The "Accident and Sickness" clause defines the rights and obligations of parties in the event that an individual covered by the agreement becomes unable to perform their duties due to injury or illness. It may also specify whether compensation or benefits continue during the period of incapacity. Accident and Sickness. During an absence due to accident or sickness, an employee shall maintain and accumulate seniority for a period not to exceed twenty-four (24) months. Upon return from such absence, employees shall be returned to the classification held at the time of absence, or to one of equal rating, provided they are capable of performing former duties and provided the Company has received an acceptable reason for and/or authorized the absence. It shall be the duty of each employee to notify the Company of the reason for absence, to furnish evidence to support the absence and to keep the Company informed of the anticipated date of return to duty.
Accident and Sickness. 14.01 A Firefighter shall be entitled to eighteen (18) days sick leave per year.
14.02 During the first six (6) months of a Firefighter's probationary period he shall be entitled to one and one-half (1 1/2) days sick leave for each complete calendar month that he works. Upon completion of the first six (6) months of his probationary period, he shall have credited to his sick leave account one and one- half days (1 1/2) days for each remaining complete calendar month in that year.
14.03 Unused sick leave, may be accumulated to a maximum of eighteen (18) days per year. It is further understood that there shall be no limit to the total number of days a Firefighter may accumulate over the years.
14.04 A Firefighter may utilize sick leave allowance for absence from employment:
(a) caused by personal illness or physical incapacity caused by factors over which the Firefighter has no reasonable or immediate control, provided a Firefighter in receipt of an award under the Workers' Compensation Act shall be excluded from utilizing sick leave allowance, other than as provided for under Section 14.07.
(b) caused by exposure to contagious disease that in the opinion of the Medical Officer of Health might endanger the health of other employees by his attendance on duty.
(c) each full shift lost by a Firefighter shall be considered as one (1) day. If twenty- four (24) hour shifts are worked then twenty-four (24) hours should be considered two (2) days. Notwithstanding the provisions of this Article, sick leave benefits will not be paid to an employee who is absent due to an injury suffered while gainfully employed by any business enterprise which is liable for payments to the Worker's Compensation Board.
14.05 Payments from cumulative sick leave credits shall be subject to the following conditions:
(a) Unless other arrangements have been made a Firefighter shall, on each day of illness report, or cause to report such illness to the Fire Chief or his representative. He may be required to produce a signed certificate or certificates from a qualified medical practitioner for any such absence stating he is or has been under his care and is not fit to return to duty.
(b) Where a Firefighter is returning to work after sick leave for three (3) consecutive shifts or longer, the Firefighter shall produce a certificate from a qualified medical practitioner certifying that the Firefighter has been under his care and is now fit to return to duty.

Accident and Sickness. 24:01 Sick Leave means the period of time an employee is permitted to be absent from work by virtue of being sick, disabled, quarantined, or because of a non-work related accident not covered under the Workplace Safety and Insurance Act.
24:02 Sick Leave shall not mean any time absent from work due to an accident or disablement incurred, while employed by an employer other than the City of Guelph, where compensation for that accident or disablement is being paid under the Workplace Safety and Insurance Act through the other employer.
24:03 Notification Requirements for Absence:
(a) Employees who are unable to assume their normal duties on any scheduled working day must notify their supervisor prior to their normal starting time. Exceptions may be granted, if the employee has reasonable cause for not being able to contact their immediate supervisor prior to their normal start time.
(b) Employees returning to work after an absence of four (4) or more working days in duration must notify their supervisor at least one day in advance of their return to work date.
(c) The supervisor shall be responsible for maintaining the contact telephone number for employees in the respective work areas.
(d) The employee must call in on every day of absence unless an extended leave of absence for a specified period of time has been approved. Where the employee is hospitalized or confined for medical care the employee shall not be required to call in on a daily basis.
24:04 Short Term Disability (STD):
(a) A STD Plan, as per the Master Benefit Contract, will be provided to all full time employees and for part time employees hired to work twenty-one (21) hours or more per week. The City’s Insurance Carrier will adjudicate claims, based on the STD plan in the Master Benefit Contract. STD is paid by the Corporation to an employee, who is absent due to non-work related illness, subject to medical justification.
(b) Full time employees, as of the 1st of the month following ratification of the contract, will have the remainder of the cumulative sick leave hours carried forward but the balance would have no value on retirement, death or termination of employment.
(c) The carried forward cumulative sick leave hours could be used until depleted to top-up STD to one hundred percent (100%). After the cumulative sick leave hours is depleted, the employee may request to top-up their STD with non-cumulative sick hours, stat lieu bank, banked overtime, floater bank, vacation or personal days...

