Ensure compliance with all applicable federal and state laws, rules, regulations, standards, guidelines, and policies in effect on the beginning date of this Contract unless amended, including but not limited to, the Rehabilitation Act of 1973, as amended by Public Law 114-95 (enacted December 10, 2015) and Texas Human Resources Code § 117.080.
2.3. Ensure compliance with all state and federal statutes and regulations, HHSC rules, policies, procedures, and guidelines governing the Texas ILS Program, including but not limited to, Texas Administrative Code TAC 357, that is available online and can currently be accessed at: ▇▇▇▇▇://▇▇▇▇▇▇.▇▇▇.▇▇▇▇▇.▇▇.▇▇/public/readtac$ext.ViewTAC?tac_view=4&ti=26&pt The foregoing rules in TAC Titles 26 as they relate to the ILS Program may be further modified, revised, and moved within their existing title or into another title during the term of the Contract. In the event of such modifications or moves, Grantee shall be required to comply with said rules.
2.4. Ensure and maintain compliance at all times with the current HHSC Independent Living Services Standards for Providers that is available online and can currently be accessed at: ▇▇▇▇▇://▇▇▇.▇▇▇.▇▇▇▇▇.▇▇▇/handbooks/independent-living-services- standards-providers, as it may be modified or revised.
2.5. Comply with all revisions to the HHSC Independent Living Services Standards for Providers by the effective date of the notice, which may be revised at any time, in 2.6. Comply with all requirements under 2 C.F.R. Part 200 and the Texas Grant Management TxGMS ▇▇▇▇▇://▇▇▇▇▇▇▇▇▇▇▇.▇▇▇▇▇.▇▇▇/purchasing/grant-management/. 2.4 Comply with all revisions to the HHSC Independent Living Services Standards for Providers by the effective date of the notice, which may be revised at any time, in HHSC’s sole discretion, as deemed necessary.
2.5 Ensure and maintain compliance with the most recent version of the HHSC Independent Living Services Standards for Providers.
2.6 Perform all services and conduct all communications to consumers, sub-contractors and HHSC staff in a professional and respectful manner.
2.7 Ensure and maintain the performance measure for VOLAR Center for Independent Living, is 109 consumers served (i.e. consumers determined eligible with an independent living plan completed) per fiscal year.
2.7.1 The service provider must meet at least 90 percent of this goal as determined by HHSC’s data reporting system.
2.7.2 The service provider must provide a written explanation of the reason for a variance either below or above the performance measure target within 45 days of the Contract period end.
2.8 Comply with all ILS Program reporting requirements, including the following:
2.8.1 Records must support all data reported, including that amounts in fiscal reports match amounts in accounting records.

2.1.1 Ensure compliance with this Grant Agreement, including these Grantee Requirements.
2.1.3 Comply with HHSC rules, policies, Grant Agreement requirements, and applicable instruction manuals regarding the collection and timely submission of complete and accurate data. Ensure that complete and accurate data is submitted into the FVNet Data System by the established due dates and that there is adequate internal control, security, and oversight, for the approval and submission of such data. FVNet is the HHSC secure file transport protocol portal for FVP data.
2.1.4 Ensure that personnel paid from the funds received as a result of this Grant Agreement, if applicable to the position or services being rendered, are duly licensed and/or qualified to perform the required services.

Code during the term of the Contract. In the event of such modifications or moves, Grantee shall be required to comply with said rules.
2.3 Maintain an appropriate Contract administration system to ensure that all terms, conditions, and specifications of this Contract are met.
2.4 Comply with HHSC rules, policies, Contract requirements, and applicable instruction manuals regarding the collection and timely submission of complete and accurate data. Ensure that complete and accurate data is entered into the Texas Kids Intervention Data System (“TKIDS”) by the established due dates, and ensure that there is adequate internal control, security and oversight for the approval and submission of such data.
2.5 Comply with all requirements under the Texas Grant Management Standards (“TxGMS”), currently available online. The Texas Comptroller of Public Accounts, from time to time and in its sole discretion, may revise the online link provided in this subsection. ▇▇▇▇▇▇▇ is responsible for contacting HHSC at any time that Grantee is not able to access the online materials to request the updated link. 2.6 Cooperate with HHSC efforts to collect revenue for eligible costs that were not previously reimbursed by Medicaid or other payment sources.
2.7 Ensure that for each funding source approved in Grantee’s budget as locally collected federal, state, local, or private funds: the source is verifiable from Grantee’s records; funding from the source is not included as a contribution for any other program; program costs are necessary and reasonable for proper and efficient accomplishment of program objectives, and allowable and allocable under the applicable cost principles; and these funds are not paid by the Federal Government under any other award.

