Working Out of Grade. 18.01 When an employee in the clerical bargaining unit is assigned temporarily to a position with a higher rate of pay, the employee shall be entitled to receive the hourly rate for the position, hour for hour.
Working Out of Grade. When an employee is assigned by the appropriate supervisor to perform work in any higher classification in the Town Classification Plan, he should be paid the higher classification wage for the time he performs such duties, or for one hour, whichever is greater.
Working Out of Grade. An employee who is instructed by the Director to perform work that is not included in his job description and is normally performed by an employee in a higher grade shall be paid at the high grade rate for all hours worked in said higher grade, provided that the assignment shall be made based upon seniority and the employees having the job qualifications for the position and provided further no out of grade payment shall be made unless the out of grade work has been approved by the Mayor. Notwithstanding the provisions above, no member of the bargaining unit shall be required to perform custodial duties (e.g., shoveling snow, cleaning bathrooms, etc.). However, bargaining unit employees may be called upon to clean incidental spills, pick items up off the floor, empty their waste baskets, and other incidental duties. Employees will not be required to address sanitary issues and/or issues involving bodily fluids.
Working Out of Grade. Section 24.1. Any bargaining unit employee who is assigned by the Employer to work at the next highest grade shall receive the next highest Step 1 base hourly rate for all hours starting with the second consecutive hour worked.
Section 24.2. In no instance shall any employee who works at the next highest grade be paid a daily rate less than the employee's regular hourly rate.
Section 24.3. When a firefighter works overtime at the next highest grade, the employee will receive overtime compensation at the rate of a Step 1 Lieutenant, starting with the first hour that is worked.
Section 24.4. When a Lieutenant works overtime at the next highest grade, the employee will receive overtime compensation at the rate of an entry level Battalion Chief, starting with the first hour that is worked.
Working Out of Grade. An employee, subsequent to the funding of this agreement, who is instructed to work in a grade higher than his current grade shall be paid for the time working in said higher grade at the step level in said grade that is fifty (50) cents more than his normal pay grade and if none then the step in said higher grade that is more than, but closest to, said fifty (50) cent differential. In the event of a promotion, the employee will be placed at the step level in said grade that is fifty cents more than his/her normal pay grade and, if none, then the step in said higher grade that is more than, but closest to, said fifty cent differential.
Working Out of Grade. In the event of a shift vacancy for Captain and a Captain cannot be hired, the Chief will be notified and the following procedure shall apply in the following order. A private on their scheduled shift who have at least one (1) year of service with the Belchertown Fire Department and five (5) years of fulltime fire department experience and is a cleared firefighter with medical control will be offered the first opportunity to work out of grade as a Captain. If more than one member assigned to the same shift meets these criteria, the private with higher seniority will be offered the first opportunity to work out of grade. Privates working overtime, working a shift swap, or in any other capacity on the shift will be offered the next opportunity to work out of grade. If no private currently working on shift is eligible for working out of grade, the shift will be offered to off duty privates who meet the eligibility criteria. If an eligible private is not able to be hired, the off going Captain will be held mandatorily. The assignment of working out of grade shall be compensated at the pay grade of Captain, matching the current step of the private filling the position, for the hours worked in this capacity only. If a member is working out of grade on overtime they shall be compensated at the working out of grade overtime rate.
Working Out of Grade. Members of the Fire Department through rank of Deputy Chief, who are ordered to serve temporarily in a higher rank for a period of one (1) or more working days, will be compensated at the rate established for the next higher rank than their present rank. Only periods comprising a normal one (1) day or night tour of duty shall be so compensated.
Working Out of Grade. If the Senior Tradesman is out of work for any reason the most senior member of the union will fill in, provided this individual is willing to do so. If the most senior member of the union is not willing to fill in, the next most senior member of the union shall fill in for the Senior Tradesman. The individual who fills in shall receive the daily stipend for fulfilling the responsibilities of the Senior Tradesman. It is understood that the regular Senior Tradesman shall continue to receive his regular stipend while out of work.
Working Out of Grade. When an officer is formally assigned to work in a higher position by the Chief, he will receive the wage assigned to the title for the duration of the assignment.
Working Out of Grade. 14.1 An employee who is directed by the Chief, or an employee acting on behalf of the Chief, to perform the duties and assume the responsibilities and the authority of a higher grade than that which the employee normally holds for a minimum of three (3) hours shall be paid additional compensation at the rate then in effect for the higher position salary grade, and at the same step as the employee's regular grade. It is understood that any employee that begins the shift as an acting officer, will remain the acting officer until either the shift is over or until relieved by an officer.
14.2 Any firefighter who is asked to perform in the supervisory role on a scene as an “Acting Officer” of an engine company on a call by call basis (i.e. responding on a fire call as the senior firefighter while all officers and acting officers on-duty are tied up on other calls) shall be compensated for a minimum of one (1) hour (or additional hours if the emergency lasts longer) pay in the same manner as if they were acting officer.
14.3 If an officer’s (i.e. Captain or Assistant Chief) position is created due to a promotion, retirement, resignation, or any other means, or an existing officer will be absent from work due to any reason including, but not limited to, sickness, injury, or leave of absence, for any period greater than six (6) weeks, the Chief shall appoint an Acting Captain/Assistant Chief of that rank to fill the vacancy being created or known. In the case of a temporary absence, if a current promotional list exists for the position in question, the appointment shall be made from the top three candidates on that list. If no current promotional list exists, then the appointment shall be the senior most member from the next lowest rank. If a promotional list is established during the period that an Acting Captain/Chief position is being filled by a member who was selected by seniority, that member shall be replaced by one of the top three candidates on the promotional list. If a list expires and there is still an officer’s opening in accordance with 14.3 the Acting Captain/Chief who came from the expired list will be replaced thorough seniority. In all cases, any member has the right to refuse such appointment without penalty, in which case the next eligible member who meets the above requirements shall be offered the position.