8.4 Upon retirement as per Municipal Pension Plan, death or release from employment of the Brantford Fire Department for medical reasons or disability, the employee shall be entitled to receive an amount equal to his/her salary for one-half (½) the number of days standing to his/her credit, and in any event, not in excess of the amount of one-half (½) year's earnings at the rate received by him/her immediately prior to the termination of employment.
8.5 Sick allowance will not accumulate when an employee is sick for an entire calendar month.
8.6 Where the Corporation requires a member to obtain a certificate or report from a medical practitioner, the Corporation shall pay any cost incurred in relation to the preparation of the certificate or report.
8.7 Employees off duty temporarily due to an accident or occupational disease compensable under the Workplace Safety and Insurance Act shall be paid full salary, not to exceed the employee’s pre-injury net weekly pay, and such salary shall be paid from the employee’s sick leave bank. Accident and Sickness. 7.01 Any employee off duty as a result of an occupational accident or occupational illness incurred in the performance of his/her duties, within the meaning of the Workplace Safety Insurance Act, shall be provided with free hospitalization and medical care, and full salary not to exceed the employee’s pre-injury net bi-weekly pay during such periods off duty. The full salary shall be considered as a W.S.I.B. benefit and employer top-up to net.
7.02 All Fire Department employees shall receive sick leave allowance according to the following schedule: Accumulated sick leave totals obtained as of December 31st, 1965 (AS PER FIRE DEPARTMENT RECORDS) shall be retained as recorded. Commencing JANUARY 1, 1966, all employees of the Brockville Fire Department shall receive sick leave allowance at the rate of one and one-half (1.5) days per month. Unused sick leave shall be cumulative one hundred percent (100%). In the event of a serious illness in which a member is required to use all of his accumulative sick leave, such period or sick leave time may be extended by the Council of the Corporation of the City of Brockville. Days to be counted are to be working days only. Recognized COMPENSATION DAYS shall not be deducted from such sick leave credits. Any employee taking advantage of this sick leave for more than forty-eight (48) hours shall, upon the request of the Fire Chief, furnish a medical certificate.
(a) Any Fire Department employee upon retirement on an O.M.E.R.S. Pension or upon his death prior to retirement, he or his beneficiary respectively shall be paid an amount of sick leave credits gratuities as per the “Municipal Act”.
(b) Any Fire Department employee upon retirement on an O.M.E.R.S. Pension or upon his death, he or his beneficiary respectively shall be paid an amount calculated by multiplying the number of sick leave days to his credit times the rate of a day’s pay and said rate to be that rate which the employee received immediately prior to his retirement or death, but in no event shall these gratuities conflict with “The Municipal Act”.
(c) For the purpose of calculating the above in this Agreement, the monetary equivalent of one day of pay for employees working in the Fire Prevention Division and Training Division shall be one two hundred and thirty-fourth (1/234th) of the amount of the employees annual salary rate. Accident and Sickness. (a) A regular full-time employee who is absent by reason of incapacity caused by an accident or occupational illness occurring while on duty and who is granted temporary total disability benefits from the Workplace Safety and Insurance Board shall be provided with hospital and medical care in accordance with the Workplace Safety and Insurance Act and will be paid the difference between the amount of such award and the employee’s basic daily wage. The difference between the award and the employee’s basic daily wage shall be calculated so that the employee’s net (take-home) pay matches but does not exceed the employee’s normal net (take-home) pay. Such payment will be authorized and continue except where:
(1) the employee has not formally elected to claim compensation in cases where a third party is involved;
(2) the Workplace Safety and Insurance Board ceases to authorize payment of temporary total disability benefits;
(3) the employee is fit to return to work;
(4) the Workplace Safety and Insurance Board awards a permanent total or permanent partial disability benefit;
(5) employment terminates; or
(6) the employee takes an unreduced retirement pension from OMERS.
(a) All regular employees shall have placed to their credit, one and one-half (1-1/2) days sick leave for each full month of employment, but are not entitled to draw sick leave pay until they have accumulated three (3) months service with the Corporation. For employees in Suppression and Communications who work a 42 hour work week a day shall be earned at the rate of 12 hours; and for employees assigned to a 40 hour work week a day shall be earned at the rate of 8 hours.

8.1 Employees off duty as a result of an accident or illness shall receive full salary during such periods off duty and the employee's sick leave accumulation shall be deducted one day for each day of such absence.
(a) For Employees in suppression division one sick day equals 12 hours, however, if an employee leaves work sick, such hours will be pro-rated for those hours worked.
(b) An employee who books off for more than one (1) twenty-four (24) hour shift shall be required to provide the City’s medical certificate of disability (Dates Clause Changed: 78, 2019)

8.6 Where the Corporation requires a member to obtain a certificate or report from a medical practitioner, the Corporation shall pay any cost incurred in relation to the preparation of the certificate or report. (Dates Clause Changed: New 99)
8.7 Employees off duty temporarily due to an accident or occupational disease compensable under the Workplace Safety and Insurance Act shall be paid 15% top up for 5 weeks paid by the Corporation and thereafter shall be paid from the employee’s sick leave bank such that their net take home pay will be neither more nor less than the employee’s pre-injury pay. When the monies are received from the W.S.I.B. they will be converted into hours and credited back into the employee’s sick leave bank. Effective Jan 1, 2023, the top-up will be maintained at 15% but will be extended for up to a ten (10) week period. (Dates Clause Changed: 78, 87, 99, 2019)
Accident and Sickness. The Accident and Sickness (A & S) weekly benefit is $390 effective November 3, 2008 (no change).will increase to $400 effective October 1, 2012; $410 effective October 1, 2013; and $420 effective September 29, 2014.