Organizations that fail to submit required documentation in a timely manner may jeopardize future grants and/or grant payments. Should you need a due date extension, please forward your request, prior to the due date, to ▇▇▇▇.▇▇▇▇▇▇@▇▇▇▇▇.▇▇▇ with the requirement type (e.g. Progress Report, Final Report, etc.), an explanation for your request (including the reason for the anticipated delay) and your preferred new due date.
Grantee Requirements. Receipt of Grant funds is dependent on Grantee's compliance with certain requirements. Grantee must:
a. Complete and have CDPH approved myCAvax Sections A and B; Be in good standing myCAvax
b. Have full and active CDPH approval for VFC practice Sites in myCAvax.
c. Order or transfer at least one complete Covid-19 vaccine order for infants and toddlers through myCAvax
d. Respond to all PHC and CDPH requests within 3 business days.
Grantee Requirements. The Grantee shall perform the following services for beaches located along the Great Lakes that are used by the public for recreational use:
1. Obtain user id and password from the beach monitoring program manager. Identify and update organization information on the DEQ beach monitoring web site at ▇▇▇▇://▇▇▇.▇▇▇.▇▇▇▇▇.▇▇.▇▇/beach/.
2. Identify beaches or similar points of access located along the Great Lakes that are used by the public for recreation. Report location information on the DEQ beach monitoring web site; information includes location name, location description, waterbody name, waterbody type, site type, if located in a state park, coordinates for latitude and longitude in decimal degrees for the endpoints and center point of each location, an 8-digit hydrological unit code, beach length in meters, the county and township location, facilities available, and optional description of amenities.
3. Notify the city, village, or township in which the beach or point of access is located prior to conducting monitoring activities.
4. Update the QAPP for the beach monitoring program prior to monitoring beaches. The QAPP must be consistent with requirements in the Public Health Code, the Part 4 Water Quality Standards, and the BEACH Act, and must be approved by the State prior to initiation of monitoring. QAPPs that have been approved and have current approval letters from the DEQ will satisfy this requirement.
5. Monitor beaches according to approved QAPP.
6. Beaches will be monitored according to R 323.1062 of the Part 4. Water Quality Standards (WQS) promulgated under Part 31, Water Resources Protection, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended. Subrule 62
(1) of the WQS states, "All waters of the state protected for total body contact recreation shall not contain more than 130 Escherichia coli (E. coli) per 100 milliliters (ml), as a 30- day geometric mean. Compliance shall be based on the geometric mean of all individual samples taken during 5 or more sampling events representatively spread over a 30-day period. Each sampling event shall consist of three or more samples taken at representative locations within a defined sampling area. At no time shall the waters of the state protected for total body contact recreation contain more than a maximum of 300 E. coli per 100 ml. Grantee Requirements. Grantee will use the Grant Funds to:
A. Increase the availability and sustainability of AAEBIs provided through local parks and recreation.
B. Participate in NRPA’s virtual Grantee Kick Off Call on February 1, 2023.
C. Participate in the Supporting Healthy Aging through Parks and Recreation Community of Practice (CoP).
D. Work to enroll 150 participants in Walk With Ease by July 31, 2024.
E. Collaborate with NRPA to conduct evaluation and AAEBI tracking activities and submit information quarterly to NRPA as requested regarding:

Grantee must develop a sex trafficking prevention needs assessment program that meets the following funding match requirements: Obtain committed matching funds which may include cash or in-kind contributions from a person or organization, this may not include money from state or federal funds. Non-state or federal sourced funding may include gifts, grants, or donations from any person or organization. The match must equal to 100 percent of the grant amount; Report all cash and in-kind match used to support the grant program; and Provide evidence of committed match in accordance with Section .24, Subpart C, Uniform Grant Management Standards (UGMS). HHSC Monitoring The Grantee and any subcontractors associated with this Contract agree to permit on-site monitoring visits and desk reviews, as deemed necessary by HHSC to review all financial or other records and management control systems relevant to the provision of goods and services under this Contract. The Grantee will include this requirement in any subcontract associated with this Contract.
