the positive test result within 24 hours of Federal Defendants’ receipt of test results. Nothing in this section shall require Defendants to reveal the identity of the positive detainee, only the fact of a positive test.
Testing Results. Upon receipt of the test, the laboratory will divide the sample in half. If the first test yields a negative result, the second half of the sample will be discarded. If the test yields a positive result, the second half of the sample will be tested to verify the result. Unless both halves of the sample yield positive results, the test will be considered a negative test.
1. The testing laboratory shall perform an initial screening test, which meets the requirements of the Food and Drug Administration. A positive test result will be confirmed by using gas chromatography/mass spectrometry (GC/MS) techniques. All confirmations shall be by quantitative analysis and must be reviewed by a medical doctor or doctor of osteopathy.
2. The physician or osteopath shall: (1) contact the employee within 48 hours and offer an opportunity to discuss the confirming test result; (2) interpret and evaluate the positive drug test result; and (3) report test results caused by prescription medicine as negative.
3. The testing laboratory shall report the results of the test to the Program Administrator after the confirmation test has been performed and the employee has been contacted.
4. After drug testing, the supervisor who accompanied the employee to the test shall either drive the employee back to work or to the employee’s home based upon a determination of impairment.
Testing Results. (a) The Buyer will not be required to pay for Dairy Product which is rejected according to the terms and conditions of the Standard Form Contract which will be entered into between a Buyer and a Seller and will govern the ongoing supply of Dairy Product.
(b) Upon receiving the Testing Data and where MX is engaged to conduct Collection, Testing and Delivery Services on behalf of the Buyer, MX will use reasonable endeavours to provide early notification to the Seller of any out-of-the-ordinary results arising from the testing conducted by MX (or a subcontractor of MX).
Testing Results. 1. In the event a bus driver tests positive, the same sample will be retested a second time by the same lab using another reliable method that is specific for the substance detected. The results of the second more specific test will be controlling and be acted upon if it conflicts with the first test.
2. If an employee tests positive, the employee shall be referred for appropriate treatment and counseling. Such employee shall be suspended until they obtains a release to return to work from the treating facility or physician. Upon return to work, such bus driver should be subject to a six (6) working month probationary period subject to unannounced testing following the date of return to work. If the employee violates the terms or conditions of the treatment program or tests positive during such six (6) month period, they shall be subject to immediate discharge.
Testing Results. Seller shall, as promptly as possible, provide buyer with copies of the results from all internal and third-party testing of any of NRM’s products.
Testing Results. A. The results of the testing shall be delivered to the Employer and the employee tested. An employee whose confirmatory test result is positive shall have the right to request a certified copy of the testing results in which the vendor shall affirm that the test results were obtained using the approved protocol methods. The employee shall provide a signed release for disclosure of the testing results. Refusal to submit to the testing provided for under this Agreement may be grounds for discipline.
B. The Employer may suspend the employee without loss of pay before the time the confirmatory test results are complete. If the screening test and confirmatory test are positive, the Employer may discipline the employee. The use of illicit substances, including any form of marijuana, on or off duty, will ordinarily result in termination. The improper use of prescription drugs and/or alcohol may result in a lesser discipline, depending upon the relevant circumstances. Such discipline must be uniform in its application.
Testing Results. 5.1 You acknowledge that a test report applies only to the sample tested and is intended to provide you with guidance information only and not for use in commercial transactions.
5.2 AWTA Ltd is not liable for any claim which may arise from any person acting on information contained in the test report, including, without limiting the generality of this clause, any claim arising in respect to the Eco-Label scheme.
5.3 You must not:
(a) alter or allow alteration of test reports; or
(b) reproduce or allow the reproduction of test reports except in full.
5.4 We disown all responsibility to any party in relation to a test report which has been altered.
Testing Results. Those employees who elect to enroll and participate in the program, and who have achieved a passing score on both semi-annual tests within the same year, shall be entitled to receive the fitness incentive pay described in the contract. If such employees do not achieve passing score on either semi-annual test, such employee shall not receive, and shall not be eligible to receive, any fitness incentive pay for that period. FITNESS TEST BENCHMARKS-FITNESS INCENTIVE PAY MINIMUM TEST REQUIREMENTS: Eligibility to receive fitness incentive pay, requires participants to pass all three of the following test components: push- ups, sit-ups and 1.5 mile run/walk. Each participating employee who passes both semi-annual physical fitness tests within the same year shall be entitled to receive fitness incentive pay, which will be paid annually, in an amount specified in the contract. The Yakima Police Department’s Corrections Sergeants Physical Ability Test (PAT) shall utilize the same elements as the test administered by the Washington State Criminal Justice Training Commission for entry level corrections academy recruits. At each semi-annual test, the CJTC scoring system that is current at the time of the test will be utilized, and an overall score of 130 or better must be achieved to be eligible for the incentive pay. The PAT is comprised of three tests, following the CJTC Protocol below. • Push-ups • Sit-ups
Testing Results. Saguaro Testing will notify Client of test results according to the Client’s requested method of communication, as determined by Client on Saguaro Testing’s Chain of Custody Form.
Testing Results. Maintenance of Test Results - Testing results will be forwarded by the independent laboratory to the ▇▇▇▇▇▇ County Office of Human Resources, where the results will be maintained in a confidential manner.
