ARTICLE STATUTORY HOLIDAYS. All employees in the bargaining unit, provided they meet the terms and conditions set out in and shall be entitled to the following statutory holidays: New Year's Day Labour Day Civic Holiday Family Day Thanksgiving Day in August Good Friday Remembrance Day Victoria Day Christmas Day Canada Day Boxing Day and any other day proclaimedas a holiday by the Foundation. All employees in the bargaining unit, shall receive the recognized statutory holidays for which they are eligible with pay, or other days with pay in lieu of such statutory holidays, providing they are available for work in accordance with their regular hours of work preceding, during and following the designated day for observance of the holiday or on approved leave for a period of ten working days or less duration. Where the Foundation designates a day off in lieu of the actual statutory holiday for the majority of its employees, the employees may be allowed off on such day. In the event that this is not possible, the employee may be allowed a day off in lieu of the statutory holiday at a time mutually agreed between the employee and her Supervisor. If such a day cannot be provided, the employee shall receive a regular day's pay at her regular rate of pay in lieu of the statutory holiday. Part-time employees will be paid on a basis for statutory holidays. Part-time employees will be paid on a basis for statutory holidays. To be eligible for a statutory holiday an employee must have worked for the Foundation one (1) full calendar month immediately prior to the holiday. Part-time, temporary and relief employees required to work on a Named Holiday shall be paid at time and one half (1 their regular rate for all hours worked on the Named Holiday.

( See Letter of Understanding on page 34) To be eligible for a holiday with pay an employee must have: Completed thirty (30) days of service with the company prior to the date of the holiday; and, Completed their regular work day as scheduled immediately preceding the holiday (or concurrent holidays) and immediately following the holiday, unless prevented from doing so due to an approved leave of absencewhich commences within twenty-eight (28) days of the holiday, non-compensable injury or illness provided such compensable injury or illness is substantiated to the satisfaction of the Company and has commenced within fourteen (14) days of the holiday; and, Not been on lay-off more than fourteen (14) days prior to the holiday. An employee who works on any of the holidays listed in this Article shall be paid for such work in accordance with and if otherwise eligible, shall also be paid for the holidays as provided in hereof. An employee's actual pay for a holiday not worked will be current hourly rate multiplied by eight (8) hours. .OS In the event that a contractual holiday falls on either a Saturday or a Sunday, the Company may elect to celebrate it on a Friday or Monday instead, in which case the day so celebrated will be deemed to be the contractual holiday. Should a holiday fall within an eligible employee's time off for vacation, such holiday will be paid for without the Commensurate day off unless, in the judgement of the Company that day off can be arranged at some other time.

ARTICLE STATUTORY HOLIDAYS. The following days for observing a public holiday shall be recognized as paid holidays and salaried members shall suffer no deduction from pay while hourly rated members shall receive a regular day‘s pay by virtue of not working on such days. Notwithstanding the above, Remembrance Day shall be recognized as a normal public holiday for all members regularly working on a seven (7) day operation. Where Clause refers to a "Regular Day's Pay", for hour classifications this represents an eight (8) hour day, and for hour classifications a seven (7) hour day, notwithstanding any compressed work schedule which may be in effect.

ARTICLE STATUTORY HOLIDAYS. The following paid Holidays will be recognized by the Board: New Year’s Day Thanksgiving Day Good Friday Christmas Day Easter Monday Boxing Day Victoria Day Canada Day Civic Holiday Floaters Labour Day and any other day proclaimed as a holiday by the Municipal, Provincial or Federal Government, and the last four (4) hours on the last scheduled day or shift prior to New Year’s Day and the last four (4) hours on the last scheduled day or shift prior to Christmas Day In order to qualify for payment of these holidays, an employee must work his regular shift immediately prior to and immediately following the holiday. In the case of an employee who works on one of the agreed paid holidays at the specific request of the Board, such employee shall be paid at the rate of one and one-half (1 times his regular rate for the period so worked; plus, the employee will be given a paid day off at a later date.
ARTICLE STATUTORY HOLIDAYS. The following twelve statutory holidays are considered paid holidays for those employees who have completed more than thirty continuous calendar days in the employ of the Company: New Year's Day Thanksgiving Day Good Friday Day before Christmas Day Victoria Day Christmas Day Boxing Day Labour Day Day before New Year's Day Armistice Day Floater Day If any of the above holidays falls on a Saturday or a Sunday, they will be recognized and paid for either on the Friday or Monday, after consultation with the Union and two (2) weeks' notice. An employee shall make a written request to the Company at least three weeks in advance of the day to be taken as his or her Floater holiday and shall be subject to the agreement of the Company. The amount paid to the employee, including employees regularly scheduled on twelve (12) hour shifts, will be equivalent to a full work period of eight (8) hours at his normal hourly rate, provided he works his last scheduled shift prior to and his next scheduled shift after such holiday. In order to qualify for payment of a holiday, the employee must have performed work for the Company within the two (2) calendar weeks prior to or within the two calendar weeks following the holiday, save that employees on sick leave or on compensation will receive payment for any holidays if they return to work within nine (9) months of the holidays. It is understood that an employee required to work during any of the above holidays will, in addition to his holiday pay, be paid at time and one-half his hourly rate. An employee required to work during the day before Christmas, Christmas, and Boxing Day, will in addition to his holiday pay, be paid at double his hourly rate; and if required to work on any of the remaining holidays will, in addition to his holiday pay, be paid at time and one-half his hourly rate. An employee called out for emergency work shall be entitled to be paid for four hours at his applicable hourly rate, regardless of time worked, or to the pay to which he is otherwise entitled under the overtime provisions of Article in respect of the time worked on such call out, whichever is the greater.
ARTICLE STATUTORY HOLIDAYS. In lieu of twelve (12) statutory holidays, each Member who regularly works three (3) shifts in a seven (7) day operation, will receive an additional twelve (12) days' pay per year at the rate of time and one-quarter (1 or equivalent time off at the option of the Member, subject to the needs of the Service. The option as to choice of pay or time off must be made by December each ear for the following year. All time off must be declared in writing, before October of that year and utilized before December of that year. Members working a hour schedule will receive, in lieu of twelve (12) statutory holidays, one hundred and twenty (120) hours pay or time off each year at the option of the Member. The option as to choice of pay or time off must be made by December each year for the following year. All such days to be scheduled as time off must be declared, in writing, before October of the selected year, and utilized before December of that year. If a Member requests time off, the choice of the day will be at the sole discretion of the Member, subject to the needs of the Service. The Statutory Holidays are: New Year's Day Thanksgiving Day Good Friday Remembrance Day Easter Monday Half day Christmas Eve Victoria Day Christmas Day Dominion Day Boxing Day Civic Holiday Labour Day Half day New Years Eve and any other holiday declared or proclaimed by law as a national or provincial (Ontario) holiday. Statutory holiday pay in lieu will be paid on or before November of each year. When a statutory holiday falls on a day shift workers' regular day off the Member will receive an additional day off. Day shift workers will be allowed to use Remembrance Day and Easter Monday as well as two (2) additional days on days other than they fall upon with the agreement of their supervisor. All Members not covered by or will receive the twelve (12) statutory holidays as time off, and will be granted one additional day to be taken at the Member's option, subject to the needs of the Service, for a total of thirteen (13) Statutory days leave.
