Part-Time Availability Clause Samples
Part-Time Availability. Part-time employees shall declare their availability three (3) times per year and shall be required to work according to their Declaration of Availability:
(1) The last Sunday in December
(2) The first Sunday in June
(3) The third Sunday in August These Declarations of Availability will be effective on the following posted schedules:
(1) The first Sunday in January
(2) The last Sunday in June
(3) The first Sunday in September In addition to the above, Employees may increase their availability between November 15th and the end of the year. The Employer may consider additional individual requests to change availability subject to business requirements as well as the current overall availability of the employees in the department. The Employer will make “Declaration of Availability” forms readily available to part-time employees. Employees who require a change in availability will submit, in person, a completed form to the Employer and the employee will be given a signed copy of the form at the time of submission. Provided the request is submitted Saturday by noon, the change will be reflected at the earliest, on the schedule posted the following Thursday. New employees shall be required to complete a “Declaration of Availability” form on or before their first day of work. An employee must not restrict themselves to the point that he or she is not available for normal scheduled shifts within the department.
Part-Time Availability. (a) Any Regular and Temporary Part-Time Nurses who wish to work shifts beyond his or her appointment status are required to notify the Employer in writing. This notification will include information such as the desired number of additional hours or shifts, interest in shifts on other patient care units in addition to a Nurse’s home unit and any restrictions to a Nurse’s availability.
(b) A calendar system will be used for each patient care unit for the purpose of scheduling additional shifts for both prior to and after posting of the schedule.
(c) Any Regular and Temporary Part-Time Nurses who have provided notification in accordance with Article 7.20 (a) shall indicate their specific available dates, available shifts, additional preferred units, and available time, via the calendar on their home unit.
(d) When a Regular or Temporary Part-Time Nurse has worked up to his or her desired extra shifts, he or she is responsible to remove his or her name from the calendar on their patient care unit.
(e) A Regular or Temporary Part-Time Nurse will not be entitled to overtime until they have worked in excess of seventy-five (75) hours in a bi-weekly pay period except as outlined in Article 7.16 (a). Not applicable to a Nurse Practitioner.
Part-Time Availability. Part-Time Nurses may indicate their availability to work shifts(s) in addition to those scheduled and shall be the first called in case of illness, emergency or other unforeseen circumstances which create additional shifts.
Part-Time Availability. The parties recognize the need to ensure that the part-time employees are available to meet the needs of the business. The Company may request or the employee may provide a new Declaration of Availability beyond the one provided at time of hire on an as needed basis, based on operational requirements but not more than four (4X) times per year.
Part-Time Availability.
(a) Part-Time Nurses may indicate to the Employer in writing availability and willingness to perform extra shifts for the Employer. These shifts shall be assigned to Part Time Nurses who have indicated their availability as equitably as possible on the basis of availability.
(b) When extra shifts become available after a shift schedule has been posted, the shifts shall be offered on the basis of seniority to Regular Part-Time Nurses who have not yet reached their indicated availability. A shift of up to four hours worked by a part time Nurse contiguous to another regular shift does not attract overtime in accordance with Article
Part-Time Availability. (a) Part-time seniority shall be determined by ▇▇▇▇▇▇. The scheduling of part-time hours and promotion to full-time from part-time will be dependent on the qualifications and ability of the part-time employee to perform the work. Part- time employees will be scheduled from a part-time availability sign-up list. With respect to scheduling part-time employees, the Employer will schedule by seniority and availability up to twenty-four (24) hours or three (3) shifts (whichever holds the greatest earning power) for each employee until the list is exhausted. The remaining hours will be scheduled by seniority to a maximum of eight (8) additional hours. This cycle will continue until all available hours are exhausted. Hours scheduled for the purpose of formal on-the-job training are excluded from the above provisions and will be subject to review pursuant to Article 6.
Part-Time Availability. All part-time employees shall submit their availability no later than the 15th of each calendar month, for the ensuing calendar month. All part-time scheduling shall be by seniority and posted no later than the 22nd of each calendar month.
Part-Time Availability. (a) For the purpose of providing coverage regular part-time nurses will declare availability for additional shifts on a twenty-four-hour basis, four (4) weeks prior to the posting of the rotation. For short term replacement purposes after the rotation has been posted part-time nurses may declare any additional availability. It is the responsibility of the part-time nurses to amend any changes to their availability.
(b) A casual nurse will declare availability on a four (4) week basis for work on specific shifts four (4) weeks prior to the posted rotation. It is the responsibility of the casual nurse to amend any changes to posted availability or non-availability for shifts.
Part-Time Availability. In order to facilitate the effective scheduling of open shifts and to increase availability to facilitate the approval of time off requests for permanent full-time staff, the following will apply:
(I) For the Prime Vacation Period, part-time employees shall provide the Employer with availability for the entire Prime Vacation Period by May 1st of each year;
(II) For the Christmas Vacation Period (December 15th to January 5th), part-time employees shall provide the Employer with availability for the entire Christmas Vacation Period by November 15th of each year.
Part-Time Availability. The following provisions shall apply to the availability of part-time employees:
1. Part-time employees will submit to the Co-operative and the Union an individual written declaration of availability for work on a form supplied by the Co-operative with a copy to the Union in the first week of September, annually. Newly hired employees will make an initial declaration at the date of hire.
2. The declaration shall provide that an employee must be available to work at least two (2) shifts per week (during the first year of employment, one of which will be Saturday). Any employee who has restricted his availability on Saturday in any way, may be required, irrespective of availability, to work no more than three (3) Saturdays out of four (4). Employees hired on or after November 10, 2005 may not restrict Saturday availability.
3. The above patterns may be further restricted during the period September 1st to December 31st with one (1) week’s notice prior to the posting of the schedule (but to no less than two (2) shifts/week) or altered in an equal number of shifts the first week of January of each year. Employees who are students and actively enrolled in a recognized educational facility shall submit a new declaration of availability the first week of January of each year.
4. Subject to the hours of work provisions of the Collective Agreement, employees must be available to be scheduled for work during unrestricted hours.
5. Failure to be available for scheduled hours (not including call-ins, sickness, leaves of absence or time off for vacations) shall cause the employee to be regarded as having voluntarily terminated provided that during each term of restriction (September 1st to August 31st) an employee can request an occasional unrestricted day off if approved by the Store Manager or his or her designate. Requested days off shall not be unreasonably withheld.
6. Restriction of availability shall not in any way interfere with an employee’s right to full-time employment under the terms of the Agreement.
7. Any full-time employee reduced to part-time would be entitled to restrict in accordance with these provisions. Any Courtesy Clerk employee promoted to regular part-time will be entitled to alter his restriction in accordance with these provisions.
