9.2 A complete seniority list of all employees covered by this Agreement will be posted at each work location and shall be open for inspection of all employees. A copy of this list shall be updated semi-annually as at 30 June and 31 December in each year and that the amended seniority list for each seniority unit will be delivered to the General Chairman and/or Designate within 15 days. A seniority date not protested in writing to the Director- Operations with a copy to the General Chairman within 60 days from its first posting on the list, will be considered permanently established, except that an employee who is laid- off or on leave of absence at the first time the seniority list is posted will have 60 days from date of return in service. Typographical errors on subsequent rosters may be corrected at any time.
9.3 A new employee shall not be regarded as Permanently employed until he has accumulated one hundred and twenty-five (125) working days’ service under this Agreement in the preceding twelve (12) months, and, if retained shall be accorded seniority as helper from the date first employed in a position covered by this Agreement.
9.4 Employees who have not accumulated one hundred and twenty-five (125) working days’ service will be laid off in reverse order of their employment and recalled to service in the order of their original employment when their services have been satisfactory. (c) For the purposes of Vacation Entitlement, Service Pay and Promotion, service will be the total of all service with this Police Service and with other Police Services as governed by the Police Services Act or Equivalent, as a Police Officer. Where service with two or more Services is broken by more than twenty-four (24) consecutive months, only the service with the Peterborough Community Police Service shall be taken into account. For the purposes of placement on Holiday Signing Lists, only service with the Peterborough Community Police Service will be used.

Promotion and Seniority. 15.01 Seniority, as referred to in this Agreement, shall mean, unless otherwise specified, length of continuous service in the employ of the Fire Department.
15.02 A Fire Fighter will be considered on probation for the first year and will have no seniority rights during that period. After one (1) year's service, the Fire Fighter’s seniority shall date back to the day on which employment began.
15.03 Seniority lists will be updated each twelve (12) months; a copy of the list will be posted in each station and a copy given to the Association.
15.04 All permanent vacancies in new classifications and in existing classifications shall be posted in the Fire Department for a period of one (1) week. Vacancies shall be filled in accordance with the Fire Department's Promotional Policy. In the filling of the vacancies, the Corporation shall not be limited to selecting Fire Fighters who have made application, but the Corporation shall be subject to the same limitations as set forth in Article XV, Clause 15.05 relating to cases of promotion. Nothing herein shall prevent the Corporation from hiring persons from outside the bargaining unit when no qualified Fire Fighter applies.
15.05 a) In all cases of promotion within the suppression and prevention divisions, such promotions will be made in accordance with the Thunder Bay Fire Department Promotional Policy, attached hereto as Appendix “A” and forming part of this collective agreement. It is understood that, generally, the “Examinations” referred to within the Promotional Policy will examine an applicant’s skill, competence, efficiency, training, experience, and general work record within the Fire Department.

If the vacancy or job cannot be filled by an employee in the section, the position will then be posted as an "Open Competition", a copy of which will also be sent to the Union. The Union will be notified of the successful applicant's name when the position is filled. Wherever there are changes or amendments to qualifications or major job tasks as outlined on existing position descriptions, the Union will be notified of the change. The Union shall have ten (10) working days in which to submit to the Division Manager, in writing, any comments to the proposed changes.
17.02 When filling posted vacancies or making promotions, selections will be based on a balanced assessment (which may include but is not limited to testing, reference checks, interviews, and physical/functional ability evaluations) encompassing an employee’s skill, competency, efficiency, reliability, attendance, experience, knowledge and education. Where these factors are relatively equal, seniority will govern. Candidates who are new to the bargaining unit will bear all costs associated with physical/functional ability evaluations.
17.03 Seniority shall accumulate in the following circumstances only:
(a) when off the payroll due to layoff, sickness or accident in which case seniority will continue to accumulate for a period of time equal to six (6) months or the length of the employee's seniority whichever is shorter;
(b) when off the payroll due to personal leave of absence, then seniority will continue to accumulate for the first calendar month of such leave;
(c) when absent on vacation or a Statutory Holiday or on Workplace Safety and Insurance (WSIB);
(d) when actually at work for the Corporation in the IBEW Traffic Control and Street Lighting Bargaining Unit.
17.04 Seniority shall terminate and an employee shall cease to be employed by the Corporation when he:
(a) voluntarily quits his employment with the Corporation;
(b) is discharged or terminated and is not reinstated through the grievance procedure or arbitration;
(c) is off the payroll for a continuous period of twelve (12) months due to layoff;
(d) fails to report for work within five (5)...

Internal bulletins shall become invalid if not filled within thirty (30) days of their respective closing dates. A copy of the bulletin will be sent to the Union at the time of posting, the position will then be posted as an “Open Competition”, a copy of which will also be sent to the Union. Employees who are members of Local Union 339, IBEW (Craft Unit) will be given preference on Office Unit positions over applicants from outside either bargaining unit, provided the applicant Craft Unit member meets all the competitive criteria as outlined in Clause
15.02 of the Office Agreement. The Union will be notified of the successful applicant’s name when the position is filled. In the event the Corporation is unable to place the successful applicant in a vacancy within ninety-one (91) calendar days of being awarded a position, the employee will be paid the hourly rate of the new position, or the rate of the job they are currently performing, whichever is greater, until they are placed in the vacancy. This clause does not remove the Corporation’s ability to cancel the job posting prior to the employee actively working in the new position. Wherever there are changes or amendments to qualifications or major job tasks as outlined on existing position descriptions, the Union will be notified of the change.
