Utility Work. Any work performed by or on behalf of Lessee or any occupant of the Premises to connect to, repair, relocate, maintain or install any storm drain, sanitary sewer, water line, gas line, telephone conduit, or any other utility service shall be performed in a manner that minimizes material interference with the provision of such services to the Premises and other persons.
Utility Work. District expressly understands and agrees that Excusable Events may occur due to Interconnection Facilities work that may need to be performed by the local electric utility (“Utility”) in order for ENGIE Services U.S. to fully implement the Project. “Interconnection Facilities” means any distribution or transmission lines and other facilities that may be required to connect equipment supplied under this Contract to an electrical distribution/transmission system owned and maintained by the Utility. Utility Work. The Utility Work must be covered by the Performance and Payment Bonds. At the request of a Utility Owner having Utility Work performed by Design-Builder, Design-Builder shall add the Utility Owner as an additional obligee to the Performance and Payment Bonds (as their interests may appear), as well as to such replacement bond or other security (as their interests may appear), to the limited extent of the amount of the Utility Work required on behalf of the Utility Owner. Design- Builder shall provide a Performance and Payment Bond in their full amount on behalf of VPRA, with no riders that reduce VPRA’s potential of recovery based on the Utility Owner’s limited obligee amounts. Alternatively, Design-Builder may provide separate bonds satisfactory to the Utility Owners. Design-Builder shall provide all information necessary for such coverage to the surety(ies) providing such bonds. Design-Builder shall include the cost of bond premiums in all cost estimates Design-Builder is required to provide under the Contract Documents for Utility Work performed by Design-Builder.
Utility Work. The Phase Developer is responsible for identifying Utility Work that will need to be performed to deliver the Phase, including design, construction and coordination. Specific requirements for Utility Work are in Exhibit 6 Article 7 (Utility Coordination). MDOT will strive to enter into agreements with certain Utility Owners for the P3 Program or the Phase as applicable (the “Utility Framework Agreements”) prior to the Effective Date of the Phase P3 Agreement. The Utility Framework Agreements set out a general approach to Utility Relocations. It is expected that additional agreements will need to be entered into with some or all of the Utility Owner setting out details of the relevant utility relocation work (each a "Utility Agreement") either to supplement the Utility Framework Agreement with additional detail or because no Utility Framework Agreements is entered into. The Phase Developer shall, assist MDOT in completing the negotiations to allow MDOT to execute a Utility Agreement with a majority of the affected Utility Owners prior to the Phase Developer establishing the Design- Build Price. At a minimum, the Phase Developer shall work with MDOT to complete Utility Agreements with WSSC, PEPCO, Washington Gas, Verizon, Century Link, Fiberlight, Crown Castle, AT&T, Zayo and City of Rockville DPW.
Utility Work. ConFire expressly understands and agrees that an Excusable Event may occur due to Interconnection Facilities work that may need to be performed by the local electric utility (“Utility”) in order for OpTerra Energy Services to fully implement the Project. Any Interconnection Facilities work that may be required will be performed by the Utility under a separate contract between Customer and the Utility.
Utility Work. Maintenance Technicians and Mechanics assigned to perform utilities work shall receive a five percent (5%) premium over base wages for all such hours worked. Utility work premium pay and out of classification pay may not be received at the same time.
