Utility Requirements Clause Samples
The Utility Requirements clause defines the obligations and standards related to the provision and maintenance of essential services such as electricity, water, gas, and telecommunications for a property or project. Typically, it specifies which party is responsible for arranging, paying for, and ensuring the continuous supply of these utilities, and may outline minimum service levels or compliance with local regulations. This clause ensures that all necessary utilities are available and maintained, thereby preventing disputes and interruptions that could hinder operations or occupancy.
Utility Requirements. A. Make notification to utilities during conceptual phase of preliminary design process. Communication to be made in a specific, documented format. (As detailed in item D).
B. Based on specific utility feedback, and field observation, identify potential high expense utility relocation issues.
C. Prepare and present plan for city review, detailing significant utility conflicts, proposed pothole locations, and associated costs for verifying existing utilities. Potholing process to include horizontal and vertical alignment and depth details. Details will be included in 30 percent plan completion, final right of way plans, and final construction plans. Necessary corrective action to address incomplete or inaccurate details may be subject to errors and omissions insurance claim.
D. Submit utility report at 30 percent submittal and close out of project. Utility report to include representatives contacted, meeting dates, and a summary of discussions, requests, observations and/or concerns. (See City of Joplin utility notification form)
Utility Requirements. All Services and Work shall be done in accordance with this Agreement, all Legal Requirements and all warranty requirements. The EPC Contractor shall give any and all notices required and comply with all Legal Requirements and Utility Requirements bearing on safety of persons or property or their protection from damage, injury or loss. EPC Contractor represents and warrants that any Subcontractor(s) will comply with the standards set forth in this section 3.5 and covenants that EPC Contractor shall (i) ensure that any Subcontractors comply with this Section 3.5 and (ii) be liable for the failure of any Subcontractor(s) to comply with any Legal Requirements or warranty requirements.
Utility Requirements. The Project shall be serviced solely by Ocala Electric Utility for electricity after the date on which a certificate of occupancy is issued for the Project.
Utility Requirements a. The site shall be constructed and graded in a manner to drain surface water away from the Parking Garage.
b. Entryways to the Parking Garage shall have sufficient drainage and provide overland relief to eliminate the potential for flooding.
Utility Requirements. This will include estimates of the consumption of steam, electrical power, cooling water, instrument air, inert gas, fuel gas and fuel oil;
Utility Requirements. The Contractor is advised of the existence of the utility notification service provided by UNDERGROUND SERVICE ALERT (USA). USA member utilities will provide the Contractor with the precise locations of their substructures in the construction area when the Contractor gives at least 48-hours’ notice to the Underground Service Alert by calling ▇-▇▇▇-▇▇▇-▇▇▇▇. The location and existence of utilities and improvements shown on the plans are approximate and taken from available records. The Contractor shall verify the location of existing improvements and shall take all precautions to protect them whether shown or not. The Contractor shall notify the following agencies at least 48 hours in advance of excavating around any of their structures. The utility companies listed below can be contacted as indicated. It shall be the responsibility of the Contractor to coordinate all phases of construction with the various utility companies involved.

Utility Requirements. The Agreement assumes all utility-owned electrical equipment serving the sites electrical distribution system has adequate capacity to handle the photovoltaic system output. No utility required electrical equipment upgrades or replacement is included, including design and coordination thereof. Any costs associated with unforeseen utility interconnection requirements, including but not limited to utility-owned equipment upgrades or additions, relay protection equipment external to the inverters, system impact studies, telemetry requirements and interconnection studies are not included in this proposal. It is assumed that the system will interconnect with the facility at customer's existing panels with ample current capacity to accept the PV system, with the exception of replacing the existing switchboards at two sites – Napa High School; and the Education Center. All new service change out applications, inspection fees, and PG&E coordination shall be completed by the District. In addition, Design-Builder is not responsible for the delay of application approvals or inspections from/by PG&E related to the service upgrades. The existing panels are assumed to have provisions to accept cable connections on the primary side of the main service breaker. Utility Requirements. All Services and Work shall be done in accordance with this Agreement, all Legal Requirements and all warranty requirements.
