Layoff and Bumping Sample Clauses

The "Layoff and Bumping" clause outlines the procedures and rights related to employee layoffs and the process by which affected employees may displace, or "bump," others with less seniority. Typically, this clause specifies the order in which employees are laid off, often prioritizing seniority, and details the conditions under which a laid-off employee can take the position of another employee with less tenure in a similar role. By establishing clear rules for layoffs and bumping, this clause helps ensure fairness and transparency in workforce reductions, minimizing disputes and protecting employee rights during organizational changes.
Layoff and Bumping. Layoffs shall be done in reverse order of seniority by classification; that is, the general principle shall prevail that an employee with the least seniority in the affected classification shall be laid off first and an employee with the most seniority in the affected classification laid off last. a. In the event of a layoff, probationary employees in the affected classification shall be laid off first. b. Employees with the least seniority shall be laid off next, providing that the remaining employees are qualified, able and willing to do the remaining work. c. If a seniority employee is given notice of layoff, he shall have the right to “bump” a less senior employee in another classification where he is qualified and able to work in that classification based on having previous work experience with the Employer in that other classification or, otherwise, if the employee is suitably qualified and has successfully completed training in the classification. With the exception of the classification of Team Leader, the right to bump includes bumping into a higher paid classification. d. There shall be a five (5) day work trial period with familiarization as required for an employee bumping into a position in accordance with c) above. e. When an employee exercises his right to bump into another classification, the employee shall then be paid at the rate of pay for that classification. Employees subject to a layoff have the right to accept the layoff.
