Retraining and Study Leave. 7.11.1 The Board of Trustees may grant an unpaid retraining or study leave to any member of the bargaining unit for a period not to exceed one (1) year for the purposes of participating in an identified course of study and/or retraining program which has a direct relationship to either the employee's current or prospective District position. The employee shall apply in accord with District established procedures and shall enumerate the plan of study or retraining program 7.11.2 Such leave of absence may be taken in separate six (6) months segments or in any other appropriate segment, rather than for a continuous period, provided separate segments of leave shall be commenced and completed in a three (3) year period. Any period of service between periods of leave shall comprise a part of the service required for a subsequent leave of absence for study or retraining. 7.11.3 Such leave of absence shall not be granted to an individual who has not served at least three (3) years of satisfactory service preceding the granting of the leave or since the prior leave and no more than one such leave shall be granted in any three (3)-year period. 7.11.4 An employee granted such leave shall not earn vacation pay, sick leave, holiday or other benefits provided under this agreement but the employee may participate in the health benefit programs of the District, provided that the employee provides reimbursement of any District expense in accordance with procedures as established by the District.
Retraining and Study Leave. 14.1.1 A leave of absence, not to exceed twelve (12) months, for retraining and study may be granted to any bargaining unit member within a three (3) year period. 14.1.2 Leaves will be taken in any appropriate periods not to exceed six (6) months in a continuous one (1) year period. 14.1.3 Eligibility for leave under this Section requires a bargaining unit member to have been employed for at least three (3) consecutive years. 14.1.4 The District shall establish procedures for enactment of this Section.

Retraining and Study Leave. The District may grant a leave of absence to a bargaining unit member for study or retraining, at its sole discretion. Study or retraining leaves of absence may be taken in separate six (6) month periods or in any other periods designated by the District for a maximum cumulative leave of one (1) year, provided that the total leave of one (1) year shall be commenced and completed within a three (3) year period. To be eligible for a study or retraining leave, the bargaining unit member must have seven (7) consecutive years of fulltime paid service in the District. To be eligible for a study or retraining leave, the bargaining unit member must agree to render at least two years of service in the employment of the District after returning from the leave. A bargaining unit member who has received a study or retraining leave shall not be considered to be eligible for further leaves under this Section. To apply for a study or retraining leave, the bargaining unit member must submit a total study or retraining plan including name of education or training institutions, proof of acceptance into the program, a detailed description of the program, a detailed description of the skills, knowledge and abilities the bargaining unit member will gain during the leave, a statement of the direct use of the skills, knowledge, and abilities in future service to the District, a suggested leave time-line and the number of hours of required attendance in the program. The application must be submitted to the Superintendent or designee not later than three (3) months prior to the proposed beginning date of the leave. Bargaining unit members granted a study or retraining leave shall be required to perform such services during the leave as the District and the bargaining unit member agree to in writing. A bargaining unit member on a District-approved study or retraining leave shall receive the difference between the salary of the bargaining unit member on leave and the salary of a substitute in the position previously held by the member on leave. If a substitute is not utilized, the bargaining unit member on leave shall receive one- half of the bargaining unit member’s regular rate of pay. Any compensation granted by the District to a bargaining unit member on leave shall be paid in two equal, annual installments during the first two years of service rendered in the employment of the District following completion of the leave. At least two (2) weeks prior to returning to the District, the unit member on leave shall verify to the Director of Human Resources of their intent to return or not return to the District at the end of the approved leave. Failure to provide notice of intent to return to employment shall result in their automatic resignation. Unit members who are on an approved leave for greater than six (6) months shall not be guaranteed reinstatement by the District but will be placed on the District’s thirty-nine (39) month rehire list. Priority to reinstatement shall only occur after laid off unit members’ rehire rights and other unit members who have reemployment rights.

With the approval of the division head and the Human Resources Division, a permanent classified employee who is a member of Unit 2 may be granted a paid leave of absence not to exceed one (1) year for the purpose of study or retraining provided that: 1. The employee has rendered paid service to the District for not less than seventy-five percent (75%) of the regular assigned time in each of the seven (7) consecutive years prior to the granting of Study Leave. For purposes of this Article, Study Leave is defined as leave granted employees for the purposes of maintaining and improving skills used in service of the District, as defined in Paragraph A.2. below. 2. The employee has rendered paid service to the District for not less than seventy-five percent (75%) of the regular assigned time in each of the three (3) consecutive years prior to the granting for Retraining Leave. For purposes of this Article, Retraining Leave is defined as leave granted employees for the purpose of acquiring new skills required as a result of changes in the District's organization and methods. 3. The employee's program for study or training while on leave is job related (i.e., related to the duties described in the class description for the employee's classification). B. If a request for Study or Retraining Leave is denied by the college president or division head or the designee, or by the Human Resources Division, an employee may request in writing a review by the Classified Employee Study and Retraining Committee. Such request must be made within five (5) working days of receipt of the denial. Such request must be in writing and submitted to the Associate Vice Chancellor of Employer-Employee Relations. The Classified Employee Study and Retraining Committee shall consist of the Associate Vice Chancellor of Employer-Employee Relations or the designee, a ▇▇▇▇ or the designee selected by the Senior Associate Vice Chancellor, Human Resources (Chancellor or his/her designee), and one (1) classified employee who is a member of the unit selected by the Union. Retraining and Study Leave. 12.1.1 The District may grant a classified employee a leave of absence not to exceed one year for the purpose of permitting study by the employee or for the purpose of retraining the employee provided such leave is useful in meeting changing conditions within the District. The decision to grant such leaves and compensation granted during such leaves shall be in compliance with the California Education Codes. 12.1.2 Such leave of absence may be taken in separate six (6) month periods or in any other appropriate periods rather than for a continuous one (1) year period provided the separate periods of leave of absence shall be commenced and completed within a three (3) year period.
