Provide Clinical Facility with copies of the course outline and course objectives, evaluation criteria as requested and a tentative list of course instructors and their qualifications before the beginning of each clinical rotation. 4. Maintain full responsibility and control for planning and execution of the Nursing Program, including curriculum, evaluation of students, administration, instructor appointments, and other matters which are normally reserved as University functions, such as granting degrees and advising students. 5. Make representatives of University available to Clinical Facility for assistance and consultation as the need arises and when possible. 6. Appoint, in writing, one or more representatives of University to communicate with the Clinical Facility representative(s) during the course of planning for student placement at Clinical Facility. 7. Provide Clinical Facility instructors and/or preceptors during times that students are at Clinical Facility. University will provide proof of licensure in Texas as registered nurses for all University faculty. 8. Advise students of their responsibilities regarding participation in the Clinical Placement, including the responsibility to exhibit professional conduct and to follow all rules and standards set by Clinical Facility and University. 9. Ensure students attend Clinical Placement orientation, if required by Clinical Facility. 10. Provide Clinical Facility with written Clinical Program objectives for each level of student assigned to Clinical Facility. 11. Prepare Clinical Program rotation schedules and ensure that Clinical Facility receives the student schedule before their assignment. 12. Provide to Clinical Facility, when requested, the following information regarding students: a. proof of student blanket professional liability insurance coverage for or on behalf of student; b. proof of each student’s current immunizations as required; and c. proof of current basic life support (b/s) for health care providers. 13. RESPONSIBILITIES OF UNIVERSITY. University will: a. furnish Facility with the names of the students assigned by University to participate in the Program; b. assign only those students who have satisfactorily completed those portions of University curriculum that are prerequisite to Program participation; and c. designate a member of the University faculty (“University Representative”) to coordinate the educational experience of students participating in the Program with the Facility Liaison. University shall give Facility written notice of the name of the University Representative.

UNIVERSITY shall identify in writing the educational goals and objectives to be attained during each RESIDENT’s clinical experience at CLINICAL SITE and shall attach same hereto as Attachment A. 2. While engaged in activities described in this Agreement, each RESIDENT shall function in the capacity of an employee or agent of The University of Florida Board of Trustees (UFBOT) and shall be subject to the personal immunity to tort claims as described in Section 768.28, Florida Statutes. Accordingly, UFBOT acting as UNIVERSITY shall, in accordance with applicable Florida laws and regulations, provide professional liability protection for claims and actions arising from the clinical activities of each RESIDENT. To the extent that the State of Florida, on behalf of the Board of Governors and UFBOT, has partially waived its immunity to tort claims and is vicariously responsible for the negligent acts and omissions of its employees and agents as prescribed by Section 768.28, Florida Statutes, UFBOT is protected for a claim or judgment by any one person in a sum not exceeding Two Hundred Thousand Dollars ($200,000.00) and for total claims or judgments arising out of the same incident or occurrence in a total amount not exceeding Three Hundred Thousand Dollars ($300,000.00), such protection being provided by the University of Florida ▇. ▇▇▇▇▇▇ ▇▇▇▇▇▇ Health Center Self-Insurance Program, a self-insurance program created pursuant to the authority of Section 1004.24, Florida Statutes. University will plan and determine the adequacy of the educational experience of the students in theoretical background, basic skill, professional ethics, attitude and behavior and shall assign to Host Agency only those students who have satisfactorily completed the prerequisite didactic portions of University’s curriculum. 2. University will retain ultimate responsibility for the education and evaluation of its students. University’s representative for this Agreement shall be a faculty member appointed and assigned by University, who will be responsible for student teaching and evaluation provided pursuant to this Agreement. 3. University will advise all students assigned to Host Agency facilities regarding the confidentiality of patient/client records and patient/client information imparted during the practice experience. University will also advise all students that the confidentiality requirements survive the termination or expiration of this Agreement. 4. University will require all participating students to maintain health insurance and provide proof of health insurance to University. Host Agency may request the student provide proof of health insurance prior to beginning of the practice experience. 5. University will require all participating students to have completed an appropriate criminal background check, and to have documented appropriate immunizations on file with University. If applicable, Host Agency shall notify the student of any requests for evidence of criminal background test or immunization. University will inform the student of his/her responsibility to provide evidence to Host Agency of any required criminal background checks or immunizations, when requested. Host Agency shall notify University of its requirements of an acceptable criminal background check and required immunizations. University will also inform students that they may be required to undergo a drug test or other similar screening tests pursuant to Host Agency’s policies and practices, and that the cost of any such test will be paid by the student, if not Host Agency. 6. University will advise students that they are required to comply with Host Agency rules, regulations, and procedures. 7. If requested by Host Agency, University will provide instruction to Host Agency's staff with respect to University’s expectations regarding evaluation of University's students at Host Agency. 8. RESPONSIBILITIES OF UNIVERSITY. University shall: (1) Appoint a Program Liaison and timely inform Facility of the name, address, email address and phone number of said Program Liaison who will be available to assist Students and Facility personnel. The Program Liaison will be responsible for maintaining ongoing contact with Facility’s designated representative. (2) Provide the educational direction of the Program as well as the placement and basic preparation of Students through classroom instruction and identification of educational and clinical objectives. University shall further direct the Program in accordance with all guidelines established by local, state or national associations, as well as develop, organize, and assist Facility in implementing and operating a Program that is suitable to each Student, including Students with disabilities. (3) Obtain from Facility the name, address, email address and phone number of Facility’s designated representative and acquaint Facility’s designated representative with methods, objectives, goals, and specifics of the Program as outlined in the Program Addendum. (4) Ensure that each Student assigned to Facility pursuant to this Agreement is enrolled in the Program with the University. (5) Recruit, screen, evaluate, select and assign to Facility only Students who have fulfilled all prerequisites for training or clinical educational experience and provide Facility with information requested by Facility about the Student, to the extent not prohibited by the Family Educational Rights and Privacy Act (FERPA), U.S.C. § 1232g; 34 CFR Part 99, or other applicable state or federal law. Facility is not authorized to redisclose any FERPA or other protected information. (6) If required by Facility, University shall notify students of Facility’s requirements to obtain the necessary criminal background check prior to assignment, but University shall not be required to conduct drug testing or criminal background checks for students. The University shall refer students to either Facility’s approved vendor(s) or to a third party vendor at Student’s sole cost and expense for the purposes of performing drug testing, health care and criminal background checks.
