Acting Positions. The College will attempt to give existing employees the opportunity to assume acting positions of increased responsibility and duties. When a person is appointed in writing by the Vice-President or Director to an acting position for a period of one (1) or more consecutive working days s/he will be paid at the incumbent’s rate of pay or the current Pay Equity Target Rate, if the incumbent is exception-rated. If an employee occupies the same position on an acting appointment, excluding replacement for an employee on an authorized leave, for twelve (12) consecutive months, the College shall post the position or discontinue it.
Acting Positions. Bargaining Unit positions involving a promotion shall not be held in an acting capacity for more than three (3) months without a competition being held unless: (a) The expected return of the previous incumbent is within six (6) months; or (b) The previous incumbent is on training or secondment with a duration not to exceed one (1) year; or (c) In cases of maternity/parental leave; or (d) The position will not be filled permanently as a result of a planned wind- down; or (e) The Company and SPEA agree in a specific case to extend the term of an acting position for reasons not stated above.
Acting Positions. A. The decision on whether to fill a vacant Lieutenant position shall be made by the Department. Open permanent vacancies for Lieutenant positions, budgeted or not, within the established work jurisdiction of the Association, shall be filled by an Association member of commensurate rank generally within sixty (60) days of the position opening or the establishment of the position. During the pendency of the promotion process, or when the current promotion list does not have any eligible candidates, an Acting Lieutenant may be appointed until a promotion can be made. B. In the event the Department determines that a special project needs to be temporarily filled, the Department will notify the Association in writing of the specific qualifications needed, a summary of the project specifics and a projected time period for the assignment. Association members will be given notice of a temporary position for special projects and offered the opportunity submit an interest in filling the position. The Department will consider these expressions of interest prior to filling the position, and will make the decision based upon the operational needs of the Department. It is understood that in some cases, such as where a Sergeant has specific qualifications that interested Lieutenants do not have, or where the Department determines that based on reasonable operating needs an interested Lieutenant(s) should not be reassigned, an Acting Lieutenant may be used. If an Acting Lieutenant is utilized, the status of the position will be reviewed by the City and Association after 180 days. When the Department determines that a Sergeant has specific qualifications not matched by any interested Lieutenant, the Association will be notified. Acting Positions. In the event that it becomes necessary to assign an employee duties of a higher skill or responsibility level other than in his/her normal classification, such an “acting capacity” assignment must exceed one workweek in order to have an adjustment in the employee’s rate of pay. When an “acting capacity” assignment is made by a supervisor, the assignment shall be approved in writing by the appropriate administrator who is authorized to make the salary change. The employee’s records shall reflect placement in the higher classification in an “acting capacity.” Such “acting capacity” adjustments will be retroactive to the date of assignment.
Acting Positions. Employees who occupy acting positions on the date of conversion will have their rate of pay recalculated as follows: - Where the substantive position and the acting position are converted to a different job level in the new classification structure, employee salaries are converted on the basis of the substantive position and a new salary rate for the substantive position is determined. Using this new salary rate, the acting salary will be determined by applying the rules for calculating pay upon promotion. Should this converted acting salary be less than the previous acting salary, the employee will maintain the former higher acting salary for the duration of the acting assignment.

Such an assignment must be made in writing by an appropriate administrator authorized to make a salary change. Emergency temporary assignments do not need to be posted. Should the position develop into one of a permanent nature or the emergency temporary assignment exceeds six (6) months, the job must be posted and a selection made in accordance with promotional procedures.

Such an “acting capacity” assignment made by a supervisor or senior operations supervisor, shall be approved by the appropriate administrator, and submitted in writing at least three (3) days in advance of the start of the assignment to the Division of Human Resources which is authorized to make the salary adjustment. Any “acting capacity” assignment beyond thirty (30) consecutive workdays must be approved by the Division of Human Resources.
